Your website is doing a great job by providing an outlet to the personnel
of various services to vent their grievances against real or perceived
(In most cases real) discrimination of one's service vis-a-vis other
services in matters of promotion etc. Indian Forest Service-wallahs
feel let down vis-a-vis the other two All India Services, Group A services
feel discriminated vis-a vis IAS, Engineering services consider themselves
worse off than the other group A services. Central Secretariat Service
officers have their own grouse against slow promotions. The latest is
the comparison among Armed Forces and other Paramilitary forces. Everyone
seems to be disgruntled and angry .This is definitely not conducive
to good performance by the government machinery .The whole system appears
to be rusty. The Sixth Pay Commission and Second Administrative Reforms
Commission should have gone deeply into this problem in the interest
of healthy administration. Those who are incharge of the personnel policies
need to reflect on this. A discontented workforce can not deliver. It
is therefore necessary to first create a good climate for performance
and then devise all those high-sounding and complicated Performance
Monitoring and Evaluation systems. The Government should take note of
all these anomalies among the services and take corrective measures
to bring about a balance among different services .After all each one
has an important role to play in the governance of the country.

MEAs revised guidelines strict for State
Governments
Revised guidelines on the channels of communications between foreign
governments or their representatives in India have come as a blow
to state governments. From now onwards for such any communication state
governments will have to strictly route through the Ministry of External
Affairs (MEA). However, these guidelines have been further liberalized
for departments of the Government of India (GOI).

Duties and functions of the office
The Appellant was informed that the duties and functions of the
audit department of the Public Authority have not been specified and
hence cannot be provided. The CIC directed the Public Authority
to define the duties and functions of the audit department and put it
on its website in discharge of its obligation under Section-4 of the
RTI Act.
Comments
Ordinarily, questions do not constitute information and cannot be raised
under the RTI Act. However, the Public Authority cannot claim non-availability
of information as an excuse for its inability to provide the same in
all cases. An assertion that a Public Authority is not expected to create
information will not hold against fulfilling the responsibility under
section 4. (The readers may recall that section 4 calls upon the Public
Authority to suo-motu disclose information about itself on a reqular

Open the Pandora Box ?
When the very first Census of India was undertaken by the British there
was a separate coloumn for Hindus and Muslims. This finally led to the
partition of the country, for who are the Pakistanis but ex-Hindu OBCs?
So Pakistan and Bangladesh are really OBC states carved out of India.
The demand for independent tribal Christian states in the Northeast
also follows a similar pattern. By enumerating castes in the Census
there will be political demands in the not too distant future for a
Dalitistan, a Yadavgiri, a Jatland and so on. Should we open one Pandoras
box after another?

It looks appalling
Social discrimination is not restricted to India alone and for that
matter to Hindus alone. In USA African Americans are looked down so
are Hispanics. In Britain Catholics are looked down. Why in our own
Kerala, Syrian Catholics look down on Latin Catholics. Most of the discriminations
are due to their respective way of living, hygiene and cleanliness playing
a major part. These discriminations will reduce only when the down trodden
communities understand their weaknesses and correct them. Some of the
leaders who flash their community card for upward mobility always look
for marriage from upper castes. We have seen Ex.President Narayanan
marrying a Burmese who kept his community people away from him. We have
Paswan who kicked out his SC wife to marry an OBC. There are several
instances in bureaucracy also. Sixty years of reservation has resulted
in creating a creamy layer amidst the reserved classes. There are instances
of even three generations of the same family reaping benefits. Therefore
to show few odd cases and cry discrimination is tragic. Let me ask.
How the Dalit got into UN when there are thousands of people including
upper castes trying for it? Was there any disrmination there? Founding
fathers of our constitution including the icon of SCs, Sri Ambedkar
meant the reservation only for a brief period. They knew that continuing
it indefinitely as now will adversely affect the quality of administration
which will directly affect the down trodden.

