Are the Immovable Property Returns open for public scrutiny?
¨ The Central Information Commission (CIC) has held that the Immovable
Property Return (IPR) filed by an Officer is in Public domain and should
be freely disclosed.
¨ Further held that it is a third party information and the concerned
Officer should be given an opportunity to make a submission regarding
whether the information should be disclosed.
Comments:
· Under section 11(1) of the Act, the submissions of the third
party shall be kept in view while taking a decision about disclosure
of information.
· All information which is related to or originated in person
and which is unrelated to a public activity or interest, should qualify
to be personal information under section 8(1)(j). As per the definition
of Sensitive Personal Data under section 2 of UK's Data Protection Act,
1998, which the CIC has relied upon repeatedly, IPR would qualify as
personal information.
· IPR is available with the Public Authority in fiduciary capacity
which is exempt from disclosure under section 8(1)(e), unless the competent
authority is satisfied that the larger public interest warrants the
disclosure of such information.
· The onus is on the appellant to prove that the public interest
in disclosure outweighs the harm to the protected interests.
One has to be vigilant to protect his personal information.

Bonus : The results of valuation as at 31.03.2008 have been announced.
The result show that the Corporation has 23.39 crore for in force policies
in its books. The Reversionary Bonus level has been maintained at the

ranging from 11% to 40% for terms spanning between 20 years and 40 years.
The amount distributed to the Policyholders by way of bonuses is Rs.
18,885.40 crores as against Rs. 17,231.30 crores of last year showing

The dividend paid to the Government this year is Rs. 827.93 crores

Accountability of the Civil Servant and Politicians?
Recent happenings have taught India that enough is enough. I am
happy to read that Mumbai public is on the road & fully awakened
now and is grilling the civil servants and politicians through peaceful
methods. It is a good sign. I am sure other Indians should also join
them peacefully. For the next ensuing elections people should field
candidates who have clean slates, who declare their full assets in advance,
give an update of their assets from time while in power and give their
plan of action for their area/country's development. Media can play
a vital role by helping them in free publicity. These candidates should
have a cleanest background and be accountable to their areas jurisdiction
and country as a whole. Unless we are awake these things will keep on
happening. Once politicians are accountable, civil servants would follow.
Anyone who is corrupt and does not deliver in government job must go,
permanency in the Government job be removed with immediate effect.

Bureaucrats who criticise their political masters invariably suffer
and repent. On the other hand when a mutually profitable understanding
develops between a bureaucrat and his political master they work in
a cohesive manner with complete collusion and that does not disturb
the government. Such understanding not only ensures good in-service
days but also secures better post retirement days. So why should bureaucrats
advise their political masters at all unless it is for strengthening
the mutually profitable understanding between the two. Why collide when
it is better to collude.

Everyone doubts capability of police to fight terror mechanism !
Everybody in this website and on the news channels is talking about
some or the mechanism to deal with the terror threat after the Mumbai
incident. In this process almost everyone has doubted the capability
of police to fight the terror mechanism and in this process have further
done a great damage to the credibility of Police. We may call our Police
corrupt, inefficient and incompetent but it must be accepted that this
is the only mechanism that is fighting with all sorts of crimes &
mishaps in the country. For a common man despite all the shortcomings
police is the only agency of hope to help in case of distress. I agree
that it may not be providing foolproof result but it certainly is giving
some results. My point here was not defending the failure of Police
but it is that by again and again indicating that we have no faith in
the police system in fighting terror we are again making an established
system of law & order defunct. People should discuss about why the
police failed and what is the real problem with the Police system, about
their low morale rather than simply ignoring the Police role in fighting
terror and appreciating NSG/Army. There is no doubt that NSG has done
an exceptional Job and deserves kudos but we must remember that NSG
is also being headed by a Police Officer. Think with an open mind on
how Police system is to be improved. The most important reason that
I feel is that the morale & motivation of the entire Police force
specially the one at lower levels is abysmally low and at the same place
there has been lot of indiscipline in the force. These issues needs
to be addressed very seriously. All sorts of terror/disaster fighting
agencies may be required but without a good police system there wont
be any success

A new gift endorsed by the 6th CPC
I have seen lot of discussion on the CCL. I am not fully aware of
this subject but I understand that it is a new gift endorsed by the
6th CPC, accepted by the Government and subsequently amended as it stands
now. Since this is not part of the original service conditions, I think
much should not be read into this. But since at one stage it has been
accepted, the Government should consider this benefit to the female
government employees by further amending it by inserting the provision
that female employees can avail this leave four times during their entire
service career (limiting the children to two) and during the public
examinations (read February to April) for the 10th standard and 12th
standard only. This will have the actual benefit of the provisions and
the misuse can be totally avoided.

Rubbish and illogical leave
CCL: If the working lady says that she has to take care of her husband
and family and so she requires CCL, then what is the husband doing,
is it not his duty to take care of his wife and family. After all the
salary of his wife is for his family. If his wife proceeds on CCL; say
some other employee whose wife is a housewife is given the work of that
lady; will he help that family or CCL rules will compensate that housewife.
On the whole this is a rubbish and illogical leave which is called CCL
as this is something natural and everone after raising a family passes
through this stage of bringing up their children. The government cannot
be exploited to this extent on the pretext of being a lady. Nowadays,
things have changed a lot and anybody can do well without this leave.
May be persons who want to avoid office at other expense are interested
in this CCL.

