Are Income Tax Returns / TDS certificate exempted ?
The appellant sought copy of the TDS certificate issued in favour of
her deceased husband. The CIC held that as the appellant is the legal
heir of the deceased, the information cannot be denied under section
8(1)(j).
Comments
Ordinarily, the IT returns/ Copies of the TDS certificates are
exempted from disclosure under section 8(1)(d) and 8(1)(j). However,
there are situations under which they are to be disclosed like the
legal heir asking for the information upon the death of the
individual.

Following features may be noted;
1. In no other case, pay increase has been lower than recommended by respective pay commissions In case of PSE officers Justice Rao Committee recommendations have been dumped. Scales have been reduced drastically for A plus PSEs. Scale E10 has been removed thus further reducing pay.
2. Increase has been reduced to 30% as compared to 42% recommended by Justice Rao Committee.
3. Risk pay is denied to PSE officers though recommended by Justice Rao Committee. Govt. has given grade pay all its employees and college teachers bet denied to PSE officers.
4. Justice Rao Committee recommended for abolition of ceiling from gratuity, for PSE officers because they are denied pension. But govt. has kept the ceiling same as govt. employees who get ever increasing pension up to Rs. 6 lakhs per annum and more, year after year for their life time and of their dependents.
5. End of scale in case of govt. officers in PB4 has been increased more than 4 times, from Rs.18300 to Rs.75700. Increase in PSE scales is far shorter.
6. It is stated that PSE salaries are not to be compared with either govt. or Pvt. sector officers. In simpler words PSE officers are being given less than both of them but PSEs are not to open their mouth. They are even being denied any negotiation with their managements.

Presently PSE managements are being used like British used Indian police to oppress Indians.

Why should this shortage occur?
Time & again there is an item in your site reagrding shortage of IAS/IPS/IFS officers in states and centre. Few days ago there was a heading, shortage of 700 IAS officers in the country. The figures may be true but why this must happen when there are so many officers from state civil services with adequate experience and qualification are available. Why is it that the Government is not interested in promoting people with more than 20-25 years of experience in the same area and goes for recruitment of fresh IAS officers? When the country is talking of austerity measures why not promote the eligible officers rather than recruiting fresh ones. If this quota of 33% for state service officers is a hitch then let this system be scrapped for 5-10 years and all eligible state civil service officers be granted IAS till there is a balance in the cadre structure. The vacancy created due to promotion of state civil service officers will further help in faster promotions to subordinate services in states. Today officers of State Civil service are stagnated in one post for 25-30 years and some retire in the same grade without getting into IAS while a young IAS(AIS) officer after joining gets promoted after every 6-7 years. No talk of improvement in system and nations welfare is possible till all the elements in the system are satisfied and they get their due in time.

Election Commission and Assured Career Progressiom
On the one hand, Election Commission is conducting General Elections for the formation of new Government and on the other hand, stopping the Government Employees from being benefited by way of announcement of ACP SCHEME.
ACP Scheme is not any new announcement, it is part of the Sixth Pay Commission, which was formally accepted by the government in principle. The Department took time in formulating and finalising the ACP scheme.
There is nothing new taking place on the eve of General Elections, but an old one which is being announced as a part of the Recommendations of Sixth Pay Commission accepted long back in August 2008. The Election Commission should not come in the way of announcement of the ACP Scheme and allow the scheme to be released even before General Elections.
DOP&T should once again take up the matter with the Election Commission and got the approval towards announcing the new ACP due to be announced as part of Sixth Pay Commission to give financial relief. It is, therefore, requested that the concerned authorities may kindly take necessary action for releasing the formal orders by the Department of Personnel and Training.
Hope concerned authorities will wake up and issue orders at the earliest.

Why discrimination against CSS
Posts at Director level in the Central Government are lying vacant on account of non availability of deputationists. On the other hand CSS Officers are waiting for 10 years as against the stipulated 5 years for appointment as Director. The Cadre review Committee for CSS has recommended additional posts in the grade of Directors but the Government does not seem to be serious about it. It has granted 15 % of Group A posts in the grade of Director for CSSS Officers who did not have a Director level post for them. This is a welcome step as CSS and CSSS have all along been treated on the same footing. However, CSS have not been given 15% of Group A posts in CSS in the Director's grade. Implementation of the Cadre review report and grant of 15% posts of Group A posts at the level of Director would relieve the acute stagnation in the CSS.
