The application for certain information was transferred by the PIO of the Headquarters to another section of the department in Mumbai and who in turn informed that he is not having any information since the concerned file has been transferred to Chennai.
The CIC held that the PIO of hqrs. to whom the application is filed, is expected to collect the information from the concerned branch whoever is having information and provide it to the appellant.
Accordingly, the CIC directed the PIO to provide point-wise reply to the appellant after collecting the same from the concerned branch in Mumbai or from Chennai within 15 days. Further, the CPIO was directed to show-cause why penalty should not be imposed on him u/s 20 (1).
Comments
There is a trend amongst the Hqrs. to forward all application for information to the field formations which is against the provisions of the Act. Hopefully, this order would put an end to it.

Nitish Kumar Chief Minister of Bihar is going to launch "Vikas Yatra"(Development journey) from January 19, 2009. The first comprising five days will CM & Government officials stay overnight in different villages. To begin with he will go to West Champaran where from Mahatma Gandhi had launched his march. Nitish Kumar after night stay in different villages will be interacting with them in morning. Bihar Chief Minister had conducted a similar exercise three years ago while being out of power. At that time it was christened "Nyaya yatra.".Basically, through his ensuing exercise, he will get the first hand feel of where all he need to take corrective measures in public interest said sources close to Nitish Kumar.

Satyam Episode-Unanswered question
1. There are two members of PWC on the central council of ICAI. Why they have not been suspended by Department of Corporate Affairs so far ?
2.There are two members of E&Y on the central council of ICAI. Why they too have not been suspended by Department of Corporate Affairs?. E& Y has done valuation of Maytas and is also said to be internal auditor of Satyam.
3. Why has ICAI given 21 days time to PWC to reply to show cause ?
4.Why has ICAI given the job of enquiry in the role of PWC to FRRB which has no powers?
5.Why has ICAI not taken any action against PWC for misconduct in case of GTB Bank case even though more than 5 years have elapsed?
6.Why did the auditor of Satyam did not do third party verification of Cash and Bank Balance,(it is a standard norm) ?
7.Why has the government nominee on disciplinary committee of ICAI ,who hails from E &Y ,not resigned in view of complicity of E & Y in the Satyam saga ?.

Most maligned profession
One of the most maligned profession today is that of CA's. Unfortunately the sins of the few in the community have reflections on the rest of the tribe. Some of the practitioners have denigrated their profession for making a quick buck so much that today certification of financial statements by CA's have lost all the credibility it once used to enjoy. A good majority of them have now been officially branded as intermediaries of tax officials and the assesses. Efforts of the ICAI to enforce some discipline on its tribe have somehow not fructified much and degeneration is very rapid and consequences are for all to see. As it is every market player today is apprehensive that what has come out is only tip of iceberg and if things be looked into deeply (which of course would never be the case) then there would be more such scams to follow. In any case Satyam fiasco has dented the credibility of our auditing and regulatory institutions very seriously and it might play havoc in the country's image as an emerging investment market. I hope we take some serious corrective actions to redeem the situation and this does not end up meeting the same fate as probes against Harshad Mehata and Ketan Parekh did.

Retirement Age of Govt. Employees
Employees are waiting since long to happen it but without any success. Whispers has many times also predicted but so far it has not happened. Is it correct to say that Govt. is waiting to announce it before election. The code of conduct will be applicable only when Election Commission declares the dates for General Election. Let the people wail far some more time.
