Government seeks legal opinion about CBI panel
The Government is reported to have sought legal opinion about the inclusion
of 1976 batch IPS in the panel for the CBI Director. According to the
guidelines of the Supreme Court, names of four batch of IPS are to be
included. It means panel of IPS officers belonging to 1972,73,74 and
75 batch can only be included in the panel.

Tata Motors sales up by 21 per cent
Total sales (including exports) of Tata Motors' commercial and passenger
vehicles in October 2010 were 64,757 vehicles, a growth of 21% over
53,404 vehicles sold in October 2009. The company's domestic sales of
Tata commercial and passenger vehicles for October 2010 were 58,807
nos., a 16% growth over 50,552 nos. sold in October last year. However,
Cumulative sales (including exports) for the company for the fiscal
are 444,870 nos., a growth of 50% over 296,354 nos. sold last year.
The company's sales of commercial vehicles in October 2010 in the domestic
market were 34,329 nos., a 12% growth compared to 30,541 vehicles sold
in October last year. LCV sales were 20,689 nos., a growth of 11% over
October last year. M&HCV sales stood at 13,640 nos., a growth of
14% over October last year.
Secretary MOP&NG visits IEC at Moscow and
Tomsk, Russia
S. Sundareshan, Secretary MOP&NG, GOI accompanied by R.S. Butola,
MD OVL visited Imperial Energy Company (IEC), at Moscow and Tomsk, Russia
and met the Governor of Tomsk region V.M. Kress to discuss issues of
mutual co-operation and commitment of GoI to strengthen business ties
with Russia in general and Tomsk region in particular. The duo also
met met the senior management of IEC and reviewed the operational activities
and future plans. Braving the chilli winds they also visited Maiskoye
oil field of IEC and congratulated team IEC for excellent upkeep of
operational facilities.

ACR grading
In respect of disclosure of the ACR grading filed by a Brigadier, the
Commission referred to the Office Memorandum No. 21011/1/2005-Estt (A)
(Pt-II) dated 14.5.2009 issued by DoPT. The para 2 (v) provides that
the grading in the APARs shall be communicated prospectively with effect
from the reporting period 2008-09. While dismissing the appeal, the
Commission also referred to the case, Dev Dutt v. UOI (Civil Appeal
no 7631 of 2002), which excludes the military personnel from the disclosure
of ACR grading.
Comments
The military personnel have been categorically excluded from disclosure
of the ACR grading vide the Dev Dutt case, but the disclosure of ACR
for others has not been ordered with prospective effect. Anyone, besides
the military personnel, who has not been given an opportunity to represent
against a grading given for an earlier period in the ACR can approach
the Court for getting the OM modified.

Sub:- Engineers feeling let down after successful Commonwealth Games
2010.
Respected Sir,
We congratulate you and the citizens of India for successful organisation
of recently concluded Commonwealth Games-Delhi 2010. We also congratulate
you for first ever second position in the medal tally of the Commonwealth
Games. This performance has silenced all those, within the country as
well as abroad, who had doubts about the capability of India to host
such international event. The foreign media, which was very critical,
is now gung-ho about the CWG-2010.
We have learnt from the media that CAG, CVC and other agencies have
been asked to investigate all the works done by Organising Committee,
city Infrastructure and stadia constructed by CPWD, Delhi Government,
NDMC,DDA and Delhi University etc. We are fully with you so far as punishing
the corrupt is concerned, however, a wrong message is going to public
that irrespective of rank and profession everybody associated with Commonwealth
Games is corrupt. This is not going to brighten the image of our country.
The scrutiny could have been ordered against those who were visibly
under doubt and where inefficiencies, incompletion, shoddy workmanship
etc was reported/found. If the integrity of everybody associated with
the preparation of Commonwealth Games was doubtful as alleged by the
media, country should not have organised the Games at all.
We, the engineering fraternity, were quite hopeful that while punishing
the corrupt, you will also appoint a committee to identify and recognise
the best performers who worked tirelessly for the last two to three
years to create such world class stadia and other city infrastructure.
Unlike many other government servants, every engineer associated with
CWG-2010 worked for 14-16 hours everyday braving extreme winters and
hot summers forgoing weekly offs, festivals and yearly vacations, ignoring
health problems, postponing personal matters, suffering major and minor
injuries so that India could stand tall in the world community. Without
their hard work, such mega-structures could not have been created in
such a short time.
Technology wise the CWG-2010 infrastructure is best ever and comparable
to any other in the west. Any country would be proud of such legacy.
One can also find out as to how many years did China take for creating
the venues at Beijing or U.K. is taking for the London Olympic in 2012.
Even in developed countries, they normally keep three years only for
construction for such works whereas the total time available to Indian
engineers from concept to completion of the CWG projects was hardly
three years, in some cases even one to two years. In spite of multiplicity
of authorities who did not attach any urgency in giving mandatory approvals
in the absence of any unified command the projects had been conceived,
plans prepared, administrative and financial approvals obtained, designs
worked out, close coordination held with various overlapping agencies
and execution of works completed in time for organising the Games. The
projects, during execution, faced extreme criticism from our own media
and an unprecedented monsoon. However, finally all the participating
nations unequivocally declared the venues as world class.
A committee of technocrats headed by a person of eminence like E. Sreedharan,
MD DMRC would perhaps be an appropriate body to appraise the performance
of engineers associated with organisation of CWG 2010. But when the
entire nation is basking in the glory of organising the great Games
the engineers, who worked day and night to make the nation's dream a
reality, are at the lowest of their spirit and morale. Their moment
of glory has been overshadowed by excessive and unfair criticism. CWG-2010
was unthinkable without the contribution of engineers yet they were
completely ignored and sidelined even by the Organising Committee during
the Games.
Oversight agencies are necessary in every society but there should also
be due place for those who provide service and add permanent assets
to the nation. If the pride of the professionals is not protected, how
can we expect to create a pool of competent and committed engineers
with self respect who would accept such challenges in future? After
completing the mega event utilising the stadia and other infrastructure
created through the hard work of engineers, the nation should not be
seen so ungrateful to its technical manpower otherwise they would not
be able to work with confidence in future in such eventualities. This
is the time for supporting our technical manpower and boost their morale
rather than summarily discredit them to satisfy a TRP driven media.

