Applicability of RTI Act on Judiciary! May I invite the attention of
Mrs Anuradha Verma and legal luminaries to a news item (HT Jan 11,09) regarding
disclosure of assets by the Supreme Court judges? The present CJI has reportedly
contested the jurisdiction of CIC on the judges of the Apex Court and is contemplating
challenging CIC's ruling before the High Court. Justice J S Verma, the former
CJI, on the contrary, has strongly objected to the Apex Court's stand on the ground
that the Resolution passed during his tenure as the CJI about disclosure of assets,
made it obligatory upon the Supreme Court Judges to declare their assets. My short
question is: Whether, the Apex Court could file a petition in a High Court, subordinate
to it, to get the CIC's ruling quashed ?Whether all citizens of India are equal
in the eye of the Law of the land or are Supreme Court judges more equal than
others? I shall be grateful to be enlightened by the experts, on this website.
A K Saxena ( A retired civil servant ) Why penalise genuine allottees
? There are allottees of the DDA Housing Scheme 2008 who are genuine,
having no link whatsoever with the persons engaged in fraudulent measures. So
why should the genuine allottees be penalised for the misdoings of the wrongdoers?
I am certain that the number of genuine allottees far outnumbers the persons who
were engaged in the fraud. Hence, the draw should not be scrapped in toto but
only the fakes disqualified. Meera Nair Increase Retirement Age
In the Bureaucratic setup, particularly in the Armed Forces, age is used as
a tool to keep the disadvantaged out of the race. In civil setups, those from
disadvantaged Class such as SC, ST and OBCs are kept out of the higher levels
due to age restrictions as these categories enter the service late. Hence age
has become very vital tool of discrimination in Indian set up. Increasing retirement
age Limits will widen the choices at higher levels and provide opportunities to
many deserving and capable disadvantaged category officers besides leading to
enhanced utilisation of experienced human resources. Renu Satyam
Asatyam Bhavet ! The satyam story is not any isolated story of corporate
India indulging in acts of criminal breach of trust. Earlier several companies
have swindled crores of investor and public sector banks. One such scam is of
Mafatlal Finance Company, which simply disappeared after siphoning off crores
of investor money with impunity. The complaints lodged with SEBI and DCA have
been thrown into waste paper basket. Mafatlal was no small entity-it was a group
company belonging to an MRTP company. The Indian laws are strong enough to bring
to justice such crimes of breach of trust under section 420 of the IPC and companies
law, MRTP law etc. If these laws can not chain offenders, why keep costly organisations
like the Registrar of Companies, the MRTP commission etc? Only to provide post
retirement jobs for 5 or 7 years to manipulators, who compromised government interests
in order to obtain illegal gratification for themselves? A retired Cabinet Secretary,
the highest civil servant in India, was adoring Satyam board. An officer who is
supposed to sniff the slightest attempt at cheating and fudging of accounts and
who is experienced to do exactly that, is a mere silent spectator! Or was each
one of the independent directors paid adequately to keep his/her mouth shut? Or
is the inclusion of retired civil servants meant to do liaison work because of
their clout? While government servants are not allowed normally for two years
from the date of retirement to take up any employment with companies they have
dealt with during their official tenure, the manipulators manage to get waivers.
This reminds me of the Vohra committee on the nexus of politicians, bureaucrats
and businesses. We are looking at the developments as helplessly as we have
been doing in case of 26/11 Mumbai tragedy. Were it a government servant charged
with defrauding the exchequer, he would have been arrested instantly, his/her
assets seized, bank accounts frozen, and all relatives-seven degrees from father's
side and five degrees from the mother's side-would have been subjected to interrogation
and charged and sent to jail. Why can't swindlers like Mafatlal Finance and Satyam
promoters/controllers be subjected to same royal treatment, sent to jail, their
assets forfeited and company money recovered by selling assets held in fictitious
or benami entities. Let us not get fooled by Raju's letter. It is not meant
for India or indians' consumption. It is to escape severe punishment in USA courts,
which no Indian Raju can manipulate. What is known as mea culpa, is sought to
be employed to get lenient US punishment, which any Indian company operating in
the USA is subjected to. The rot needs to be stemmed. Names like TATA, NR
Murthy and Azim Premji evoke trust and respect. Imagine any one of them doing
a Satyam! A cold sweat down the spine is the only experience. Raju can still
save his soul by revealing the truth in one go and undergo penance, for his crime
is more serious than that inviting even death penalty! M L Gupta Another
Enron ! The Satyam saga reminds me of Enron. Hired Executives and dishonest
promoters tend to propose the names of global auditors, and based on face/name
value, such entities are selected by the company. Few stakeholders would choose
to oppose selection of a globally known name. These entities hire brilliant people
at huge salaries, buying their loyalties, making them amenable to whatever they
are told to do. They will be told to do whatsoever is required to retain the account,
and they charge huge fees. The hired employees are brilliant but mostly lacking
in moral fiber, and are afraid to lose the high paying job. You can get them to
get anything signed by them. This places them no higher than a local fraudulent
accountant who chooses to sign an audit report for a mere Rs 500/-. These auditors
are co-conspirators within the meaning of section 120B of Indian Penal Code, and
ought to be prosecuted in individual capacity as well as the entity controllers,
including directors/partners. Apart from the directly involved auditors, the liability
of the directors/ partners is directly covered by Supreme Court decisions in the
following cases:- Modi Carpets in the pollution case. UP Pollution Control
Board vs B K Modi SMS Pharmaceuticals vs Neela Bhalla Tamil Nadu
Electricity Board vs Rasipuram Textiles Ltd. The National Consumer Commission
in the case of Ashish Birla vs Murlidhar Patil. It is high time that we
started placing the right question marks and the so called high flier entities,
or else we shall see many more of Enron and Satyam. Ramalinga Raju cannot be
hanged, unless an affected party chooses to get him along with his family liquidated.
