Aaj Ki Aawaz

I was seated on a bench in Lodhi Garden early one morning minding my own business. My self-imposed loneliness was disturbed by early morning walkers, who caught their breath sitting on the bench I was seated on. And all of them were Netas, as Lodhi is their exercising haunt.

First to sit on the bench was wheezing Pranab Da.

Pranab Da: You know I'm one of the most honest Minister's!

Me: But Rahul did not mention your name when he announced the honest Ministers names.

Pranab Da: Arre he's still has to learn a lot. Ask him what is his definition of honesty?

Me: What do you feel is his definition of honesty?

Pranab Da: Arre you can understand his definition is warped because he has named PC as one of the honest Minister's!

Me: Chalo he's not taken your name, now how will you counter this, because now people feel you are not honest!

Pranab Da: Do not forget I'm Madam's trusted fire fighter and I will I will fight this fire too!

Me: But give me a hint how you plan to fight this fire?

Pranab Da: Haven't you heard 'those who live in glass houses should not throw stones'….. Q!!!

Me: Kyon??? What does this mean???
Pranab Da: Arre baba the alphabet Q…… now enough….. I've got to go!

Pawar: Tell me what does 'khota' mean in Punjabi????

Pawar: Ailaa…… but this Langah (Punjab Agri Minister) used this so respectfully when he addressed me… I thought it was a respectful term!

Me: Now what will you do???

Pawar: Use the equivalent in Marathi when I address him! What does 'paise da puttar' mean????

Me: Means someone who values everything in money! Besotted with money!

Pawar: So this is what Manmohan Singh Ji thinks of me! Why when he introduced me to his wife he used this terminology after me name! Chalo he's an elder…… but I'll find a 'respectful' name for him in Mumbaiya Marathi slang….. fattu ji (weakling)!!!

Next came PC

PC: (his collars up) I'm honest…. I'm honest!!!

Me: Do you know after Rahul gave you this title people in the know have started saying he is naïve!!

PC: How dare they!!! India is going to import the 'word catcher'. Via this software we'll scan all phone calls based on 'words on the caution list'. Anyone using a word on the caution list and the call will be recorded! I'll add 'naïve' to the list and catch these guys!!

Me: Wish 'Party Fund' is added to the list and then someone leaks the collected data to the Public. Radiia tapes would pale in front of this data!!.

PC: What's your name…….. your mobile number!

Me: Fat chance ….. go take your walk!!

PC: I'll see you!!!

Me: You already have!

Next came Rahul

Me: You exercise in your personal gym…… what are you doing here???

Rahul: I like fresh air! And sometimes I feel my house is tapped!!

Me: Who will dare do this?????

Rahul: No… no….. it is just a feeling!!

Me: Haven't you and your Mom got Congress into a knot???

Rahul: What do you mean???

Me: Inaction on Kalmadi, Raja being shielded, stonewalling Opposition's JPC demand, a tainted CVC etc.!!!

Rahul: The files on these issues have not reached Mama's table! She'll ensure the correct decision is taken!!

Me: So what's going on is all without her okay!!!!!

Rahul: She maybe in the know but she still has not given her decision!!!

Me: So 17 days of the Parliament have been wasted just because Congress is marking time till she decides!!

Rahul: Hurry in such matters is not right!

Me: Well Congress better hurry up….. because just the tip of the iceberg has been revealed in the Radiia Tapes and very sensitive WikiLeaks on India are now going to come out! If the current files are not cleared it'll create a big backlog! Or why don't you just say in Congress there is a lot of red tape and that is why decisions take time?

Rahul gets up in a huff, gives me a dirty look and jogs off with his posse of bodyguards.

Preferential allottment of shares of RIL

A copy of the action taken by SEBI from the time of the filing of the
complaint by S. Gurumurthy regarding the preferential allotment of
shares to the promoters of RIL through 34 Ambani companies along with
the file notings, a copy of the findings of SEBI, Justice Srikrishna
report etc. was sought. The CPIO informed that the information could
not be disclosed as, though the investigation was completed, the
process of prosecution might be impeded by parting of information at
this stage. Holding the claim that its disclosure would impede the
process of investigation as untenable, the CIC directed to disclose
the information.