Casteism is in Indian constitution
Those who have interaction with international bodies may very well appreciate
how casteism has been introduced in Indian Constitution by Dr B. R.
Ambedkar. Here everybody talks very freely about " Scheduled Caste,
Scheduled Tribe & Other Backward Castes" both inside
and outside parliament of India. Because it is there in our constitution.
Not only that India has reserved seat in Parliament & government
jobs based on castes of people. And Government employees know how it
divides them in treatments & promotions because of their differences
in castes. This reservation is based on 1931 Census done by Census Commissioner
Lord Risley.
Had India become averse to casteism, it should not have used this
data and caste-based policies & programmes would not have been formulated
till date. Rather India should apologise to Lord Risley for accusing
him of dividing India based on caste.
No civilised nation other than India discriminates her citizens
legally based on castes & religion. Caste based reservation is not
even secular. While Hindu SC/STs enjoying reservations since independence
their Muslim counterparts have no such reservation in jobs till date
despite being far below in development index. And faulty reservation
policy has prompted Historian Rama Chandra Guha to comment " Once
in permanently in". Further FICCI Secretary General has written
few years back that 37% of Industrial Units are controlled by SCs/STs.
So there is nothing new or wrong in caste-wise census in India.
While an Indian Muslim can have four wives at a time; even Muslim Nation
like Pakistan can not allow one to have more than one wife at a time.
India has gove to any extent to appease minorities & caste-certificate
holders.
So go ahead with caste wise census.

Opinion of an affected individual
A comment in Whispers dated 14th that making civil servants
accountable and subject to RTI will make the service unattractive in
future, seems to be the opinion of an affected individual. In fact,
the civil servants have been hiding under their rules and have
so far not been held accountable for whatever they do. For wrong decisions,
the blame is mostly put by them on the people's representatives who
head the ministries. For acts of corruption, wrongdoing, lethargy and
inefficiency, even now there is no prompt accountability and punishment.
Therefore, in fact, there is need to further strenghten the rules. If
some persons do not join civil service fearing accountability, such
persons are not needed in any case.

Of what use the report is?
Department of Administrative reforms recently got a survey done on 'State
of Civil Services in India'. The findings of survey are quite interesting
but given our track record on implementation of administrative reforms
in all probability the report would be consigned to the big dustbins
of Govt. of India particularly because the survey has highlighted the
frustration prevailing in Central and other AIS services against the
manipulative ways of IAS. Cab Sec has a given a lip service forward
and some other statements would also come out from some other forums
but gradually everything would fade out and things would continue to
be as they are because the big boys would never allow any meaningful
reforms to ever take place. Sample this as example there was a lot of
noise on empanelment process in the Central services and finally IAS
managed to hold on to the informal two years advantage they had built
in the system. However even that did not satisfy them and they have
informally ensured through their control over DoPT that this advantage
extends to more than 5 years so today when 1990 batch of IAS has been
empanelled for JS only the 1985 batch of other services has been considered
for empanelment. In my opinion this facade of administrative reforms
should now be given up and a rule should be brought out that other services
can not form part of central staffing excepting at DS/Director levels
which of course our big boys dont like to man given the clerical
nature of the job content at this level. Dear Cab Sec also need not
waste his precious time on such lip services when even a child knows
that there is no possibility of real administrative reforms in a regime
where 'might is right' is the principle norm of governance.

Why always IPS?
IPS seek their elevation as DG by sneaking into paramilitary forces
and shattering their dreams of higher posts. These forces are engaged
with never finishing duties unlike army .still these forces dont
have CSD facility, Free Ration provisions and so on because their none
to take up their case. Even in MHA, IPS are advisories although they
are far apart from the ground realities of the forces. Why always IPS
IG (Pers)?-To enjoy their deputation &desired postings.

