From Day One, I have supported the civilian nuclear deal for only one reason: I wanted no discrimination against India, vis-a-vis China, for doing business in nuclear technology, equipment and materials with any country.
No apartheid against India, please!
I am neutral on the question of whether or not India actually should set up new civilian nuclear reactors. It's a matter of economics which the experts will decide.
But -- please, please NO discrimination against India.
India must be allowed to take whatever course it chooses in meeting its energy needs. If any one disagrees and says China should have a choice but not India, by definition, he or she can't be a friend of India.

However, one has every hope that Congress will approve, without delay, the United States-India agreement on civil nuclear cooperation, so that American companies do not lose out. It's also important that when the US conveys its final terms, they do not contain conditions which will be unacceptable to India and which other competing countries will not ask of India..
If and when India floats tenders, more than one country is likely to respond. India will then choose the winners based on cost considerations plus all other relevant factors. If the US imposes conditions unacceptable to India which some other country does not, the US will lose out. However, one hopes that powerful US business interests will ensure that American terms of sale to India are not out of alignment with those of competing countries.

Are Group 'B' and 'C' employees of secretariat worst?
After going through the recommendations of Sixth Pay Commission, it seems that this was set up for all services except Group 'B' and 'C' employees of Secretariat. It shows that these categories are the worst in Government Services.
I feel that after implementation of Sixth Pay Commission, employees of these categories are not working upto their capabilities. Due to this Government machinery will be jammed very soon.
To avoid such type of circumstances Government should immediately do justice with them, so that Govt. business will run smoothly.

Banking Scam - Ground Realities

The readers would recall having read a rather seemingly innocuous news item about a month back regarding discovery of counterfeit Indian currency notes in the chest of Dumariaganj branch of the SBI in Bihar. The GoI initially attributed this to some heavenly shower! Preliminary investigation, however, revealed that the currency notes did not descend from the heaven. The case is under investigation by the CBI. Some officials of the bank were arrested as it was thought that, without their collusion, the crime could not have been committed. Sure enough! In this connection, I would like to share with the readers of this famous website, my experience while serving in the GOI before my retirement in Dec. 2007. On one occasion, in the hard cash running into laths of rupees drawn from the accredited nationalized bank for disbursement of salaries to staff/ officers, a large number of counterfeit currency notes were detected by the officers of my ministry. I ordered immediate investigation. When questioned, the banking officials on condition of anonymity, revealed that their bank had acute shortage of manpower .There were also limited number of currency notes counting machines. It was also revealed that a prominent political party whose accounts are being maintained by their bank deliberately and regularly follows the practice of bringing a large number of sacks containing hard cash. In the present case , since the hard cash was brought at the closing hours, it was not humanly possible to carry out the counting manually as per the prescribed practice. Instead, the counting was done through the note counting machines. Unfortunately , the counters do not distinguish between counterfeit notes and the actual notes. In view of the political clout exercised by the donors , the docile banking officials had no option but to give in .The hard cash handed over to my officers as stated above was a part of this monetary transaction .T his is how the black money was converted into white money ! The matter was referred by me to the department of Banking for appropriate action. I am not aware of the final outcome of this case.
I do not hold any brief for the banking officials. But the conduct of the political parties also calls for a probe in a transparent manner.May I humbly request Dr Suresh Mehrotra the Chief Editor of this illustrious website to convey my views to the new Director CBI for facilitating the investigation as also the new Governor of RBI to have a relook at the existing banking practices and lay down fresh guidelines keeping in view the fast pace of advancing printing technology for printing currency notes

Child Care leave - a welcome step!

The child care leave sanctioned by the government is a step in the right direction. This was long overdue as situations have changed drastically from earlier times. With nuclear families being the norm, there is nobody in the home to fall back upon for the care of the child and the child ends up either at the child care centre or in the care of the domestic servants at such a tender age when it should be getting all the attention and love of the mother. I am very grateful to the government for having recognised this problem and taking measures to solve the difficulties of the working women. Nobody will appreciate this decision more than me being mother of twin infants. Kudos to the government. Thank you.

