Not only the process of empanelment but the criteria for empanelment, the
list of those who satisfy the criteria and the final approved list should be open
and transparent. Those who are empanelled do not know that they figure in the
list of empanelled officers and as a result use informal channels to get the information
. Those who are left out become bitter and demotivated ,as they do not know which
criteria they did not satisfy. Often non-availability of the ACR's is the reason
' for which they are not responsible. The reason for maintaining secrecy is not
clear unless it is for manipulating the criteria and the procedure for screening

in Indian Tax Law ? There is discrimination in Indian Tax Law. But why
is it? As for instance, from one of websites deals in Income Tax matters in its
caption "Fully Exempt Allowances" has quoted "Allowances to High
Court and Supreme Court Judges of whatever nature are exempt from tax". In
a democratic country like India where in the eye of law all are required to be
treated as equal, but I donot understand why all its citizens cannot be treated

"With privatisation of airlines industry there is fierce competition in the
sector and if the government is going to subsidise the national carrier, it should
also give equivalent amount to the private carriers otherwise government would
be killing private sector by subsidising a government run undertaking . Order
of Finance Ministry mandating travel by government officers by national carrier
is illegal and immoral. It is like protectionism at its worst. The finance ministry
should immediately withdraw such immoral order. Over a period of time successive
ministers and bureaucrats have plundered the national carrier that is why it is
asking for a dole of 5000 crores from the pocket of common tax payer. Ravi
Trade Unionism is a big problem In the context of Indian Airlines' story
which has unravelled itself these days, I believe that a major portion of our
system is plagued by the problem of Trade Unionism. Departments ( and of course
Airlines) are run not for the wider good of state or society but to keep one or
other trade union happy and satisfied at the expense of tax payers money.
Today I chanced upon the web page of Income Tax Gazetted Officers Association
(ITGOA) and got the insight of mindset with which a class of officers articulate
their demands, the nature of their demands and degree of indiscipline and disregard
towards other counterparts of department it displays. Through certain acquaintances,
familiar with the functioning of Income Tax department I could contextualise the
contents of the said page. The 36 page proceedings of what has been called
as MCM held on 23/01/2009 at Jaipur, and attended by representatives of the ITGOA
from all over India are discussed below. I have reproduced major demands of this
union and leave it to the discretion of readers to decide where these forces want
to take us:- 1. One Gentleman has advocated that they "should adopt trade
unionist approach." to get its demands met from Govt. What a level of thinking
of a cadre where average salary is more than 40,000/- PM. In India today ITO is
not a labourer. Trade-Unionism is sought only to further their vested interests.
Grab faster promotions. In Fact militant trade Unionism has been a constant tool.
Each year several days are lost on account of Dharanas, Bandhs and Hartals by
Income tax Departments Staff and ranks from which ITGOA comes. All this is happening
with impunity and in violation of several supreme Court judgements. Sloganeering
within office premises, open meetings abusing Government and authorities is order
of day in Income Tax Department. 2. One representative of ITGOA gas gone
to the extent that Income tax department should not be a Service Provider to assesses.
It should be like an enforcement agency (probably on the lines of CBI and Police).
Great vision indeed for making Income tax compliance a pleasant and honourable
experience for honest tax payers of the country! First they will boycott the work
in department, deny refunds to tax payers than they want to assume role of Police
Officers probably to beat one or two taxpayers who would not fall in line with
them. 3. The ITGOA has further demanded an amendment in law and passed a resolution
that notice u/s 143(2) should be required to be only issued within six months
and not served within six months from end of the Financial Year in which the return
in filed. Such demand was made certainly to put the tax payers at mercy of ITOs.
And with complete ignorance that law can not be amended by CBDT it can be amended
by the parliament only which probably can not be pressurised by the ITGOA.
4. Having resolved to serve the country with such commitment and dedication as
above demands exhibit, It has been demanded that they must be given "time
bound promotions"; which in effect means performance should not matter. Even
when you are adversely appraised, Your integrity is doubtful you should not be
denied promotion. Moreover, it means vigilance or any such matter should not come
