S. Vijay Kumar is likely to succeed Ms. Santha Sheela Nair as Secretary,
Mining on August 1. The 1976 batch Himachal Pradesh cadre IAS officer,

Regarding CRs of 14 years
Now 14 years the civil servants choose to become inactive during the
consideration zone. Because it is said, "More work more problem,
Less work less problem, No work no problem" in Governance. Already,
new APAR forms causing many hardships particularly for officers of SC/ST
and OBCs. The perceived difference in carrier opportunities of central
services vis-a-vis IAS is all-time low. One wonders how these brainwaves
hit the decision makers for civil services!

DoPT directive about deputation terms
The recent instructions of the DoPT about the deputation terms have
adversely affected the future prospectus of the officers who have been
working on ad-hoc basis for more than 12 years. It may be mentioned,
in this connection, that while these rules came into effect in the first
instance, the provision of ad-hoc appointments were for short-term measures
and not for years together. Now, the ad-hoc appointments are made
for long term. There is a dire need to revisit these old rules
as it appears that the new instructions of DP&T are clubbing all
the instructions issued from time to time in one order without going
into the rationale of the old rules in the present context. It
is earnestly urge that if we strictly go by the recent instructions
of DP&T, the officials, who have put in more than 13 years and appointed
on the higher post on ad-hoc basis and have rendered more than 12 years,
are not allowed to apply for the higher post. In other words,
the officials on ad-hoc basis are allowed to work for years together
without taking care of future prospects of the officers despite the
fact that the officers fulfills the eligibility criteria and can serve
better in public interests. I hope that the DP&T will take
a sympathetic view and relax the current guidelines. The DP&T
may, as a one time measure, regularise all the officers working on ad-hoc
basis from the date of their initial appointments.

I dont regret my decision
I have read with interest views on wards of CS following footsteps.
My father was a CS and has seen the family suffer due to frequent transfers/postings
and low salary structure, making it difficult for an honest officer
to meet the family needs and requirements.
It was a conscious decision on his part to keep me out of CS. I am a
doctorate from IIT and have built a strong enterprise providing employment
to over 1000 persons. Professionally also, I have derived immense satisfaction
and don't regret my decision one bit.

Apropos to Nandan K's comments of June 21, while I am fully cognizant
of, and sympathetic to the problems of CSS personnel, I must correct
his entirely erroneous assertions regarding the civilian equivalence
of army Lt. Cols.
Lt. Cols and their equivalent in the Navy an Air Force are, and were,
officers of Director level, who are in command of major establishments,
such as capital ships, ammunition depots, air squadrons, supply and
transport battalions, hospitals, and training establishments. Government
property worth thousands of crores is under their care, and typically
several hundred men report to them.
In recognition of their important role in the services, in the V CPC,
Lt. Cols were placed in S-25, viz. the pay scale of Rs 15,100 - 400
- 18,300. If they have now been placed in PB4, GP8000, they are in fact
being placed lower than persons even who used to be in S-24 in the 5th
CPC.
So, who is facing injustice here? Certainly, the Army officers who used
to be in S-25, but now have been reduced in pay for reasons unknown,
are being subjected to gross injustice. At any rate, any Class I gazetted
and commissioned officer of the armed forces or civil services cannot
be compared to personnel of Group B services, so the entire argument
is moot. Armed forces officers are waiting with interest for the recommendations
of the committee of secretaries on the anomalies pointed out, including
that of the pay accorded to Lt. Cols and equivalent.

This is the reality
Loud noise which is being made by all everywhere after 26 years of Mr.
Anderson leaving the country after the Bhopal Gas tragedy is not dying
down. Why nobody was bothered about this for more than a quarter of
a century? What Indian system would have done to him had he not gone
away? Nothing, I think. Brutal murderers and rapists of children roam
free in this country as they are granted bail or are acquitted by the
courts for lack of evidence. Then there are number of tiers in the judiciary.
Even in cases where the sentences have been upheld by the Supreme Court,
the same have not been implemented. President should not be above
the judiciary. Surely, I am not referring to Afzal. There are many who
were given death sentence before him. In my view he should not be treated
differenly and out of turn because he is a Muslim. There are honest
and efficient officers. But as a whole every organ of the system is
criminally lax, indifferent, inefficient and corrupt. First, reform
the systems to make them simpler and faster, particularly the judiciary.
If judiciary becomes fast, half of the problems will be solved. Today
nobody is afraid of law.

About Judiciary
The Supreme Court has cautioned the High Courts against using intemperate
language and passing castigating strictures on judges of the lower judiciary.
For, doing so would diminish the image of judiciary in the eyes of the
public. Image of the judiciary can be maintained only by providing
justice and not by burying justice which is being done now-a-days by
the novice judges of trial court, using their Discretionary Power on
the basis of suspicion/surmises/conjecture etc. and discarding the evidence
on record whimsically. Supreme Court is equally responsible for
the present situation. On appeal judges are not interested in
setting aside the judgements of novice trial judges. Regarding
second appeal despite provision in CPC, Supreme Court has issued instructions
by way of various judgements not to entertain the cases where concurrent
findings of facts are there. Whether the Supreme Court has time
to entertain the SLP or the poor public has money to spend on litigation?
It is well known that there is dearth of competent lawyers and judges.
Instruction of Supreme Court by way of various judgements not to entertain
the second appeal amounts to burial of justice. It seems that
the attitude of Supreme Court is to reduce the number of cases by burying
the justice. The Public should learn the lesson from compromise
between Ambani Brothers and should avoid approaching courts for justice,
which is not being imparted now-a-days until there is media pressure
etc. Supreme Court should immediately withdraw its standing instructions
not to entertain second appeal in case of concurrent findings of facts,
keeping in view the present scenario and decisions of novice lower court
judges. Several
Judges are playing with the sentiments of poor public.
