Reforms called for in administration of Justice I am a little
curious to know if the Indian Administration Of Justice will suffer
any adverse consequences by discontinuing the practice of getting all
kinds of documents notarized ! Perhaps not. It is an unnecessary irritant
for the common man, who wastes his/her time and money only. It is very
well known that there is no verification done by the notary and documents
are notarised without the parties or the witnesses being actually present.
It is just a means of income for some people. Visit any documentation
centre next to the public offices like housing boards, motor licensing
authority or such other organisations and you can get any document notarised
without visiting the Notary. In courts complexes too, it is easy to
get documents notarised without the parties signing papers or the witnesses
being present. One has to only pay the fees demanded, which depends
on the nature of the document and the paying capacity of the parties.
Fees is not prescribed nor administered.

Internal security
I would entirely go along with the excellent advice given by A K Saxena
on the issue of internal security in our country. The multiplicity of
organisations like RAW , IB, NSC Secretariat is merely adding further
confusion to the already confused situation. I agree with Saxena that
a new full-fledged ministry for internal security must be created immediately
so that the matter gets focussed attention. At present, there is only
a wing in the MHA headed by a Joint Secretary or Additional Secretary
who are usually IAS officers. The officers of IB and RAW who are usually
IPS officers for obvious reason do not feel comfortable. It is therefore
suggested that the new min. of internal security, as and when created,
must be manned by IPS officers only.

A heartening news, if it is so
What in actual what was given by PMO and Chairperson UPA is being snatched
away delibrately. For example, in September 2006 Government revised
the pay scale of certain Group B non-Gazetted cadres of central secretariat
from Rs. 5500-175-9000 to Rs. 6500-200-10500 but the 6th CPC and officers
implementing the 6th CPC Report have undone by recommending and adopting
the Pay Band of Rs. 9300-34800+Grade Pay i.e. now at intitial stage
it has been brought down to Rs.5000-150-8000 downgradation even from
the earlier 5500-175-9000. It is a well known fact that these cadres
of Central Government are Group B non-Gazetted employees and their pay
cannot be less than Group C employees but the whole Report show that
number of categories which are Group C and were getting lower scale
has been put up at higher stage than Group B staff. Perhaps this categorization
takes care only from Class I of Group A staff and above where every
care has been taken that they do not much higher than multiplication
factor of 1.86 which is applicable to only lower categories. This is
the only Pay Commission and Government where step motherly treatment
has been given to those categories who have no reach in decision making
and implementing the Pay Commission Report. It has been shown that how
'Charity begins at home' has been fully utilised. This is one example.
There are numerous others. This is causing resentment among the staff
and should be taken care of. There should be an impartial forum to look
into all these anomalies either submitted individually or through some
forum.

Govt. and the Private Sector should do their duty towards this hero

Through the esteemed column of this web site, I may inform Ms Sonia
Gandhi that the IRS officers are extremely annoyed with P Chidambram
and the ungrateful government for sidelining the IRS Officers on the
implementation of the Pay Commission. Election time, which is not far,
may be the expenditure observers will have many things to do!!!

Two insults to Prime Minister with regard to 6th CPC
1. Prime Minister had approved the upgradation of Rs.5500-9000/- basic
pay(pre-revised) for Assistants and PAs to Rs.6500-10500. The 6th CPC
has simply downgraded this benefit and simply thrown down this grade
by clubbing this with lower level scales. On the contrary; scales below
this grade have been given an increased grade pay that has been given
to Assistants/PAs.
2. PM had announced three promotions (ACPs, i.e. after 10, 20 and 30
years)in place earlier two ACPs (12 and 24years). The benefits of this
has been nullified by applying this on the grade pay in the pay band
and not on the designation in which the employee has entered.
For example:
In case of Earlier ACP(12 & 24 years):
For a Steno Grade"D" :
After 12 years - Pay of Gade "C"
After 24 years - Pay of Private Secretary.
Now in Three ACP(10, 20 & 30 years):
It is according to the next grade pay of scale in pay band in which
the employee joins. It means a Steno Grade"D" will get ACP
for a Private Secretary(that too Grade Pay Rs.4600 and not 4800) only
after 30 years and not 24 years as was earlier existing. Under Earlier
2 ACP; some were getting the 2nd ACP for even for PPS post in the same
line. Now all these things have gone to dustbin. Unless a clear cut
clarification is made and the benefit given; these Three ACPs are only
a demotion and not promotion. Whoever the official had misinterpreted
this in such a way only to make the benefit of these 3 ACPs a total
'zero' is only insulting the benefit given by the PM to the lower level
staff.

