Elected are elected by us and so if we protest to let them know our
mind it is legal!!!
I'm sure had Justice Mazumdar's Judgment been tested in SC , the SC
would have literally binned Justice Mazumdar's judgement! It is every
Citizen's right to peacefully protest.... and just because Parliament
is discussing the issue it does not mean no one can protest on the issue!
I'm sure Congress has placed Justice Mazumdar's Resume in 'Potential
CJI' candidates file!!!! The Lokpal Bill is in Public Domain and many
Indians have found this Lokpal to be a Jokepal or Corruptpal.... so
why can't they protest to show the MPs that this Bill is unacceptable????
It's pure hogwash that Team Anna and protestors are demeaning Parliament!!!!
The Sarkaari Lokpal is just a showpiece....cannot even appoint a Secretary.....
that's because the Secretary will be expected to serve as a 'Ghar ka
bhedi' by the Party in Power!!!! Lokpal will go after the corrupt and
CBI will protect whoever the Party in Power stamps CBI... 'Cannot Be
Investigated'!!! It is pretty evident Congress does not want corruption
to be tackled...... and so Congress is plugging for a Lokpal that will
in fact be a Post Office and CBI will be used to whitewash the 'allegations
of corruption' that Lokpal forwards to CBI!!!! And then just see the
perverseness in this Bill.... those who face corruption charges get
Government Legal Aid....and even Legal Aid to sue the Whistleblowers
however no aid to the Whistleblowers!!! Whistleblowers are left to the
mercy of the corrupt....some are bought over... some pressurized to
withdraw and some are neutralized!!! And the beauty is just 10% of Politicians
and 5% Officials come under the ambit of Lokpal!! And why should a Show
Cause Notice be sent to the Politician or Official prior to commencement
of investigation??? CBI needs to be Independent....CBI coming under
the control of the Government , whose corruption CBI is supposed to
investigate, is indeed against the very spirit of Justice!!!
As BJP's star speaker Sushma made valuable points in her speech!!
And Congress's start Speaker Sibal gave one message 'Congress stands
behind every leach'!!
The Minority reservation is only a ploy used by Congress with one eye
on the vote bank and the other on creating a wedge in the Opposition!!!
There is no reservation in Judiciary..... EC.... CVC..... CAG.... then
why in Lokpal..... as it is any Body in the Judicial domain should not
have any 'reservation'!!!! And enforcing Article 252 is technically
wrong.... our Lokpal has been in the pipeline for 42 years... way before
we signed the UN Charter on corruption!! The fair mode of selecting
Lokpal and CBI Director would be ..... PM, Leaders of Opposition in
RS and LS, CJI and any Cabinet Minister of PM's choice!!! And then PM
delivered his speech....spoke on the various Schemes launched by UPA...he
needs to be reminded about the phenomenal corruption ..... NREGA for
example...... it's a bleeder!!! He spoke of the RTI..... may I remind
him of his efforts to water down RTI!!!! Inclusive growth...what a joke....
the gap has widened phenomenally....and what progress in Economy is
he talking about.... our Economy is in a fix!!!! Mr . PM how can we
trust a lopsided selection Group and Mr. PM that's the objection to
the Selection mechanism of the Lokpal and CBI!!!! And Democracy is not
in danger because of a strong Lokpal but because of the rampant corruption
in India!!!!!

PM speaks last usually so why in this role was Pranab Da cast!!
Pranab Da played his role to the hilt!!!! He took on Yahswant Sinha
on his statement that this was PM's bye bye speech...... Yashwant responded
later that he said this because this was the talk in Parliament!!!Pranab
forgets that fighting corruption goes beyond numbers..... in fact if
fight is constrained by numbers the fight is shackled!!! Pranab reached
out to the Opposition.... but it's said Congress's floor managers were
haughty....maybe they were being commandeered by PC!!!! In the end Lokpal
Bill was passed .... Rahul's game changing idea was not!!!!! Post the
Vote Rahul was on his feet with his 'Brat Gang' doing some arithmetic....
to pass Rahul's idea Congress needed BJP's vote.... viewing Rahul's

not need to tell you what will be the condition of the road in a few
weeks'!!! Sharad Yadav very rightly said Pranab Da is overworked.....
Sibal, PC, Kursheed etc., create fires and Pranab Da has to blow out
there fires... and the fact that PM delivered his speech in the mid
of the discussion and Pranab Da gave his response at the end , exemplifies
this!! Laloo said that he felt only Manmohan Singh qualifies to be Lokpal
as per him (Laloo)...... so then Manmohan Singh as Lokpal will do what
he did as PM.... clean chit, white wash and side with corruption!! In
act in the English Dictionary there is a new word because of Manmohan
Singh.... Dishonest-honest or Imaandar- Beimaan!!