into the way of such officers' "right" to promotion. 5.It has been
demanded that in the matters of promotion etc. "role of UPSC must be minimised".
In fact clever leadership of ITGOA know that they can bully Income Tax Administration
but not other authorities. 6. The proceedings of same meeting, note a demand
from representatives of ITGOA that there are about 400 vacancies in the cadre
of JCIT which are not being filled because of insistence by "IAS Lobby"
on inter service balance; than ITGOA states that they will get it by citing ground
of revenue. The JCIT post is Junior Administrative Grade Post. The ITGOA wants
it for its members when no other service can get it. 7. In the context of
overdue seniority list of ITOs it has been resolved that CHQ(some representative
body of ITGOA) should "Put pressure on CCIT(CCA) through Board" to get
ITOs' seniority list. Pressure as an instrument to meet the demand is certainly
an acceptable tool to the Trade Unionist minds! 8. Further, it has been demanded
that there should be separate Transfer Policy for Promotee officers. Several reasons
such as age etc. are cited." It must be remembered the same officers demand
parity with directly recruited IRS officers when assessment charges are filled.
That time old age becomes a non-issue. 9. The IT Department had given Laptops
to all officers above ITO. The ITGOA demands that on retirement they should be
allowed to retain the Laptops given by Government. A laptop costs about Rs.35,000/-
and on retirement one be allowed to carry it home, displays the level of loyalty
to the government and their department. This is high time when such militant
trade unionism is discouraged. Departments are not for individuals. Loyalty should
be to the department and not to the unions. Kushal Singh. Is there
no other person ? Sam Pitroda is already Head of India' National Knowledge
Commission. Recently (in July 2009) he is also appointed in High Level Committee
of Telecom in Railway Ministry. Is there no other person in India from 110 crore
people?. Lokpal Jangir The Lone Crusader, Mamata Di Much
is being made out of Mamata Di's opposition to amendments to the Land Acquisition
Act. In matters of public importance, it becomes necessary to examine threadbare
the issues involved. Opposition to amendments to the LA Act may not necessarily
mean opposition to industrialisation. But it may also mean opposition to acquisition
of poor people's land by land sharks in the name of "public purpose".
Who can deny the power, influence and authority of these land sharks? They are
all around us in the persona of developers, grabbers, encroachers and Lords Of
The Great Indian Jungle Of Lawlessness. India has moved from finer sentiments
of Bhoodaan to land sharks & colonizers. The ULCER is dead. In fact it was
already dead within months of its birth ! That is how influential people, including
politicians, owned thousands of acres of urban as well as agricultural land in
open contravention of the Land Ceiling Act and the ULCER. Because they own thousands
of acres of land in their own name and names of family members and benami, taxing
agricultural income is a high decibel no-no-noooo! Because such huge income goes
untaxed, commoners like us have to compensate the Treasury by paying unreasonably
high taxes. Amendments to the LA Act as visualised now are going to open newer
opportunities for these land sharks, who have already acquired the status of Oligarchs
of independent India, rubbishing any pretence of real democracy. I have not
seen a single notification acquiring land for the public purpose of carving "Farm
Houses"! But there are thousands of farm houses carved out of lands acquired
for public purpose and allotted to influential people like politicians, bureaucrats,
judges, lawyers, network experts, celebrities, wheeler-dealers, munshis and managers.
As the amendments to the Land Acquisition Act are going to affect the whole country,
Mamata's lone voice appeals as the voice of reason and public concern. It is not
restricted to West Bengal or TMC v/s CPM battle of nerves. The country must
also know, how much land, in excess of genuine industrial project needs has been
allotted to each industry and to what purpose it is being used by the allottee
industry. Now that computerisation is a decades old achievement of India and all
the districts of the country are connected to the national capital Delhi, culling
out this data is easy.India is not a fully developed industrialised country yet.
Records of industrial units are maintained uptodate by all states. Mamata
Di, if your opposition to LA amendmends is inspired by such public concern, please
pursue the matter to its logical conclusion; you shall find support from many

I Khan Supreme Court should expedite hearing The Civil Appeal
No.5319 of 2003 is pending in the Supreme Court since 16.8.2004. About 5 years
have lapsed but the said Civil Appeal is still pending in the Registrar Court.
This Appeal was filed by the Union of India against the order of Delhi High Court
in CWP No.350 of 2001. The High Court ordered that J S Garg should be promoted
