S.K. Panda will join as new chief secretary of Tripura on April 30.

chief secretary of the state after Tripura became a full-fledged state
in 1972.

All DPCs are Null and Void
The above statement may seem outrageous, but is made on the basis of
facts. Let me explain how:-
1. In Dev Dutt v. Union of India (Civil Appeal No. 7631/2002),
the Supreme Court held that every entry (not merely the adverse entry)
in the ACR must be communicated to the person reported upon within a
reasonable period. Even the government servant getting a good
or very good grading should be given an opportunity of making
a representation for its upgradation. All such representation must be
decided fairly and within a reasonable time period.
2. The above said judgement only clarifies the legal position
(not merely prospective) and is applicable in respect of all the ACRs.
3. In the past, no opportunity was given to the government servants
to make any representation against the gradations in the ACR. Therefore,
if any officer has been denied promotion on the basis of just
adequate / good grading without giving an opportunity
of making a representation, it is bad in law. Without following the
principles of natural justice, denial of promotion cannot be done. 4.
Therefore, any such DPC where an individual was denied promotion
is not legal and all the subsequent DPCs would need a review.

Cabinet reshuffle due
Cabinet reshuffle in various categories of functional organisation,
politically, was very much due. This is necessary, otherwise, also to

A new Skelton every day
Every day a new Skelton is coming out of the cup-board (in fact out
of a go-down) of IPL Scam. I however think that the din will die down
once a new story of wrongdoing surfaces. A deal will be struck, maybe
already done ,between Lalit Modi and the two Cabinet Ministers. Modi
will resign and the two ministers remain where they are helping him
in giving a quiet burial to all the cases against him. The government
will accept the demand of the opposition for a JPC on the issue. That
will give them more than a year time. By that period there will be a
new Scam, a fresh story of Corruption or any other unsavoury saga to
keep our TV channels busy. We have seen this pattern for all these years.
What is important for Government is its own survival not probity in
public life. Who cares about corruption? What is so unusual about it?
Have you not read only today that the head of Medical Council of India
who was held for a bribe of 2 crores for extension of approval to a
medical college in Punjab was caught for the same crime in 2001(That
time the sum was 65 lakhs. He has to be compensated for price increase
during all these years!)was let off by CBI on flimsy grounds after,
as is reported, he employed a kin of a CBI official. Take the case of
Mayawati, the CBI gave an affidavit in the Supreme Court only last week
that it had enough proof to nail her in DA case but the other day the
same agency told the same Court that they can consider her plea of discrimination
filed by her before the Court. It is said for getting the help of her
party on the cut motion on the Finance Bill as threatened by the opposition.
We can only wring our hands in despair for the kind of Governance we
have. Ours is definitely a Banana Republic.

IPS Officers are real bosses
Of late, we are reading in this column about grievances of CPMFs' Officers
about their promotions. Fortunately, they are getting speedy promotions
too. But their condition is still pathetic by virtue of their own deeds.
They always remained scare of IPS bosses just to enjoy a good posting.
I can give you a simple example. One DIG level officer incharge of Establishment
Branch in one of the large CPMF, has not been able to transfer a Constable
in field due to terror of his IPS boss. If he has no authority for such
lower level work, why he has been made to sit at HQ ? A clerk can do
that job easily. There is no difficulty to be a "yesman".
Who will tell these fellows that what is use of such promotions, while
you do not have any power/authority to exercise. Powers are not presented
in plate like sweets, these are to be snachted & exercised. Instead
of hankering after promotions, these officers should learn to exercise
their own power/discretion, without having malice towards IPS bosses
otherwise they will continue to govern you and you will be happy only
seeing your stars before a mirror !

Ombudsman to look into corrupt & unfair practices required
We need an ombudsman to look into corrupt and unfair practices by powerful
bureaucrats. Most of them are above law and nothing happens to them
despite being inefficient, stinkingly rich by amassing public money
and with no respect to law of the land. Even in UN and other big institutions
ombudsman play an important role in exercising checks over rampaging
officials.

D.K. Pandey returns the HRA drawn over a period of nearly 3 years to
the Government. It is not honesty and you should know it well. It was
an attempt to grab the undue Government money which, when he apprehended
would be caught, was deposited back. Was he not aware that if he is
availing a PSU accommodation, he can't get HRA? Surely he was. There
is another such thing for usage of vehicles. Many officers take vehicles
from PSUs and also draw transport allowance. Will some one keep an eye
on that?