Another scandal !
According to a report released by Housing and Land Rights Network-a
group of NGOs the total cost for the Common Wealth Games has gone up
almost 15 times the original estimated cost at the time of bidding.
Named "Whose Wealth? Whose Commons' the report gives out what is
feared to be another scandal in the wastage of public money. Games are
important and our national prestige and pride are at stake but
what is being done in the name of beautification in the run-up to the
Games is so very ugly. Lot of money has been wasted in what is called
'street scaping'. Pavements have been uprooted, border stones removed
and new stones laid in many cases shortening the width of the main roads
as the dividers are also two row dividers leaving the gap in between
perhaps for plants or foliage which so far are nowhere in sight. The
old pavements were good enough. A good scrub and paint would have been
nicer than the present ugly looking stones. Commuting daily through
the roads where work is being done one gets dismayed by lack of imagination,
planning and coordination in this streetscaping work.one departments
puts the iron railings dividing the street. A few days later you find
some of them removed maybe landing up at Kabadiwala' shop. Then the
railings and stones are removed and the earth dug to lay the electric
lines for new street lights.one garish example of this beautification
is the saffron and yellow 6-inch tiles being plastered all around the
wall of the complex behind which there is a godown, a temple and a junk
yard when you get down the Safdarjung flyover towards Laxmibai Nagar.
The 'malba' the barriers, the dug pits and stones are strewn all over.
When are they going to clean up? The waste of money is so very evident
.I hope the Games go off well but the cost of the Games is indeed going
to be very high.

Whose fault it is ?
It is strange that an officer is made to suffer for a missing ACR, though
it is not his fault. Invariably, officers submit their self-appraisal
but reporting officers either fail to record or delay their reports.
New PAR system has further complicated it because a number of reporting
officers do not record their report because they can not face the consequences
subsequent to conveying of the report to the officers and likely appeal
or review thereof...they prefer not to write the report or their report
is not objective...Also the present reporting system has a major lacuna
as it does help to capture or bring on record inefficiency or doubtful
integtriy of officers....because of inherent subjectivity in the system
or intellectual dishonesty on the part of some of the reporting officers...notwithstanding
instructions of DOPT, these ills of the systems need something like
external or third party honest and independent evaluation to assure
officers of their objective annual assessment.

Wanted only scientist with research management experience
Scientists in ICFRE are opposing non scientist DG for ICFRE. They insist
that only scientist with research management experience can understand
explore best of scientist working there. They also made a point that
in December 2009 minister told that DG ICFRE should be scientist of
Dr. M S Swaminathan's calibre. In January 2010, Dr. Manmohan Singh stated

I must thank the whisper for bringing the selection of DG ICFRE a Secretary
rank post to public domain. We scientists and IFS working in ICFRE are
in the crying need for a good DG who should join immediately. The post
is vacant for the last almost one year Can the dynamic Minister intervene
to sort out things as other bureaucrats are sleeping. Will PMO pull
the wires????

Never ending woes
I am CSS officer. The personal secretariat of Senior Officers
are to be maintained only by the CSSS officers. By the might of
their bosses the CSSS officers get LDCs, UDCs & Assistants posted
in their establishment. This against rules. Through an RTI Application
I have obtained the copy of the latest orders of the entitlement of
personal staff of Ministers, Secretaries, Additional Secretaries.
I have also obtained information from various Ministries/Departments
that how excess staff are posted in the personal section of officers.
I am an honest tax payers of the country and I have full right to ensure
that the Government's money is not spent in an injudicious manner in
the form of posting of excess staff. The CSSS officers are warned
to be ready to face hard days. I propose to file a PIL in the
Court to end the malady of excess posting of staff with the Senior Officers
including from the PSUs, attached and subordinate offices. I will
also fight all the Court cases filed by the CSSS in various courts for
their entry into the CSS every tooth and nail till the end of my life.
If the CSSS get any benefit from the Court (I am sure this cannot happen),
I will take some drastic action.