Another whip to working women
In the form of CCL the government has given another whip to the working ladies who tend to misuse it more rather then getting it in place for some genuine problem. Already ladies were given enough leeway and liberty to take care of their household activity. There is no problem in CCL but it should be without any pay. No pay or(at the most half pay), should be given if their husbands are working and are tax payers. Of course some ladies genuinely need this but this would definitely take a course of gross misuse and in turn put more burden on their male counterparts. It's good to see that some ladies has raised this despite getting direct benefit out of this order.

What an inhuman treatment to non-gazatted staff ?
The HRA of a Joint Secretary after the implementation of 6th CPC is more than that of a one and half LDC Gross Salary (revised pay),. What an inhuman treatment to non-gazatted staff. I don't think that even if this Pay Commission had been constituted during British Rule, the english rulers certainly would not have encouraged the benefits only in favour of senior officers but also given the lower staff their equal share. Still we belong to post-independence period. What is a senior officer with Rs.20,000 to 30,000 HRA going to do? Will he be able to digest it? Only time will give the answer. Anyhow officials concerned with the implementation 6thCPC in favour of only higher officers have committed grave sins and may be they have to take many births if at all they have to wash this.

Every one comes to IAS/CSS on the basis of All India competitions
In the very beginning IAS officers were not being taken into the parliament secretariat services and in the ministry of parliamentary affairs for the sole reason that these secretariats have to work free and fare in parliament work with ministries without any pressure or influence of IAS cadre as these cadre officers have a lot of consideration for each other as well as for their seniors to oblige. Moreover Secretariats' work is quite different in nature than those of ministries and only own cadre/service officers were more suitable and used to be taken up. For sometime past, IAS are being taken in these services, also may be for the reason best known to the high ups of these secretariats. It might be the views of these high ups or decision taking authorities that the IAS stuff is more intelligent than other service/CSS officers although every one comes to IAS/CSS and other services on the basis of All India competitions only.

A welcome decision !
Only 8%of government workforce is women , out of which about half will probably fall in category of officers having children below 18 years. Being committed to careers , few will opt for 2 years ,off work / leave . Its reasonably expected that this provision of a leave option will encourage more women to join government, now that they are assured of being able to do justice to their role of a mother. A welcome , overdue decision !

Implementation O.M. dated 2.9.08 is illegal, being violative of Resolution.
The decisions of the Government on the recommendations of the 6th Central Pay Commission on pensionary benefits have been communicated under Department of Pensions & PW's Resolution No. 38/37/08-P&PW (A), dated 29.8.08. In order to implement these decisions, Department of Personnel & PW has issued OM No. 38/37/08-P&PW (A), dated 2.9.2008. Obviously, no part of the implementation OM can be at variance with the decision as contained in the Resolution.
Vide Item No.2 of the Table in the Resolution, the Government has accepted the recommendation for payment of pension to those, who have rendered minimum 20 years of pensionable service, at 50% of the average emoluments received during the past 10 years or the pay last drawn, whichever is more beneficial to the retiring employee. It is nowhere indicated in the Resolution that this decision will be applicable prospectively. Apparently, even the Government servants who have rendered more than 33 years of qualifying service are covered in this category.
Para 5.2 of the implementation OM gives effect to the decision in Item No. 2 of the Table in the Resolution. Para 5.4 of the OM, however, states that (i), the revised provisions for calculation of pension in para 5.2 and 5.3 shall come into force with effect from the date of issue of this O.M. and shall be applicable to Government servants retiring on or after that date and (ii), the Government servants who have retired on or after 1.1.2006 but before the date of this OM will continue to be governed by the rules/orders which were in force immediately before coming into force of these orders.
The result of para 5.4 of implementation OM will be that the Government servants retiring between 1.1.2006 and 2.9.08, including those who have rendered more than 33 years of qualifying service, will not be given the benefit of pension at "50% of the emoluments last drawn or average emoluments received during the last 10 months, whichever is beneficial to him". Thus, para 5.4 of the implementation OM is clearly in contravention of the Government decision contained in the Resolution dated 29.8.08.
In view of the above, Department of Pensions & P.W. is requested to immediately modify the implementation OM dated 2.9.08 to the extent that the provision of "pension at 50% of emoluments last drawn or 10 months average emoluments, whichever is beneficial to Government servant" is made applicable to the retirees between 1.1.2006 and date of issue of aforesaid OM, in accordance with item 2 of the Resolution. If this is done, a large number of applications will be filed against the Government in CAT.
