Bombay High Court on December 4,2008 ;delivered its judgement on the writ petition filed against a notice issued by the Income Tax department under section 201(1) of the Income Tax Act, 1961 to Vodafone International Holdings BV asking it to show-cause as to why it should not be treated as an assessee in default for failure to deduct tax on payment made in respect of transfer of securities relating to Vodafone Essar Ltd.In the writ petition, the validity and legality of the notice issued by the Income Tax department was challenged. The High Court has dismissed the writ petition with cost. The copy of the judgement is still to be received.The decision of the High Court has strengthened the hands of the Income Tax department in its attempt to bring to tax in India transactions involving transfer of assets situated in India between entities located outside the country.

Though your site is giving news about the Indian Railway-General Managers and Financial Advisors, but Rail Bhawan website seems to be heading for a back-gear with following deformities
1. 2005 gazette list displayed on the website, as we are heading towars 2009 - http://www.indianrailways.gov.in/personnel/gazetted-establishment/index.htm
2. Till date Manual as per RTI Act and Directory of employees, which is used to be published and available in hard copy not published on the website of Rail Bhawan and other Railway Zones. Forget about the stations or division.

Regarding not showing the names of Railway Board chairman and members, Revenue board Chairman etc, even the names of members of Telecom Commission, who are ex-officio secretary to GoI, are also not shown. These names used to be listed some time back. Is it that, IAS gradually wants to sideline all non-IAS services in this respect also?!

I am sure they will come on surface when all cools down to take their pie of sweet and power. Why don't they come forward to take up responsibility. They can only cause hindrance and stop growth to reap benefits for their own selves. We need to wake up. Give the dues to deserving ones the Uniform people. Don't stop the proposals for modernizing and updating of forces. Check certainly the financial genuinity but not question the intent of requirements. Don't blame politicians, they come and go. We people who vote remain so wake up to answer the call of election the power in your hand. Don't accept complacency, check as a citizen if any thing wrong around you. We all individuals should share the blame. Media is doing good job.

Child Care leave
DOPT has been very harsh on the implementation of the Child Care leave. Instead, it should have taken a way out so that it could not be misused, without hampering its main objective. Instead of putting in that clause that a women employee should exhaust Earned Leave first, it could be like it can be taken for a period of maximum 2 weeks and in case of emergency, may be extended to one month, if the competent authority so thinks. What I feel is that if you are taking a leave for the care of your child, either for his/her exam or for sickness, it could be for maximum 2 weeks. This would solve the purpose of the women employee who now will have to spend her prescious earned leave for taking care of the child. Some way out should have been evolved instead of taking such a harsh and unjust stand. Women who proceeded on CCL for 1 year or more, just because their child is 17 years and she has just 1 year left, her leave in the first instance should not have been sanctioned as in the original order also it was clearly stated that it should be sanctioned by the competent authority. Instead, leave in proportion to the period of service should be the criteria for giving CCL. What I mean is that there could have been other ways to curtail the misuse of CCL, some not so harsh ways, instead of such harsh decision. If all the Earned Leave is exhausted, then how would a women employee take leave for her own sickness or any other needs. Wouldn't she be forced take leave on the pretext of taking care of the child. I think DOPT must give this decision a second thought and take a way out so that maximum benefit is being derived without hampering the official work.

Need for code of conduct for politicians
There should be code of conduct for the politicians also like government servants. Their misdeeds and misconduct should be subject to scrutiny under special law. Those who are found wanting in their assigned duties should be proceeded against and severely punished. The drama of resignation as an alibi to criminal misconduct shouldn't be accepted. When they are enjoying the luxury of plum posts at the cost of common man, they should be equally accountable for their failures.

Important issue raised by Ms Kiran Bedi
Yesterday night there was a discussion on the 26/11 terrorist attack in Mumbai in the 'face the nation' programme telecast by CNN/IBN7. One of the important issue raised by Ms Kiran Bedi (does not require any introduction) was the greed of faster promotions by the Babus (IAS) and their encroachment in the other ministries irrespective of their qualification and experience. She squarely blamed the government for placing IAS officers as Security Advisors or Defence Secretaries etc for which they are not at all competent. And she held these babus responsible for the system failure besides the politician. She strongly advocated the postings from only IPS cadre in the deptt/ministries dealing with security related issues because of their proven expertise.

Average citizen is seething with momentary rage
The nation wide indignation at the recent turn of events is palpable and the average citizen is seething with momentary rage. It is easy to point accusing fingers, trade charges and pronounce peremptory verdict based on our perception of the subject. However, the incident is a microcosm of the wider unfortunate reality which we tend to ignore only at our collective peril. The lack of coordination is visible not merely with regard to the intelligence network and the security set up but is evident in all walks of life. The institutional mechanisms seldom serve us in good stead. Instead, petty and puny individuals have been either propped up or have maneuvered to take the mantle on themselves to run the show so long as the going is good. Yet, none is honest and conscientious enough to accept the blame for the failures either of omission or commission. The malady applies not only to political leaders but to all the organs of the State. The travesty of the omnipotent Parliament and the State Legislatures, the omniscient Judiciary, the all pervasive steel frame, the majestic and magical Planning Commission and innumerable high powered Commissions, Councils, Boards et al is a living testimony to the severe degradation that has set in our polity. Our individual lives are no exception to this phenomenon.

Bureaucrats have lost their position to advise ministers
Bureaucrats hanker so much for postings that they have no guts to advise minister for the right course of action. Files of important matters keep pending or keep circulating from table to table. What a section officer notes in the file is approved ditto without any other authority applying its brains. These files may be on all kinds of matters such as collecting intelligence, coordination between various agencies, measures to boost economy, improve investment climate etc.
Bureaucrat cannot speak his mind in personal capacity in public. The service rules were framed by British to keep babus enslaved so that babus do not criticise the British. Same rules have continued. Bureaucrat can not express himself so he stops thinking and stops taking stand on issues concerning the country and the society. Time has come that archaic service rules are changed.