Non Functional Grade Fiasco!
The IPS / IFS ( Pay ) Rules have been amended recently to incorporate
provision regarding grant of higher grade / grade pay on non functional
basis to members of these services in their respective States whenever
any IAS officer of a particular batch, who is two years or more junior
to such members of IPS / IFS, is posted at the Centre to a particular
grade carrying a specific grade pay in PB-3, PB-4 or HAG scale. The
Central Government has sought to restrict the applicability of this
provision, in the Pay Rules by issuing instructions dated 16th March,
2010 that the provision shall be applicable against only those IAS officers
who are empanelled under the Central Staffing Scheme for posts of DS
/ Director / JS / AS or equivalent! This Association had pointed out
that the restriction placed by the GOI vide letter dated 16th March,
2010 was against the letter and spirit of the Rules, and therefore needed
to be withdrawn. But, no action has been taken as yet.
In this regard, attention of all IPS / IFS officers is brought to the
Circular Dated 12th March, 2010 issued by the DOPT regarding fixation
of pay of AIS officers appointed as DS / Directors / JS / Additional
Secretary under the Central Staffing Scheme.
The said Circular conveys the GOI's decision that in the case
of appointment of an AIS officer to a lower grade at the Centre or in
the case of proforma promotion to the next higher grade i.e. super time
scale or above the super time scale, or in the case of their proforma
promotion to any of these grades, their pay may be fixed in the grade
/ grade pay to which they were promoted in their State cadre / given
proforma promotion by the State cadre authority.
In essence, an IAS officer, who is promoted / given proforma promotion
to supertime scale or above supertime scale, prior to or after joining
the Centre on a lower grade post, is entitled to higher grade
/ grade pay. So an IAS officer working as Director / Joint Secretary
in the Centre is permitted the higher grade / grade pay to which he
was promoted in the State. He is also permitted to draw higher scale
if he gets proforma promotion in the State during his tenure in the
Centre. In nut shell, he is entitled to higher grade on NON FUNCTIONAL
BASIS!
The moot question is would IPS / IFS officers two years or more senior
to such IAS officer be extended the benefit of higher grade on non functional
basis as the Note 3 under Rule 3 of Pay Rules provides? Or, the DOPT
shall issue fresh instructions to exclude such IAS officers from their
scheme of granting higher grade / grade pay to IPS / IFS officers?
That's the way you can eat the cake and have it too!

The unnecessary chatter of the city based English speaking media anchors
is many a times more irritating than the cliches from our rogue politicians.
The coverage of the Pakistani terrorist guilty of 26/11 massacre always
makes top story and not the achievements of an Anand Kumar of Bihar!
What priorities? And now, the low language used for the indian cricket
team and its captain. I am sure the script for the "shaandaar vijay'
must have been kept ready. But since it could not be used, the other
script of "sharmnaak haar" was used. Does the fundamental
right to speech & expression include use of words that are better
avoided( without compromising on content) or loosen the tongue to utter
anything that it is able to lick? Abominable, at times. Anger and desperation
are understandable, but a healthy analysis is necessary. May be the
other team proved itself superior or our players had insurmountable
constraints or any other reason. Instead of doing that we tend to straight
away reach for the throat of our object of anger. Unfortunately, we
pay no attention to the enrichment of our language(s), but want to communicate
the complexities of the contemporary times through our limited vocabulary.
Hence, words like sharmnaak get used so freely at the drop of a hat.
It would be interesting to subject the letters written on the official
pads of the elected members against officers to language audit. That
is why they make mockery of themselves whereas they could have set examples
of dignified use of language. The leadership of the freedom movement
displayed that venerable quality, which is fast disappearing.

Doctor selected through UPSC stays temporary for full service. It was
told by one doctor friend that when Professor retired he was told
that that he was not permanent after serving for more than 28 years.
Ministry of Health which is a controlling body had not passed the order
for him as well others doctors for permanency (substantive capacity)
or years. These doctors also keep working without knowledge of service
rules. Ministry must take cognizance of this. Almost half of doctors
serving in CGHS may still be temporary.

Extension counter of the Army HQ ?
If the working of the office of Engineer-in-Chief (E-in-C) of Military
Engineer Services (MES) is any indication, then it can be seen that
the Ministry of Defence (MOD) has of late become an extension counter
of the Army HQ. Many examples of the same can be found from the attitude
of Engineer-in-Chief (an army officer of Lt General rank)of Military
Engineer Services (MES). Whenever an issue concerning legitimate aspirations
of or improvement in the career prospects of civilian officers of MES
has been taken up by the MOD, the E-in-C with support from top brass
of Army including Army Chief have done everything to scuttle the issue.
Many orders of the MOD remain unimplemented by the E-in-C with impunity
in spite of the fact that lot of time has elapsed after the issue of
such letters. There is an open defiance of orders of the MOD by the
E-in-C with connivance of Army HQ. The Cadre Review of Civilian officers
initiated more than six years back has been completely derailed by the
E-in-C at a stage when it had already been cleared by the MOD, Finance
and DOP&T. The ministry appears to be helpless and unable to resist
the pressure. Are we going Pakistani way?
