What are Cabinet Papers ?
The inspection of a file was sought under which circular No. 18/12/99-EO (OM-II), Government of India, Secretariat of the Appointment Committee of the Cabinet, DoPT (Office of the Establishment Officer, New Delhi) dated 18.12.1999 was issued.
Past decision in which the CIC directed the DoPT and the Cabinet Secretariat to allow inspection to the relevant files concerning empanelment of Additional Secretaries and Secretaries to the Government of India was referred to (appeal No. CIC/MA/A/2006/00204, 207 & 208 in Arvind Kejariwal vs. DOPT).
The CIC noted that the 44th Amendment to the Constitution of India for the first time not only used the term "Cabinet", but also literally defined it.
The CIC held that every decision of the Council of Ministers is a decision of the Cabinet. Therefore, all records concerning such decision shall fall within the category of "Cabinet papers" and, as such, disclosable under Sec 8(1)(i) after the decision is taken and the matter is complete.
The CIC further held that Article 77(3) of the Constitution is not impervious to the application of the RTI Act as Sec 22 of the Act has an overriding effect on anything inconsistent with it.

Why Indians are averse to take bold decisions?
Is there something in hour genes which makes us hesitant in taking bold decision. Today the govt. has announce certain measures to boost the economy. These measure seem to be half hearted and mere eye wash. It is accepted by all that banks don't have dearth of money. It is the crisis of fear which has prevented banks from lending in last one year. Similarly the consumer are not averse to buying house, cars, two wheelers etc. The problem is loan are available at 22% interest rates as banks don't want to lend. What was needed was a big jolting, thumping stimulus from govt. which would have addressed as many sectors' worries as possible. This would have created a sense of boost to spur the demand and ensure supply. Instead the govt. has done nothing. In fact what ever has been done, has been done by the RBI. Reduction in repo, reverse repo and CRR and RBI measure. Govt. has just reduced certain duties on cement and few other measures. These are not going to boost the economy.

You may have seen many trade union movements but none can match that of Armed Forces .All Lt Cols in combat or ready to combat working in parent units given PB-4.A dispensation for Lt Cols working in other departments as a one time measure also made for granting PB - 4 with a condition that in future no Lt Cols to be sent to other departments .Here lies the catch .PB - 4 taken by falsely claiming that Lt Cols are cutting edge of Army .In fact Lt Cols (of Corp of Engineers )who finally superseded after 16 years of service ,is not posted to unit i.e. Regiments as he is no more motivated enough to be of any use to Army /combat duties except that he is a trained hand .So he is finally dumped in Military Engineer Services where he remains till his retirement getting all Military perks and doing nothing related to combat .He is also not very useful to Military Engineer Service as he hardly has any experience of MES work .He also has no motivation to learn MES work .
So now if Lt Cols are no more to be sent to other department ,where will this so called cutting edge ,will be adjusted .This is the problem specific to Corp of engineer ,but other Arms like infantry /Artillery etc also have but they are able to adjust their superseded Lt Cols in Administrative jobs like that in Area HQ /Sub Area Head quarters /other Head quarters.
This is the reason it is still not acceptable to Army. Government should be very careful in dealing with so called disciplined forces as they are not happy till they get what they want when they sense that Government is weak (They take generosity as sign of weakness ).We are in process of going Pakistan way where Army is the most powerful arm of government and they do not even listen to elected government. For their demands they will put up umpteen no of lies ,they will take perks in name of combat and majority of time remain in departments like MES .I wonder where is the constitutional right of "Equal pay for Equal work" ? A civilian officer /subordinate who is much more cued up and more motivated ,can do and is doing double the work at half the Pay .
The other argument of bullets on chest and hardship ,is concerned than it is the PBORs who are most affected but they have no voice .This will continue till they are made their own umpires

Raise the demand of HAG
It is essential for the central services to raise the demand of HAG in view of impact on pensions etc. In the case of say Income Tax, Central Excise and other services there is no post in the grade of HAG! Isn't it objectionable that while the HAG was not studied by the pay commission, this scale was carved by committee of IAS and given adhoc to few services. Thus leaving some services with no post in HAG.
Perhaps senior officers in the services e.g. CCs and other equivalent should take up the issue as they are immediately hit by such discrepancy. So far as govt. is concerned this does not have much financial impact. The issue is to see things in proper perspective. It is not only pay parity but also associated inter services interaction amongst officers and co-ordination which takes a hit with such adhoc decisions.
How do you expect DGs in central services to interact with say DGP in the state when there is so much discrepancy in scale. Let some sense prevail. Please do not shatter whatever co-ordination is left in different services

CSS lost out because of in-fight. SOs (DR) thought - and are still thinking that they were members of Group A service and discarded their GP B origins. Hence the comparison with IPS etc, which is misplaced. The lordies should come down to Mother Earth and thankful to God's (or GoI's ? - whatever) small mercies.

