A deserving site:
Whispers in the corridors is no more a whispering site. It has gone beyond that and now is a forum where honest and bold citizens find a place to see them expressed as they want. Slowly but steadily, even IAS officers have now started understanding the importance of this site and are joining this forum. The way Dr. Misra has expressed his anguish at the plight of civil servants, deserves to be praised, at the same to be pondered about.

I feel it is time too for the Civil Servants (IAS) to form an Association/Federation of their own and protect themselves from the greedy politicians. The Federation could also lay down rules for their own members and boycott those dishonest socially.

Preferential allottment of shares of RIL

A copy of the action taken by SEBI from the time of the filing of the
complaint by S. Gurumurthy regarding the preferential allotment of
shares to the promoters of RIL through 34 Ambani companies along with
the file notings, a copy of the findings of SEBI, Justice Srikrishna
report etc. was sought. The CPIO informed that the information could
not be disclosed as, though the investigation was completed, the
process of prosecution might be impeded by parting of information at
this stage. Holding the claim that its disclosure would impede the
process of investigation as untenable, the CIC directed to disclose
the information.

Comments

The Delhi High Court judgement in the Bhagat Singh case which
delineated the application of Section 8(1)(h) of the RTI Act has made
it clear that mere pendency of prosecution cannot be a basis for
denial of information. For the share market to mature, information
about the scams - whether the Harshad Mehta scam or others, must be
put in the public domain.

To be honest or not to be is no question!

A non stop debate has been going on for a long time surrounding the incumbent CVC. Most comments are coming from persons who have no access to the case file! However, those who have the case material before them, have sought critical clarifications, which have raised legitimate doubts in public mind and hence very sharp reactions for & against the appointment of Thomas as the CVC. I am limiting myself to only one point: is a secretary(Principal Secretary included but Chief Secretary not excluded)appointed merely to sign the orders handed down to him/her by the minister or the cabinet? No. The Secretary is appointed to discharge his duties in accordance with the statute and the rules made. These rules lay down in black and white as to who will do what and when. In common parlance it is known as the "power". And the rules do not lay anywhere that the Secretary shall blindly execute the orders of the minister. The transaction of business in government has to be carried out in accordance with the law and not the "desire or wish or arbitrary or whimsical orders" of any superior authority. The rules lay down that no government servant is bound to carry out the "unlawful" orders of his superior and for doing so he can not be punished by way of transfer, blocked promotion or any form of punitive action. If some swollen head indulges in any such activity, the CAT is there to show him the light! So, we do not yet know the considered advice tendered by Thomas on file to the Kerala government and whether he was overruled. If he did resist the orders of the minister or the cabinet on the ground of hitting any policy or laws, he can not be hauled. But if he gave a note facilitating imports otherwise not permissible, he owes an explanation. What is surprising is the fact of the orders coming directly from the cabinet! That is not normal. Decisions are not taken that way! The cabinet need to consider the proposal in its entirety. At least the Chief Secretary is part of any such deliberations. Since these points are not clear, questions on integrity of one or another are being raised. For me, it is just a case study. If the Secretary simply carries out orders of the superior authority he is not doing his "duty" for which he is getting paid. A Secretary is not simply a post office! If he carries out an honest examination of the proposal and then tenders his advice, he is acting lawful. A government servant does no favour to the government or the people by being "honest". It is his "duty" to be honest all the time(Every government servant shall maintain absolute integrity all the time). One can not sacrifice honesty because it is a hazardous enterprise! So there should be no wavering whether to be or not to be honest. But at the same time, the ground realities can not be wished away. The arrogance, arbitrariness, autocracy of the politician has reached such a level where the slightest resistance to the will of the political power can endanger not only one's career prospects but even life & property & security of the family. Basically, Indian democracy has already turned into an ugly oligarchy of the rascals, who operate from behind a mask of one "honest" face! In that situation, upright government servants may not fall for the seduction of a post retirement sinecure, as the politician will suck all his values out and turn him into an apparition of his integrated self. If Thomas thinks he is absolutely honest, he should not suffer this continuing ignominy another moment and relieve himself of the burden of the current post.

Senior citizens need Empathy, not Sympathy !

Looking after the welfare of senior citizens, deserted by their near and dear ones, is the responsibility of the State. Delhi Government has miserably failed in discharging this mandate. I have surveyed various old age homes run by the NDMC and MCD in Delhi. Their conditions are woefully inadequate with no human touch. The senior citizens are being treated as mentally challenged, packed like sardines. The corrupt bureaucracy of local bodies is insensitive. There is rampant corruption in the old age homes maintained by the NDMC and MCD.I have written extensively about the deficiencies in these State-run old age Homes and sent complaints about lack of human touch. One of my audio-visual story also appeared on India TV. But, the authorities remained unfazed. Delhi's Chief Minister, the LG ,the PM, Sonia Gandhi, Ministers and MPs etc - all senior citizens, have been enjoying perks for decades at the cost of public exchequer.

In these circumstances, the media report of the Indian Express dt Dec 09, 2010 highlighting the initiative of NRIs to build old age homes in Ludhiana, Punjab, is the best step forward. Let other NRIs take a cue from Punjab and cover other States. What next?

The India Inc must also be pro-active and contribute generously to such welfare activities for the old and the infirm as part of their "Corporate Social Responsibility". These rooms could be allotted to the genuinely needy persons at subsidized rents.

It is indeed wonderful and shall set an example for others like Delhi Transco Limited where a lady is running from pillar to post to seek justice for sexual harassment for last six months as senior officers are protecting the offender.
