Navin Kumar to move GoI
Naveen Kumar has been appointed as Principal Advisor in the Planning Commission. He is an IAS officer of the 1975 batch who belongs to the Bihar cadre. The post is of Additional Secretary level, but now it has been upgraded at par with the Secretary to Government of India (GOI).
Anil Goswami is Addl Secretary Home in GOI
As the grapevine has it Anil Goswami Principal Secretary Commerce & Industries (C & I) with the Jammu & Kashmir Government will now be Additional Secretary Home in Government of India (GOI). His appointment orders have been issued. He is an IAS officer of the 1978 batch who belongs to the Jammu & Kashmir cadre.

Communication between President and Prime Minister

Inspection of the file dealing with granting scheduled castes status to convert Christians of Scheduled Castes origin was sought. It was refused under section 8(1) (i) claiming that the relevant communication comes under the category of ‘privileged correspondence’ between the then President and the Prime minister. Referring to the
Apex Court judgment in S. R. Bommai v. UoI (AIR 1994 SC 1918) regarding the scope and ambit of Article 74(2) of the Constitution of India, the Commission directed to disclose the information.

Comments

Article 74 (2) says that “The question whether any, and if so what, advice was tendered by Ministers to the President shall not be inquired into in any court.” The object is that an order issued in the name of the President could not be questioned on the ground that it was either contrary to the advice tendered by the Ministers or was issued without obtaining any advice from the Ministers. It does not mean that the nature of this advice cannot be disclosed and hence, such communication is not exempt under the RTI Act.

Confusion all the time
Is he SAG officer...In telecom (ITS) 1987 batch (exam year is 1987 and joining year is 1989) became SAG. Joint Secretaries are SAG officers. For IAS what is exactly batch year. Is this exam year or year of joining or year of Job offer letter ? So much of confusion all the time. Please clarify.

Resent, criticize or solve ?

The Neta-bureaucrat-business acts of omissions and commissions have been receiving more than deserved attention, because this nexus hurts all of us, especially who would like the rule of law only to hold the sway. Unfortunately, in India (not Bharat), Rule Of Law is a mere fiction. WIC, as also the media generally, has been informing the Aam Aadmi of the centers of power around the PM/CMs or other powerful dignitaries, which are in reality extra-legal operators. The past years since 1947 have consumed so many zillions of words and thousands of miles of space devoted only to the word "corruption" and yet has ended in helping the corrupt to go higher and higher in their political-official-business careers! Why then waste precious time, energy and effort in just mounting a verbal assault on corruption: why try to find out whether a bridge is constructed in public interest or not? It is being built in the interest of someone after all! If it happens to serve public purpose too, well & good!! Otherwise don't crib. Though public spirited citizens will refuse to accept it. That is really the purpose also: no one need suffer corruption in silence. But instead of expressing resentment or voicing criticism, it would help if the approach adopted is problem solving. This is within the powers of every citizen, especially those employed in public services. They need not fight the enemy or try to correct their unique ways--they should rather do their duty honestly and render public service. The problem is when our colleagues express uninhibited willingness to serve the vested interests at the cost of public service and try isolating the duty conscious among the public servants. But just ignore such elements. Those determined to serve can do so fearlessly and honourably--the corrupt are known to each other very well and are always out to outdo each other. politics is never satisfied with one slave!

First approval has to come from Mukesh Ambani !
Selection of a Chairman for a milch cow organisation like IOC is not an easy affair. Whether it is posting of a Petroleum Secretary, Additional Secretary or even a Joint Secretary, the first approval has to come from Mukesh Ambani and then that of the sphinx behind our learned PM.

Stop adhocism
It is reported that SK Srivastava, Director (Operations), Oil India Ltd, has been asked to continue for another six months as the Director-General at the Directorate-General of Hydrocarbons (DGH). Such adhocism must stop forthwith. Let there be a public notice inviting applications and then appoint a suitable person for a longer term. Giving someone the power that is not legitimately due to him is not in larger public interest. This practice must stop.

Fill up posts

The post of Administrative Officer is also vacant in Chennai and Kolkatta Benches. In Chennai since February 2005 and no action has been taken to fill it up till date. Probably, the Heads of Power 'that be' will see that the posts are filled up early and the office is administered properly.
