He is likely to be repatriated to his parent cadre Manipur as compromise formula where his pay will be protected or he will be accommodated as DG in one of the para-military outfits . Will it be pick and choose?
Several 1977 and 1978 batch IAS officers empanelled but waiting to be posted as AS in centre despite state NOC. Is it true that Government is shortly starting posting of 1979 batch? Will it become pick and choose or will the Government follow seniority? Being 1977 batch empanelled late due technical reasons/ or state NOC coming late is no crime or fault of officer. Should he be punished with posting after his juniors?

Congratulations to your website for informing us about the historic judgement of CIC in the case of A K Saxena Vs DOP&T, regarding appointments at higher positions in Government of India. I retired as Chief Commissioner (IT) and was denied promotion as Member ,by the GOI for no valid reason. In view of CIC's ruling, I would also seek relevant information from the PIO.

The CIC's above ruling based on the Second Appeal filed by me after persistent denial of information by DOP&T .Let me clarify that being my personal case , I did not solicit the Chief Editor to cover my case in its RTI forum ( Oct,5,2009) .The Chief Editor, nevertheless, considered it a fit case for wider publicity due to the landmark ruling by the CIC which would impact the entire Indian bureaucracy.
I have always been articulating my views freely and frankly on this site for motivating the Indian bureaucracy to have a clear conscience and a straight spine to resist the arbitrary orders of their superiors including the political masters.
In the interest of transparency and fair play, I may be permitted to say a word about the present case. The CIC after a joint hearing with me and DOPT's representatives gave its final ruling on 28-07-09. This was in my favor, but on paper only! According to CIC's ruling , complete file notings leading to ACC's decisions are mandatorily to be shared with the RTI Applicant once the ACC's directions have been acted upon.This was in conformity with the provisions of the RTI Act. Strange but true, DOPT continues to be obdurate on both my requests despite CIC's clear directions. Even though, DOPT administers the RTI Act, it acts more like its adversary rather than its protagonist! The Prime Minister ,as the head of DOP&T is unaware of the malfunctioning and corruption in his own department. There is no point for the PM in making claims about transparency. Let the charity begins at home, first! DOPT ,perhaps, has more things to hide than reveal .
As regards the two consecutive vacancies of Members ,Staff Selection Commission(SSC), even though, the two different high powered screening committees, headed by Secretary level officers of DOPT including Rahul Sarin , former Secretary ( DOPT) had adjudged me as No: 1 candidate on both the occasions by virtue of my experience of seven years as Joint Secretary (Confidential) in UPSC(1989 to 1996) and later as Secretary (PESB-1996to 2002) , the final decisions of DOPT ignored my candidature on both the occasions on extraneous considerations as revealed in succeeding paragraphs. Thanks to RTI Act !
In partial compliance of CIC's ruling, DOPT has supplied me merely 10% of the desired information withholding the crucial 90% in violation of RTI Act . Even the 10% information supplied reveals more than what meets the eye .The MOS (Personnel) under UPA-I regime after keeping the file for months, gave orders in favour of Sl No-2,ignoring my name placed at Sl No-1 of the recommended panel . The Minister did not cite any reasons for ignoring the candidature of Sl No-1 ,as required under the rules. No speaking orders were given. There was no application of mind. It was merely a case of "pick and choose". I have got documentary proofs supplied by DOP&T.
DOP&T's documents also reveal that my name was initially cleared by the then MOS(Personnel) and the then Dy Prime Minister under the NDA rule. Before, however, the case could be submitted Mr Atal Behari Bajpayi ,the then PM , the NDA Government fell.
Worse was yet to follow. When the case was submitted to MOS(Personnel) under UPA-I, he is reported to have told a former Secretary to GOI "that I was a BJP agent ". I am now repenting, why did I never vote for the party, of which I was branded as the agent !
More shocks . Worse still, even on second occasion ,when I was placed at Sl No-1 in the panel recommended by another high-powered screening committee of senior officers ,my name was again ignored by MOS(Personnel) ostensibly due to my BJP's leanings!"
Having said this, I would urge upon the Prime Minister through this website to order DOPT to supply all file notings to me including copies of notings submitted to the ACC on the basis of which final decisions were taken on two occasions to fill up two consecutive vacancies of Members in the Staff Selection Commission, a limb of DOP&T.I can reveal the more sinister side of the present case as soon as the balance 90% documents are supplied to me by DOP&T, where I served as Joint Secretary for six years.
I know that there would be no material gain for me. But, in a country, where the honest are victimized and the corrupt are rewarded, has no business to talk about "Sustainable Development", for the coming generations! What brand of Ethics and Morality, are we leaving for them to nurture!