Many non IAS officers too have been Secretaries to the GoI
Many non IAS officers have been Secretaries to the Government of India
in recent years as well, Jung of the IAAS was Secretary Civil Aviation
couple of years back, Shahi a technocrat was Secretary Power some years
back, Krishnamurthy of the IRS was Secretary Corporate Affairs and subsequently
Chief Election Commissioner some yaers back. In the olden days of course,
IAS officers were rarely Secretaries, ICS officers were. Till the last
ICS man retired, they preferred Services like the Customs over the IAS.
The reason is obvious, the IAS was mostly recruited from the pre independence
PCS. That way the IAS has origins in the PCS of old. Many Customs and
Audit Service chaps have been Secretaries earlier also. Till the Finance
and Commerce pool was extant (till 1977 when Morarji Desai, another
ex PCS officer, abolished it) many officers from other Services who
were seconded to the pool became Secretaries to the Government regardless
of service.

Case for cross pollination in MOHFW
The sorry state of health affairs in MOHFW, poor health indicators should
be a wake up call to this government and Prime Minister should personally
review this; get some strong and honest civil servants to lead the department.
There is a case for cross pollination of skills too viz.
a) Appoint IAS and other Officers to MOHFW only if they have a Medical
or Public health degreee or have worked in the State Health dept for
atleast 3 yrs ( Look at the present crop--less than50% fulfill this
condition)
b) train the CHS doctors ( CMOs/DyDGs ) in Public Sector Management.
Tie up with IIM Bangalore or similar such institution. Make it compulsory
before they get their promotions.
c) Get Health Advisers /External expertise in MOH to improve the knowledge
base and understanding of the IAS brotherhood
d) Do a systems audit of MOHFW. Ask CA&AG to look at the major decisions
for irregularities , if any
We have a well meaning Minister who is too much of a politician, so
major /harsh decisions that take forward the public health agenda are
not taken or encouraged.

Kashmir problem !
As a citizen, I am baffled and confused by our successive Government's
policy on Kashmir. I would like to ask the following questions.
1.Was it not Nehru, the founder of the present ruling dynasty who created
Kashmir problem by stopping a winning Indian Army from throwing out
Pakistani invaders in Kashmir much against the advice of Army generals?
Was it not he who internationalized the problem by taking it to UN.
Was he not the one who unilaterally offered plebiscite in Kashmir at
the same time giving the state a unique status under article 370 and
preventing other Indians from settling there?
2. Was it not a fact that we had to be rescued by Russian veto from
Security Council censure several times?
3. Why are we keeping quiet about Pakistan's gift of part of Kashmir
to China. Why are we being quiet when Pakistanis from the plains are
being settled in POK and democracy is denied there?
We can not go on eternally fooling the world saying it is an internal
problem. We should have the courage to offer plebiscite under the following
terms;
1.It should be applicable to J&K, POK and Ladakh.
2.Pakistan should get back all the land ceded to China.
3.All outsiders should be moved out of POK.

Send SAG officers to telecom deptt
Railway has promoted at least 24 officers more than the sanctioned posts.
SAG officers working in zones are regularly sent on leave to accommodate
these excess officers. Every month the incumbent of the post is changed
and governance has gone to dogs.
Please tell them to send these SAG Officers to Department of Telecom.
They have generated enough space in BSNL to accommodate such SAG and
HAG Officers in connivance with UPSC under the pretext these posts are
civil posts of Government operating in BSNL.

Corruption in India
The problem in India about corruption is lack of character. Probably,
indians are not raised properly so that ethics and values will play
an important role. Most of Indians adopt double standards. If a politician
wins an election, he will first think how much money he will make during
his tenure. If a bureaucrat finds a project in his ministry first he
thinks how much money he can make out of it If a policeman registers
a case he starts counting money. If a taxman finds a rich man first
he thinks how much money he can share with him. We need a leader who
can do something.