Welcome decision
All such AIS officers , who are willing to go to private sector for
better remuneration on the basis of their supposed or presumed merit
and competence, should be encouraged to resign from AIS and their resignation
should be promptly accepted. I say so because competent persons going
over to private sector will be in the larger interest of industrial
and infrastructure development of the country. The line between government
sector and private sector is already vanishing. We are in a time where
public-private partnership is a development mantra.

Poverty alleviation programmes require drastic change
I am in agreement with Bhimani's views about conversion. It is the governance,
more so the poverty alleviation programmes, which requires drastic changes
to see that it reaches out in full to the poor. If people really sincere
in their efforts manage these programmes, a change can be expected;
otherwise the same state of affairs will continue. In this regard, our
late Prime Minister Rajiv Gandhi's words were from the core of his heart
and are still proved to be true.

- Applicability of this criteria to retirees between 1.1.2006 and 2.9.08.
Readers may please refer to my views published in the column "Forum"
on 19.9.08 under the caption "Implementation OM dated 2.9.08 is
illegal, being violative of Resolution", in which Department of
Pensions & PW (PPW) was requested to immediately modify the Implementation
OM dated 2.9.08 to the extent that the provision of "Pension @
50% of Last Pay Drawn or past 10 months' Average Emoluments, whichever
is more beneficial to Government Servants" is made applicable to
all those who retired on superannuation between 1.1.2006 and date of
issue of OM i.e. 2.9.08, in accordance with Item 2 of the Resolution
dated 29.8.08.
In this connection, I also sent a detailed letter dated 19.9.08 to Ms.
Rajni Razdan, Secretary, Department of PPW, with copy to MP Singh, Director
(Pension) in that Department. No response has been received in this
regard from Department of PPW so far.
The email facility on the website of Department of PPW, provided under
the caption "Contact Us" of website, does not work. I have
tried it many times. The emails sent to Department of PPW on that address
were returned undelivered. Department of PPW may please ensure proper
functioning of its email facility so that pensioners are in a position
to contact Department of PPW through email.
As regards the substantive issue of "calculation of pension @ 50%
of Last Pay Drawn or past 10 months' Average Emoluments, whichever is
more beneficial to Government Servants", in so far as retirees
between 1.1.2006 and 2.9.08 are concerned, I would like to elaborate
further. In the recommendation under para 5.1.33 of its Report, the
Pay Commission has dealt with two aspects namely (i) Full Pension to
be paid after 20 years of qualifying service instead of 33 years and
(ii) Pension to be calculated @ "50% of Last Pay Drawn or past
10 months' Average Emoluments, whichever is more beneficial to the Government
Servant". While the first part of the recommendation applies to
those who have rendered more than 20 years but less than 33 years qualifying
service but the second part of the recommendation applies to every retired
or retiring Government Servant, including those who have rendered more
than 33 years of qualifying service.
In this connection, it is also relevant to draw attention to para 6.5.3
of the Pay Commission's Report which inter alia provides that the recommendation
regarding payment of full pension on completion of 20 years of qualifying
service will take effect only prospectively from the date it is accepted
by the Government. It is very clear from this para that it is only that
part of the recommendation granting Full Pension after completion of
20 years qualifying service (in stead of 33 years), which will apply
prospectively. However, as regards Government Servants retired on superannuation
after 1.1.2006 (after completion of full service i.e. 33 years), Pay
Commission has nowhere recommended or indicated that the revised criteria
of calculation of pension should not be applied to them. When the revised
pension structure has been made effective from 1.1.2006 (as per Resolution
dated 29.8.08), there is no reason why the revised criteria of calculation
of pension, which is a part of revised pension structure, should not
be applied w.e.f. 1.1.2006 also. The recommendations on "Full Pension
after completion of 20 years" and "Revised Criteria of Pension
Calculation" are distinct and these should be viewed separately
in their own different perspectives.
In view of the above, the revised criteria of pension calculation i.e.
"50% of Last Pay Drawn or past 10 month' Average Emoluments, whichever
is more beneficial to Government Servants" should be applied to
all those who retired on superannuation between 1.1.2006 and 2.9.08.
Deptt. of Pension & PW should immediately issue a clarification
to this effect. I would also urge all affected persons to make representations
on this issue to the Government.
