Bharat Kumar FORUM "ACR: No More Confidential"- Supreme Court The ACRs play a very vital role in the career of a government servant. Timely promotion and recognition are the basic motivations for a government servant So DoPT should evolve such transparent Performance Appraisal System, which should have least subjectivity and no room of unfairness and prejudiceness. In Central Staffing Scheme, the DoPT has fixed minimum bench-mark of ACR as 'Very Good' for empanelment of Deputy Secretary, Director, Joint Secretary. If some officer is appointed as DS/Dir/JS, it means his/her performance had been Very Good and above. So such officers are fully capable to deliver the results. Our duty is to provide congenial environment. There are examples in some ministries that some officers are not allowed to get adjusted in the new environment. Some high-headed people forget if such treatment was given to them, what would have been their reaction? First of all, provide them stage only then they can perform better. Moral of the story is that one should play with anybody's career. Moreover in the recent judgement of Supreme Court(CA No.7631 of 2002: Dev Dutt Vs Union of India), ACR in no more confidential document. It can be shown to the concerned official. The Supreme Court has held, "Non-communication of entries in the Annual Confidential Report of a public servant, whether he is in civil, judicial,police or any other service (other than the military), certainly has civil consequences because it may affect his chances for promotion or get other benefits. Hence, such non-communication would be arbitrary, and as such violative of Article 14 of the Constitution." The DOPT is requested to issue, in this regard, necessary directions to all the Departments/ Ministries in the interest of the country as fear of ACR grading travels in the mind. The transparecy in the ACR System will bring efficiency in the working of Government. Meenakshi Roy Letter to ministers: PSU appointments no deviations from guidelines and standing instructions: In reference to not in favor of jumping the queue, I would like bring to notice the PM's instructions. Prime Minister Manmohan Singh has earlier on August 13, 2004 written letter to his ministerial team to ensure that the ministers strictly follow the guidelines laid down for the selection and appointment of directors of public sector undertakings. The prime minister's letter indicates his concern over political intrusion in the function of PSUs. Extracts of his letter are reproduced He mentioned that " It is necessary to ensure that guidelines and policies evolved by the Union government with respect to the structure, composition, selection, appointment and service conditions of the board of directors and senior management personnel are strictly followed. There are standing instructions and guidelines on these matters and have been approved by the Appointments committee of the Union Cabinet and Department of Personnel and Training from time to time. While requesting you to ensure that there are no deviations from these guidelines and standing instructions, I am directing the Cabinet Secretary to closely monitor the compliance. Needless to stress that delays and deviations are detrimental to the efficient functioning of public sector undertakings." D Saxena Pay Commission - turbulence at the top. Self serving machinations of senior bureaucrats has led to a situation where the report is being called pro-IAS. Actually, the report is pro-Secretary. Considering that the report was drafted by a Secretary, it was only to be expected. Up to 2005, the difference in pension of officers retiring at the levels of the Secretary and Additional Secretary was minor. The difference in case of officers retired/retiring 2006 onwards will be huge. Officers up to the rank of DGP have been placed in a time scale starting at the Director level, while the Secretaries have been given a huge jump. Officers of most Class I services can aspire to reach the level of Additional Secretary to Government of India. There is no justification for such a huge gap whatsoever. But decision making is with those (mostly, but not all) who are at the level of Secretary. V. C. Mehrotra Assertion under question! Reacting to Lt Col Dewan's views(11-8-08),I do not agree with the "reported" assertion of the Cabinet Secy that he is not in favour of jumping the queue of empanelled officers. This is not corroborated by actual facts. Toppling panels recommended by high -powered bodies, Search Committees, Screening Committees and the like for considerations other than merit, have become the order of the day. These loud whispers can be heard in the corridors of PSUs, the government ministries, departments and now even in the groves of academia! Nobody (read, everybody ) knows who is controlling the show and how rewards are given in the government on the basis of rare attributes like: networking , boundary management and last but not the least proximity to IAS coterie. There are instances galore under successive coalition governments to substantiate the above conclusion. The readers are expected to introspect on this important matter and be guided by the dictates of their conscience. Truth will come out sooner than later! A K SAXENA(A retired civil servant) Clarification on Rule 6.2.2: Only for private sector/ NGOs A clarification on article of S Bose - I do not think UN deputations are under Rule 6.2.2, these are part of the normal deputations to International organisations for people who get selected applying to an open advertisement, and which have been in place for many years. As per the rules such deputations are allowed for a maximum period of 5 years after which the officer has to resign from service, although there are any number of examples of officers in the international and other organisations who have stayed on for much longer, without resigning. The IAS civil list also shows names of some officers who are "missing" for a number of years (presumably working abroad or in such organisations without the knowledge of the government, but their names continue to appear in the list) - one cannot think of any other such liberal employer anywhere in the world. Nevertheless, it is creditable that our officers get selected to international organisations through an open international competition and they should be encouraged. Rule 6.2.2 was created a couple of years back to benefit such cases who wanted to go to the private sector or some unheard of NGOs and organisations that were not covered under the above, and still retain the government job, and this is not correct. The PM has