As the Stenographers forming parting of CSSS, particularly the Stenographer Grade 'D' placed at par with Upper Division Clerk in the Central Secretariat Service, have been facing acute stagnation in their cadre in comparison to the aforesaid sister service in the Central Secretariat Service, the Sixth Pay Commission, after giving due weightage to the sincere service rendered by the Steno-grapher Grade 'D' and to address the grievance about the stagnation in the service, proposed that the Central Secretariat Stenographer Service be merged with Central Secretariat Service. In their opinion, it is the only solution to the left with the Government to address the grievance of the CSSS. It is humbly requested that while taking the final view in the matter due weightage be accorded to the Stenographers Grade 'D' who have been deprived of getting their legitimate overdue promotion on regular basis. In other words, the Stenographers Grade 'D' promoted on ad-hoc basis way back in 1997 and persistently working as Personal Assistant (Stenographer Grade 'C' at par with Assistants in Central Secretariat Service, be appointed as Assistants/ Personal Assistants from the date they were appointed in the first instance. It may be mentioned, in this connection, ad-hoc appointments are the short-term measure to fill the gap i.e. not more than six months. Since the services rendered by Stenographers Grade 'D' after having been appointed as Personal Assistants (Stenographer Grade 'C') on ad-hoc basis continuously for more than 12 years cannot be treated as short-term measure to fill the gap, the DP&T may kindly consider sympathetically to regularise the tenure of Ad-hoc service from the date the initial appointments were made by the Department/ Ministries. Thereafter, the proposed merger should be given nod by the DP&T. It would be the fair treatment to the services enjoying the status of at par services. Otherwise, anomalies are bound to take place and may lead to legal implications. In order to ensure that injustice is not done by the Government towards the personnel of one community (Stenographer Grade 'D', due kind consideration to the affected personnel as a whole, may kindly be granted.
Who audits CAG doings ?

I fully agree with the views expressed by Meenakshi Roy conveying that who audits CAG doings. In addition to this I may add here that I feel that CAG's organization does not do justice to their existence. The reason is very simple, if they were doing audit correctly, honestly and really the situation in India would not have been as it is today. An item which costs just Rs 2 is purchased at Rs 150 sometimes, they close their eyes when they come for audit. Roads are not made but paid on records. Water pipes are not cleaned but payment is made for that. There is no end to such bungling list in India. That is why there are million scandals in India and still the babus, field officers and civil servant go scot free and enjoy at Government cost. What happens in the Def deals/MEA and it's Missions abroad/other public dealing Ministries is well known but nothing happens. That is why India is known as the most corrupt nation. The fact is CAG people when they come for audit of an organization, have good food and all their other interests are taken care of during their so called short sojourn with the organization they audit and go back without doing anything. The audit is a big eye wash. I think time has come that it should be outsourced/privatized in such a way that each payment is audited the moment it is made, the next payment should be made once the previous one has been audited. Everything should be privatized and on line. This is only my dream which I am sure is not possible in a country like India. Regards.

Cancel the extravagant Commonwealth Games
The government should cancel the extravagant Commonwealth Games and instead use the money to redeem farmers debts. Every year One lakh farmers commit suicide in desperation. What if they decide tomorrow to murder instead of committing suicide? And who can blame them if they murder the hypocrites in white khadi by the dozen? Just to impress white westerners we are squandering crores of rupees on the moon and building stadia which no one visits even during games as games are watched on television.

Retirement Age should be raised to 62. HOWEVER the Government should not allow the extension on full scale and rather hire these retiring officers ON CONTRACT BASIS ONLY giving a lumpsum salary without any perks to enjoy!!! With the savings the Government can provide employment to young generations also while keeping the retiring babus happy

Let me add further to the debate. its not a question of extension beyond 60 yr. it is a question of retaining the best . This is the right time for government to ensure that all officers beyond 50 yr should be put to scrutiny and only the best be retained. It is useful to work out a proper scheme , wherein in competent professionals are taken into government, for a 3 or 5 ye term, as mid/sr level officers. The Prime Minister must look at administrative reforms in areas of infrastructure, urban development and all the social sectors esp education , health , to get the professionals . Is he willing and ready to take on the bureaucracy ( esp IAS) to revisit the existing system of Governance

The retirement age should be equal to every one because constitution says there should be equality. In India there is inequality in retirement age. Some retire at 60,some at 62, some at65 and some at 70.Gov't should bring uniform retirement age for all and it should be 65.
Longevity is increased to the double proportions after independence and experience is always counts and retirement age is increased in England to 70 and 75 in some cases

Charlotte, North Carolina. A lawyer purchased a box of very rare and expensive cigars, then insured them against, among other things, fire. Within a month, having smoked his entire stockpile of these great cigars and without yet having made even his first premium payment on the policy the lawyer filed a claim against the insurance company.
In his claim, the lawyer stated the cigars were lost "in a series of small fires." The insurance company refused to pay, citing the obvious reason, that the man had consumed the cigars in the normal fashion.
The lawyer sued.. and WON!
(Stay with me.)
Delivering the ruling, the judge agreed with the insurance company that the claim was frivolous.
The judge stated nevertheless, that the lawyer held a policy from the company, which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be unacceptable fire" and was obligated to pay the claim. Rather than endure lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000 to the lawyer for his loss of the cigars lost in the "fires".


NOW FOR THE BEST PART..
After the lawyer cashed the check, the insurance company had him arrested on 24 counts of ARSON (Arson is the crime of deliberately and maliciously setting fire to structures or wildland areas.) With his own insurance claim and testimony from the previous case being used against him, the lawyer was convicted of intentionally burning his insured property and was sentenced to 24 months in jail and a $24,000 fine.