Comments

The Delhi High Court judgement in the Bhagat Singh case which
delineated the application of Section 8(1)(h) of the RTI Act has made
it clear that mere pendency of prosecution cannot be a basis for
denial of information. For the share market to mature, information
about the scams - whether the Harshad Mehta scam or others, must be
put in the public domain.

Mail on PJ Thomas

I am forwarding a mail received from one Randhir Kumar on P.J. Thomas. I know this is not going to shut the mouth of those who derive malicious pleasure in seeing an IAS officer in trouble. The reasons are obvious. I am really pained to see that like media a section of your readers have started putting every officer, especially if it involves an IAS officer, unto trial without looking into details. Anyone who is into his senses and has some reasoning power will be able to differentiate between Thomas and Raviinder Singh. Equating both the cases leads me believe that the person who even thinks about it is either a moron or just stretching his jealousy to prove his frustration at any cost. I know if you publish it along with the mail there will be sniggers from all these people. Still then I want them to read.

"Sir,

As I have worked in Kerala for some time. Thought to mention a few detail about the case in which an Honest and Upright officer is dragged.

So much is mentioned these days about the involvement of Sri PJ Thomas, the Central Vigilance Commissioner in the Kerala Palmolein case, but what exactly is the case against him?

As per the charge sheet filed in the Vigilance court in Kerala, the main charge against him is that as the Secretary Food & Civil Supplies of the Government of Kerala in 1991, he signed, on the basis of a Cabinet Decision, the Government Order (GO) sanctioning the purchase of 15000 MTs of palmolein,. The only other charge is that he was part of a criminal conspiracy to purchase the palmolein.

The other accused in the case are Sri K Karunakaran, the then Chief Minister of Kerala, the then Minister for Food, the Chief Secretary, the Additional Chief Secretary, the then MD of the Kerala State Civil Supplies Corporation and the Directors of P & E Pte Ltd Singapore, through whom the palmolein was purchased.

The conspiracy angle against Sri Thomas is sought to be proved through a telex sent by him to the Government of India (GoI), Ministry of Civil Supplies, seeking allotment of palmolein under a Govt of India scheme to import palmolein by State Governments or their undertakings for sale through the public distribution system. This letter was written on the directions of the Chief Secretary, who in turn acted on the directions of the Chief Minister. Even according to Vigilance, the only "irregularity" in this letter to the GoI is that the allotment of palmolein is sought in connection with Makar Sankranti, "which is not a major festival in Kerala". It is admitted even by the Vigilance Department that the GoI scheme envisages such a request from the State Government. That other State Governments had sent similar letters to the Govt of India are ignored. The charge sheet also ignores the fact that the 15000 MTs of palmolein were sold in small pouches to ration card holders, at rock bottom rates, in record time, through the Maveli stores of the Civil Supplies Corporation, fetching the cash starved Corporation nearly Rs 17 crore by way of profit (yes, profit and not "loss").

The Kerala Vigilance case admits that the decision to purchase the palmolein without tender was taken by the State Cabinet (as an outside the Agenda item) and all that Mr. Thomas did was to issue the GO, on the basis of the Cabinet Decision, formally communicated to him by the Chief Secretary. The Kerala Government Rules of Business say that orders on Cabinet decisions have to be issued by the Secretary concerned in 48 hours. "He did not get the GO vetted by the Finance Department before issue", says Vigilance, although this is required only if the file had never been seen by the Finance Department before it was placed in the Cabinet and if State Government funds were involved. In this case, the file was seen by the then Finance Minister before it was placed in the Cabinet. The Chief Minister, the Food Minister and the Finance Minister all attended this cabinet meeting. The funds for this commercial transaction was entirely met by the Civil Supplies Corporation and not the State Government. Admittedly, Sri Thomas had no role to play in the purchase, other than issuing the G.O. It is interesting that in the original case registered by Vigilance, Sri PJ Thomas was not an accused, his name was added as the 9th accused much later.