taken a right decision and deserves to be congratulated. Let our "Victorian era" generalist civil service progress to an environment of today's free economy where there is a 2 way movement of professionals between the private sector and government, this will benefit both and the country. A reader Retirement Age: We are interested in the implementation of 6th CPC and not increase in retirement age. If the retirement age is increased; then it means government does not want youth in this country but only old persons. This will kill the aspirations and determination of the youth and allow the old persons to live retired calm life in office with a good free salary and other facilities. In this case, a youth will get employment only after 30 or 32 years and take another 5-6 years to settle down. By then everything in him would have evaporated and he will be of no use. Therefore, Government should not even by mistake think of increasing the retirement age just for the sake some selfish persons who want to solve their pending domestic work; stay in government accommodation and earn rent from their house as a separate income. Hope PM and other concerned officers will not encourage this increase in retirement age as they must know better about its implications that ordinary persons like us. R P Saran Sixth Pay Commission The position described by Mr. Ajay is really acceptable and it is a general expectation of all class of employees that there will be a justification with them also. But in actual it is never done in a well justified manner in the pay commission. Every one whether in lower post or higher post, have a contribution of its respective level towards the service rendered by them to the nation. An administration can not be completed in the absence of administered. Without all the existing level, an organisation can not function properly. So pay commission and review committee must keep it in mind that justification is made to all categories as thought for higher officials. It is always true that a handful of salary, good working environment, good fooding and good living condition not only reduce corruption but also increases efficiency. Large difference, less carrier prospect & tensed environment also hand to mouth position only leads to less efficiency. A person can work much better if he work from his heart and fresh mind instead of forcing on him for some work. We must change our views than the British administration towards the brotherhood relation and intimacy with the subordinates and reduce the difference. A K Banerjee Public-Private Partnership AI's decision to shut down certain foreign sectors will facilitate private airlines who are likely to fly those routes .Certainly a very good example of public-private partnership conceptualised by politicians and being ably executed by the bureaucracy. Keshav Prasad IRS transfer policy is unique in this world. Yes it is strange that the IRS is the only one which has the following unique features in its transfer policy: 1. Advising officers to represent against transfer orders [though after joining at new station 2. Child education clause [this one is really funny and reduces the service to clerks] 3. Transfer seasons lasts for 8 months every year 4. Officers not due for transfer are asked to give choices 5. The policy has no clause for first in first out which is an essential clause of every policy 6. Deputation clause, exempt posts clause, area stay, cycle stay, max station stay, [when a simple 5 year continuous term in a A city would suffice to rid the cadre of all its problems] 7. No clause for last posting before retirement [which is there in every transfer policy] Wad CGHS affairs I am a regular reader of your site. It gives a wide knowledge about the Government sector and PSU. Through this site, I share my recent experience in the CGHS dispensary. Recently I got severe fever in the morning and I immediately rushed to the CGHS dispensary, Laxmibai Nagar. I got the slip to meet the Doctor from the counter and my number was 10. That lady Doctor was quite busy gossiping with his fellow doctors and talking over phone about her family matters. After a great struggle, I met the Doctor and revealed my problems. Even she was not willing to check up properly whether I am having fever or not, she immediately gave usual white and red tablets. Later in the evening, I rushed to some private hospital and after the diagnosis, it was typhoid. I am of the view that the whole system should be revamped or better to close the CGHS dispensaries and give a free hand to the Government employees to go to any private hospital for their treatment. Apart from the fact, still there are kind hearted capable Doctors are available in the CGHS dispensary. M Senthil I think this website is not meant for IAS only Apropos JMS' view that number of DGPs should be less and that policing is just one small part of government functioning and that the number of DGPs are naturally supposed to be much less; let me add that the IAS is not the Government, they are as equally a small part of Government as the IPS. Let me add that the number of Secretaries should also be far lesser, the way the numbers have been increased over the years to merely accommodate entire batches of the IAS is well known. Why do we need to have entire batches of the IAS in the rank and pay of Chief Secretary? There should be only one person in the entire state in that rank and pay, by logic. Some of the IAS officers wish that they should get the rank and pay of Joint Secretary to Government of India in 14 years (by executive fiat) and the IPS and others should do so in 20 years! Their capacity for sophistry never ceases to amaze. They want (and have) everything, and simultaneously want to deny others their legitimate due. Please publish this rejoinder as you have published JMS' views, in the interest of equity. Otherwise, please stop publishing such statements sent to this website by JMS and his ilk. I presume this website is not an "IAS only" website. Vijay Kumar Disparities in IFS promotions In many states IFS (forest ) even 1992 batch has not got selection grade....leave alone SAG! UP is an example. 1992, 1993, 1994, 1995 batches are still waiting to get a non functional Selection grade after 14 to 16 years of service! Imagine not getting promoted from a DFO to a Conservator even in 16 years! But who is listening? A Kumar Why not other services Who is this Ravi? On what grounds does he say that IAS can continue in Service while other Services' officers have to resign to go to UN. If there is any such rule or frequent cases, we may please be enlightened.