This too is far fetched in India. Remember what CR Bhansali did and got away with.
So, in the worst case scenario may get a life sentence, which will be, in practical
terms, over within 7 years. God bless him, and his victims! Satyamev Jayete! It
is possible that the regulatory authorities may fine Ramalinga Raju much more
than he has defrauded in terms of insider trading, but I do not feel it is likely. In
the meanwhile, all the associates of Ramalainga Raju, co-conspirators, must also
be punished, if not legally, then in terms of market forces. Just as Arthur Anderson
was a co-conspirator in the case of Enron, PriceWaterhouseCoopers is a co-conspirator
in the case of Satyam. Therefore, all the cases relating to income tax, customs,
excise, service tax, sales tax, company law matters or anything with which the
name of PriceWaterhouseCoopers is associated must be scrutinized in depth. The
market for PriceWaterhouseCoopers's dubious services would disappear within a
few months, and that will be the most appropriate punishment for PriceWaterhouseCoopers,
much more effective than going through the judiciary. Vijay Kumar Is
Raju still lying ? Earlier Satyam tried to transfer 1.6 billion $ to
Maytas. Then Raju said that Satyam had in fact no cash and company was operating
at a margin of 3%. I have inkling that he was telling lie. Where as other IT companies
are working at 20 to 30% margin how Satyam was able to get customers at just 3%
margin. I think he did have the cash which he sought to transfer to Maytas. 3%
margin story is false. I explain how. Raju says that he has been fudging
the books to show more profit and actual profit was just 3%. Can anybody believe
that margin in IT BPO is just 3%. Then how other giants Infosys, TCS etc are showing
excellent margins. Are they also fudging the books. Certainly all cannot be thieves.
Raju says that abnormal margins were shown year after year by over-invoicing.
My sense says the he is telling the whole truth and the true picture could be
just opposite. Fudging he has been doing but in reserve way. Raju has been siphoning
off the cash away from companies books to other ventures and other companies.
This has resulted that today there is no cash with the company which is not a
result of low incoming but the cash had actually been taken away by him. So to
explain no cash situation as of now, he has cooked the story that margins were
low and he had somehow shown rosy picture by over-invoicing. So, its not that
margins were not there. Margins were very much there. He has swindled the money
and is now explaining the money was not there in the first place. Then due
to recession when he found that entire money is locked in lands owned by Maytas
and property price has dived down, he had no idea what to do. It was Satyam subprime
crisis in which land owned by Maytas fell in value. So he had the 'bright' idea
to take Board's approval and transfer 1.5 billion $ to Maytas in the guise of
investment. Later on when the property market would rise, land would be sold and
money or at least some part will be returned. However the majority shareholders
and media spilled the cart and rest is history Shantanu Ghosh Valid
question The Satyam scams raises valid questions about the role of the
auditors without whose connivance it seems that scam of this proportion could
not have happened. If the inquiry proves this conclusively that the auditors have
connived or failed professionally to prevent this scam then appropriate penal
action should be taken against the auditors. This also raises another issue that
whether the same norms of accountability be not applied to public auditors. There
a large number of scams which have taken place in various government bodies at
different points of time. All these bodies are subject to audit of C&AG. If
Pricewater coopers is held accountable for scam in satyam should the same norm
be not applicable to C&AG afterall scams in governement bodies also point

I must congratulate government for its tough handling of the strike of oil PSU's
unions. This is indicative of the fact that if government sends a proper signal
to all pervading indiscipline in our system there is still hope of redeeming the
grim situation. I hope government takes similar steps towards the striking transporters.
Time has come when we must tell the world that this chalta hai attitude is no
longer our philosophy and we mean business. Any ways my congratulations to RS