The charge sheet admits that there was a GoI scheme in operation which did not envisage inviting of tenders and which clearly provided for payment of 15% of the cost of Palmolein to the supplier towards his expenses and profit. The irregularity, according to Vigilance, is in the price fixation done by the Corporation (that Sri Thomas had nothing to do with this is conveniently forgotten). Vigilance argues that the price should not have been the spot price of the day (which was what was followed) but the average of the last 30 days daily spot prices, which not even the Government of India will say is practical. Imagine going to the market and buying edible oil not at the day's price of US$ 392 per MT, but at the average of last 30 days' prices of US$ 380! The report also ignores the fact that 4 other State Governments had obtained the approval of the GoI under the scheme; 2 of these, Tamil Nadu and West Bengal, actually purchased Palmolein without tender, under the same scheme, from the same vendor, after signing exactly similar contracts, with the price being fixed in the same manner as was done in Kerala (ie. spot prices and not the average of past 30 years). There are no "palmolein cases" in these States.

Needless to mention, the case is seen politically, as one against Sri K Karunakaran, the then Chief Minister. It is not surprising that the charge sheet was filed when the Left Democratic Government came to power during 1996-2001. The UDF Government during their 2001-06 rule decided to drop the case, but the LDF which came back to power in 2006 decided to revive it. Not even the LDF leaders will claim that Thomas's integrity is suspect; otherwise, the same Chief Minister who was a party in the Supreme Court in the public interest litigation in the palmolein case against K Karunakaran would not have appointed the same Thomas as his Chief Secretary.

The case is still pending trial, which has not even commenced on account of stay by the Supreme Court. For 19 years, Sri Thomas has been "unable to prove his innocence" or find a forum where he can present his side of the case. He will probably have to wait for another 19 years to do so. A right man, caught at the wrong place, at the wrong time!!

Many people have not heard of a CVC till date. The officer is supposed to superintend CBI, as one of the Ex CVC luminaries is broadcasting through visual media day in and day out and calling for the resignation of the present CVC. Where was this great bureaucrat ,when politicians used CBI as a tool to allow Quottyrochi to escape with his ill gotten millions? Where was he when CBI soft pedaled and virtually scuttled enquiries against Laloo and Mayawati? Where was he when CBI practically lost credibility by acting as a government stooge? Where was this so called superintendence when he was the CVC?

A sole Corporate lobbyist, the India Inc and some journalists! What a deadly cocktail? They have all gone down in my esteem. Ratan Tata who seemed to be the most honest among the India Inc is screaming for protection to his Right to Privacy? He has certainly not lived upto the image and reputation built by his forefathers. How readily he targetted a former Minister for demanding bribe from him for launching his Airlines and then refused to disclose his identity for fear of defamation? What a paradigm shift has taken place in the realm of Ethics and moral values during the past few decades? Is Ratan Tata transparent? Certainly not. At least, so it seems, if Radia tapes are any witness. Radia-active tapes are like atom bombs. First batch is like nano cars. Further releases, they say, would be more lethal.

Of late Mohana has woken up to know about how people live. He was Chief Economic Advisor in the Ministry of Finance and is eager to do a lot for the central government staff. All are close but no one is able to get things done. For example extension of age limits from 60 years to 62 years. Why kill youngsters who had joined the services and other posts in the central government at the very ripe age of 32-35 years by 60 their wards are busy in appearing for 10+ 2 exam or some graduation etc. These children are forced to some jobs at this stage as their parents retire or has to spend the huge money on marriage of son and daughters. So it is really damaging people at 60 and giving no help is harsh step. It is really disgusting to know that in other sectors age limits have gone to 65 or 70 years and here it is question of raising only 2 years. What a government ? Mohan Ji Ke Haath Sab Rahat Hai Sab Ki Hit Ki Baat Dekhe Alakh Ko Puchee Jaat Na Paat. Kardo Sab Kalyan Tera Wahe Guru Meharbaan.