Are we Truly Patriots?
The incidents of the last week disturbed us.
We shouted hoarse at the politicians.
We took candlelight marches.
We joined hands together and waved flags.
We cancelled parties and marriages and shared with the grief of the
bereaved families.
Now it is time for some introspection.
We blame the politicians and the government.
But deep in our conscience, have we done everything right.?
Can we call ourselves patriots?
Can we sincerely say that we Indians are truly united to the national
cause.
Aren't some of us still look down upon the lower castes and the poor
class.
Aren't some of us fight for getting quotas rather than achieving
anything on merit?
Aren't some of us pay bribes to the same sarkari babus we curse for
getting our work done?
Aren't some of us working as babus demand bribes for doing our duty?
Aren't some of us turn a blind eye when a man lies injured in a street
and needs urgent medical help?
Aren't some of us evade taxes and still expect the government to do
something for us?
Aren't some of us never exercise our voting right but still blame the
politicians?
Aren't some of us vote on party lines, caste lines, communal lines and
never on national interest?
Aren't some of us took sides during the Godhra riots and the Babri
Masjid demolition?
Aren't some of us took sides during the violent agitation against the
North Indians in Maharashtra?
Aren't some of us never keep our surroundings clean and always expect
our municipality workers to do it for us?
We must ask many such questions and invoke our conscience as to where
we stand regarding our duty towards our beloved Nation?
We are always aware of our fundamental rights but take our duties for
granted.
Someone will do it for us, that is our Attitude.
Why not we?
Why not some of us stand in the elections and become better managers
of the nation?
Take the example of our own co-operative housing society.
Many of us blame the secretary and the committee members but refuse
to
take the responsibility ourselves?
If this is our Attitude, we have no right to blame our politicians.
It is easy for a Narayan Murthi or Ambani to run their companies where
a paricular discipline and education and experience is expected of
their staff?
But to run a nation with a largely illiterate and caste driven nation,
it takes a mammoth task to take the country along the path of progress
with a sense of security.
Let us divert our anger constructively towards finding solutions to
the problem.
Not many of us can directly contribute towards the intelligence,
towards the army, towards the police and towards the governance
aspect.
But by merely doing our respectively jobs and staying united as the
citizens of the country, we can build a healthy, strong and vibrant
society where no terrorist can dare to attack?
Last but not the least, let us not feel guilty about the attack and
stop celebrating and postponing marriages?
Those who have died have had a honorable death compared to the death
of those cowardly terrorists who went on a shooting spree throughout
the city of Mumbai.
These cowardly terrorists neither have a place in the hearts of any
people nor have a place to die.
Even their nation rejects their nationality, their own parents and
relatives have destroyed their young dreams and let them die a
horrific death. No one cries for these terrorists, they neither lived
the life of a human or that of an animal.
So let us learn from our mistakes and strengthen our cause towards
nation building.

Pak needs solid response, not evidence
Now, Pakistan wants solid evidence. Why do we wish to indulge in
a verbal duel with Pakistan? Pakistan is good at verbiage, treachery
and terrorism. We must address these issues in reverse order, wipe out
terrorist camps based in Pakistan aided/ abetted by its ISI, the other
two can be sorted out later. They need a solid response, not solid evidence.

What our Intelligence Agencies were doing?
No doubt it is true that our neighbouring country is involved in
Mumbai massacre, but what our Intelligence Agencies were doing? Were
they attending picnic parties? Now time has come to fix responsibility.
It is really surprising to know that inspite of repeatedly alerting
the different agencies about the possible threat, no action was taken.
How is it possible? There should not be any excuse from any corner.
Either the officers/officials responsible for ignoring such messages
should leave the job or the Government should be very touch and sack
them immediately. As because, we being the citizens of this country
are totally unsafe being in the hands of these sleeping white elephants.

What's the point in setting up new security agencies ?
What is the point of setting up new security agencies and adding
dandawallah constables? We need to concentrate on securing our porous
borders and gear our judicial system to meting out punishment without
appeal, equipping state and central police forces with technology (rather
than constables, reinforcing the coastguard, giving powers to the Navy
to board ships, provide ground level radar cover to our 6000 km coastline,
issuing smart citizen cards, et al. There is no use in saying that states
have a low constable to population ratio and then diverting the extra
heads to domestic help duty or VIP duty. Without any respect for law,
all enforcement is meaningless.

Does it make sense?
Yester night I attended the birthday of granddaughter of my friend.
I was surprised to see four candles on the cake since it was girl's
first birthday. Then parents explained that they did not like to extinguish
candles. They have lighted four candles in the belief that the girl
will spread light in four directions viz North, South, East and West.
After singing customary "Happy Birthday to You" they chanted
some Shlokas and explained their meanings.
I was impressed and I think I shall follow this. Does it make sense
to any other viewer?