The applicants who submitted representations, the sanctioning authority who grants the benefit and finally the beneficiary is one and the same. He is none other than the Central Secretariat Service 'ASSISTANT'. During 2004-05, the Assistants have submitted representations to the 'Government of India' for granting higher pay-scale of Rs. 6500-200-10500/-being paid to the Inspectors of Central Excise/Income tax. The said representations were 'scrutinised' by an 'Assistant of CSS' and finally 'submitted' to his SO/US/DS/Director/JS (all are CSS cadre officers) with a proposal to grant the higher pay-scale to all the 'Assistants of the CSS cadre'. The 'Government of India' was kind enough to grant the said higher pay-scale to the Assistants of the CSS cadre. The decision was immediately conveyed to all the Ministries/Departments on war footing by an 'Assistant of CSS Cadre'. Finally, all the 'Assistants of the CSS' have been granted with higher pay-scale of Rs. 6500-200-10500/- in place of Rs. 5500-175-9000/-.
It is next to impossible for any other staff members to get involved in all the stages of finalising their representations/ petitions.

CCS's grand plans brought to nought
CCS's grand plans have been brought to nought by political sponsored delay in issue of OM which gives parity to CCS with 2 year delay. One must understand that many candidates appear in CSE and if they get CCS, do not appear again due to personal reasons, especially the ladies. It would be interesting to see if the entry age of CCS, on an average, is nearly 2 years lower than IAS. Due to some other reasons, the pay commission had recommended parity to all IAS and , after delay of 2 years, to the all the organized cadres. However, due to reasons best known in bureaucracy, whereas the orders have been issued and implemented for IAS, they are facing the usual red tape for CCS

Death of Bangalore student
Death of Mukkarram 20 year old student of Bangalore who entered the residential compound of an army Brigadier while being pursued by police to escape their wrath is most tragic. He was killed by bullets of armed guards posted there while trying to escape to safety. This incident happened in the background of enhanced security measures following terrorist attack in Mumbai. While complete facts will emerge only after an impartial enquiry into the incident is held and findings made public, but action of Karnatak Police to slap case of trespass against the dead student shows total lack of sensitivity. First they pursued him so vigorously that he jumped into the residence of an army officer, then they appear to have done nothing to prevent armed sentries from firing at the student. While taking steps to prevent terrorist attacks, great care is required to ensure through proper training that those given weapons by the state do not turn into killers of citizens even by mistake. Punishment meted out to Mukkarram and his family members was totally disproportionate to mistake committed by him.

Let the civil servants rise to the occasion!
The Municipal Corporation ,Delhi( MCD)'s move, widely reported in all the national dailies dated Jan 2,2009, to usurp the land occupied/ earmarked by sixty schools in Delhi for commercial purposes, demonstrates its utter callousness and intellectual bankruptcy! The argument that these schools are either under-utilised or unutilised is fallacious. Now consider this-- A large number of MCD's offices remain utterly under-utilised due to perennial late-coming and unauthorised absenteeism of the staff and officers. The public is witness to it. Could these offices also be considered for demolition by the same logic! If the MCD's motive is to provide" fiscal stimulus" to the sluggish Real Estate Sectors to overcome the effects of global financial melt-down, then it is sadly mistaken. The posterity will never forgive the Corporation for committing this folly! Changing the land-use from " Educational" to " Commercial", is unwarranted . It smacks of MCD's hidden agenda involving possible kickbacks ! Demolishing school infrastructures, that caters to poor children , and then build malls and hotels over that land , for the rich and the aristocrats, shows MCD's total lack of concern for the downtrodden! How could we eradicate poverty by sidelining "Education"? Let us rehash our lessons learnt from the wisdom of Dr Amartya Sen , the Noble Laureate. stressing the importance of basic education in eradicating poverty. Also, what about the importance of concepts like: Social justice, Ethics and Morality in Governance? How have these virtues been overlooked by the MCD by embarking on the proposed switch-over to stark "Capitalism" and "Consumerism"? It is now for the Civil Servants to rise to the occasion. I urge upon the Commissioner MCD to first get a detailed feasibility study report on the proposal, from expert consultants keeping the above factors and other relevant considerations in view so that a just and fair decision is taken in the matter in public interest despite political compulsions,.. The land in question could always be gainfully utilized for educational purposes like opening Vocational centres to produce skilled manpower . It needs to be investigated , as to, since when have the existing educational infrastructures fallen into disuse and how were these schools opened and located at the present sites? Are the children being provided motivational incentives like: monthly stipends, school uniforms, free meals etc.? Is there any conspiracy by the building mafia in dissuading parents from sending their wards to schools ? The proposal after political clearance is reportedly under submission to the Competent Authority for approval.
