Appointments Committee of the Cabinet

Documents / notings in respect of the processing of the panel of the
year 2001 during the period from January to March, 2005 for
appointment to the post of Director (Commercial & Marketing) in ITDC
was rejected claiming that they are essentially part of the papers put
up to “Appointments Committee of the Cabinet” (ACC) and are exempted
under Sec. 8(1)(i). It was claimed that “Cabinet papers” includes all
the papers pertaining to deliberations of the various Committees of
the Cabinet, apart from including the papers pertaining to ‘Records of
deliberations of the Council of Ministers’, ‘Records of deliberations
of the Secretaries’ and ‘Records of deliberations of other officers’.
‘Decisions of the Council of Ministers’ and ‘material on the basis of
which the decisions were taken’ are a just a sub set of the larger set
of documents encompassed under the larger term “Cabinet Papers”. Out
of these types of documents – only one set of documents is mandated to
be made public after “the decision has been taken, and the matter is
complete or over”. The term “Shall be made public”, in the Act, makes
it a duty for the Public Authorities to make public the “decision of
the Council of Ministers” and “material on the basis of which the
decisions were taken only in cases of “Decision of Council of
Ministers” and not in respect of any other class of “Cabinet Papers”.
The Commission disagreed with the above claim and directed to disclose
the information.

Comments

Every decision of the Council of Ministers is a decision of the
Cabinet and hence, all records concerning such decision shall fall
within the category of “Cabinet papers” and, as such, disclosable
under Section 8(1) (i) after the decision is taken and the matter is
complete, and over.

IS THE DEMAND OF SMALLER STATES JUSTIFIED ?

Smaller states for administrative convenience is alright. This also will dampen the linguistic chauvinism exhibited in certain states. Creating a new province in North Bengal is good. But why this name Gorkha Land. To my understanding Gorkha is a province in Nepal. Since the majority of soldiers coming into the British army were from this province, Nepalis are generally called Gorkhas. Even if a new province is given Government should never agree to this Gorkha land name, since this will have bad future inplications.Perhaps Jaswant singh is doing what his predecessor did for the Moghuls.

I request the Editor to put a stop to this discussion on who is running the MOD. In a democracy elected Government is supreme. Bureaucrats are only implementing tools of policy taken by the Government. Defence forces have their own responsibility. Their problems have to be sorted out by the Defence Minister. There is no question of them over riding the bureaucrats or the latter over riding the defence forces. They complement each other.
