The Central Board of Excise and Customs (CBEC) is facing dearth of Chief
Commissioners. At present nearly 50 per cent posts are vacant. Most

Copy of complaint filed by third party
The appellant had sought a copy of the complaint filed against him by
the third party which was permitted by the first appellate authority.
The third party filed an appeal against this order claiming exemption
u/s 8(1)(g). The Commission observed that the third party has produced
no evidence to prove that the appellant is likely to endanger the physical
safety of the third party. The appellant has only claimed that the third
party is a habitual complainant and the mere allegation of this nature
does not establish any ground to believe that the physical safety of
third party is endangered. The Commission directed the PIO to give a
copy of the complaint to the appellant.
Comments
In the absence of the Whistleblowers Act, an applicant would have
to substantiate his claim of a danger to his life and physical safety
to claim exemption u/s 8(1)(g).

Dont raise retirment age
I am in Government with more than 20 years of service. I wonder why
Government should raise the age of retirement ? The permanency of the
civil service (or life long job) too has its disadvantages like inefficient
bureaucracy that cannot even organize CWG. The answer would lie in revamping
the Civil Service, allow for lateral induction of talent. IAS and other
services may oppose it. The answer to that should be an equal opportunity
for the government folks to go out ( on secondment, lien , whatever).
Let us work towards having a more robust governance system, rather than
clamour for 62 or 65. My advise would be to reduce the retirement age
from 60 back to 58 or 55, and free up these highly rated, top civil
servants to serve society in any other way they want ( from 55- 70).
15 productive years! Looking forward to hearing more on this.

There is nothing to repent by Government. Retaining of a
person over the age of 60 years in Government service is, as it is felt,
to call for an invitation of liabilities on public.

All kudos to our system !
As one watches in exasperation the mess surrounding the CWG 2010, one
is also sure of one fact that despite such a huge loss of face of the
nation before the international community, no one, I reiterate here
no one, would be held responsible for all this. Such is our system
that bureaucrats would hide behind netas who will pass buck onto each
other and after a plenty of mud slinging the 'chalta hai' would takeover.
Our media would cry hoax and slogan of 'enough is enough' would surface
once again for some time but things would remain the way they are. CAG
and CVC would come out with some reports( which as usual would have
nothing new to offer) and the same would be referred to a parliamentary
committee which would give a 'golomol report' after donkey's years which
shall rot into some government record rooms to be quoted by some intelligent
parliamentarians once in a while in their speeches. We in this nation
have learnt the art of patience and move on and the end of all these
stories is as predictable as the end of our Mumbaiah movies.

Don't take people for a riot!
Everybody from the PM/HM to civil society is talking in the name of
the people, but nobody reveals what it is all about! Even our Judges
of the HC have taken almost 60 years to understand what it is all about,
but seem to be unsure of it all. They got the assistance of the AGs
and lawyers but still can not decide a simple matter of title to a small
piece of land! The tragedy is that they expect the people of india to
understand what it is all about in a few moments of their delivering
the judgement! What do they think of the people? Some kind of Shri Ram
or Allah? If the courts want time, if the government wants time, if
the civil society wants time, please give the people of india time to
understand what it is all about. It would be naive for anybody to expect
the youth under 25 years of age to understand what it is all about when
they were not even born at the time the dispute was raised by insensitive
people nor have they been taught anything about it in school/college/university/job.
How do you expect people to react without possessing the factual information
on the subject? Do you want them to be (mis)informed by agitated TV
anchors, debaters, politicians, religious dignitaries, newspapers, foreign
media or Al-quaida/Pakistan/ISI? The lawyers on both sides say the matter
is "complex". If it is complex, please place all the facts
of the case in public domain, since the public at large is going to
be affected by this judgement as by no earthquake/tsunami/tornado/wild
fire etc. The people have a right to know what is bothering the courts
that they have failed to deliver the judgement for decades and still
unsure about. Tell us the "complex" contours of this issue
and we will solve it in less than 4 weeks straight. Trust the wisdom
of the ordinary in India over the legal complexities created by the
English law, which nobody seems to understand fully! We demand of the
court to please release the case books on their website and also in
CD form for all those who want to understand the issues and contribute
to a satisfactory resolution, sparing the lives & properties of
the citizens and the nation. Heavens are not going to fall if my request
is granted by the courts. On the other hand Heavens are likely to descend
on our beloved India!

Pride and Nationalism
Complicated Indian polity
The polity of India is complicated in terms of region, religion, language,
caste and gender. This has unfortunately led to loss of national pride
and spirit. Nationalism is forgotten word. The lack of pride in our
country, and lack of nationalism ( as is evident in CWG Mess) should
be a wake up call to all. There is a need for a citizens movement to
build nationalism. Not too sure if Government could do anything! Is
the Congress Party grown enough to take this as an agenda ?

put best men on the job, allowed efficient people to retire, delayed
approvals by treating Games projects like ordinary projects, too many
committees/men to monitor, Games in October instead of November to allow
for time after monsoon.

Hold one person responsible
The pathetic situation of Delhi during commonwealth or any other city
during an occasion or even on normal days, the solution is only one.
Just as in many western countries, there should be only one person responsible
for the good or bad of a city. Its the Mayor. In these countries,
the Mayor has all the police power, magisterial power, civic power and
he is powered as well as responsible for everything in the city.
The government must bring this system in Indian cities. Today the DM
runs civil administration, Mayor is supposed to run civic administration,
SP is boss of law and order, so in the end nobody is responsible.

Subletting BHEL quarters
Denial of Government residential accommodation to Central Government
employees on account of subletting by its employees for greed of more
earning has become a profession and another big chunk of accommodations
with enquires meant for renovation by plundering away precious wooden
doors and windows and replacing it with useless material and keeping
for 6-12 months leads to loss of revenue to Government and denial of
accommodation to employees. One can approach any Govt. colony's
property dealer and you can get accommodation on price. All above
seems to be big commerce to property dealers, CPWD employees, prized
owner of govt. accommodation and somewhat to estates employees and looser
is Govt., tax payer and the un-allotted Govt. employees. Since
none of the above will change shall we start a movement through this
august website by daily putting in one or more accommodation which are
on rent in our neighbourhood or are with CPWD for over one month in
the name of renovation and upgradation - as under renovation also leads
to anti social activities by disgruntled employees and bad elements
leading to sence of insecurity in neighbourhood. This will make
out the rot in the system and help to genuine users and unallotted govt.

Appeasing Muslims !
It appears Congress and CPI(M) are falling over each other to appease
Muslims. While Government in Kerala is sending financial relief to Pakistan,
the WB Government has declared all Muslims as OBCs. Mean while centre
has declared a subsidy of Rs.16ooo each to the 1.8 Lakhs Haj pilgrims,
a whopping 300 crores of tax payers money. All these Governments
are giving substantial financial aid to the medieval Madarsas though
they do not impose any control over its running. They are also declaring
Madarsa examinations as equivalent to CBSE and degree examinations.