Anna effect derails work implementation
The Anna effect has created a fear psychosis among the corrupt bureaucrats
with the result that several projects and schemes including those meant
for the welfare of people are languishing for want of initiative at
the higher level. This was the conclusion of a debate conducted by the
whispersinthecorridors.com titled 'Lokpal Bill and Bureaucracy' recently.
Whispers has asked "The debate on Lokpal Bill and the subsequent
anger and protests across the country led by veteran Gandhian Anna Hazare
has instilled a fear of accountability among the bureaucracy. How should
the bureaucrats react to the situation?" and the majority of respondents
felt that since the government officials have become extra careful,
even many important works have taken a backseat.
And the fear about the adverse impact of Anna Hazare (Lokpal bill)
on 'mega projects' is not totally unfounded. In the absence of 'speed
money', the projects could slow down temporarily due to fear in taking
rational decisions. The institution of Lokpal will check, if not stamp
out, inflow of black money - into the realty sector and social sector
schemes - that is being misused as a corpus for bribery. Though, the
Realtors, as private players, will not come under the ambit of Lokpal
bill, their nexus with corrupt government functionaries will get exposed.
However, some of the respondents said, "Only the corrupt should
fear Lokpal Bill". The Anna effect, according to him, has created
a fear psychosis only among the corrupt bureaucrats by enhancing their
accountability. The corrupt Ministers alongwith the public sector executives
handling projects are also feeling immensely threatened by the impending
Lokpal Bill. The nexus between the corrupt political Executives and
bureaucrats is an open secret. No Minister can indulge in corruption
without the collusion of corrupt bureaucrats and vice versa.
Let the performance of bureaucrats/executives be assessed in relation
to physical and financial progress of government projects. Greater transparency
in tender evaluation is required. The and PSU executives must also refuse
to buckle under the political pressure.

Pakistan: PM orders inquiry against Defence Secretary for his affidavit
in Memogate
Pakistan's Prime Minister YR Gilani has asked the defence minister to
order an inquiry to ascertain the circumstances under which he had in
an affidavit filed in the supreme court in the 'memogate' case stated
that the 'MoD has no operational control over the army and the ISI and
looks after only administrative matters'. 'Changing the Secretary is
no big deal', the PM said and added, 'but I have asked the defence minister
to hold an inquiry'.

the supreme court has rubbished the federal government's stand that

ambassador to US, Hussain Haqqani had to resign if the memo was a non-issue.

elected representative to address a bureaucrat as "Sir"?
Orissa Chief Minister Navin Patnaik has asked
Cabinet Ministers to maintain dignity of the office. Patnaik conveyed
his mind when a Minister addressed "Sir" to an IAS officer
in his presence. "You are Cabinet Minister and should maintain
your dignity" the Chief Minister said. How far it is appropriate
or inappropriate for an elected representative to address a bureaucrat
as "Sir".

Indian Overseas Bank (IOB) is going to open eight new branches in three
states. This was disclosed by P K Garg, Chief Regional Manager of IOB
for MP region, who looks after Madhya Pradesh, Chhattisgarh & certain
parts of Maharashtra. Garg said these branches will be opened simultaneously
in the first week of January 2012. Of them four branches, Garg said,
will be opened in MP, three in Maharashtra & one in Baikunthpur

Sir is a matter of courtesy and culture
P K Sharma says in this column that he has never seen a senior officer
calling his junior 'sir'. Hasn't he seen a senior in the Hindi belt
calling his junior 'Saab'--which is the Hindi equivalent of 'sir'.Also
he hasn't seen the Tamil officialdom where senior and junior officials
address each other sir as a matter of routine courtesy.

Orissa Chief Minister Navin Patnaik's advisory to his Cabinet colleagues
to refrain from addressing the bureaucrats as "Sir", was unwarranted.
He owns a feudalistic and hierarchical mindset . Ego massage is an important
aspect of Communication skill.
If an elected representative addresses a bureaucrat as "Sir",
his job is completed quickly and without bribe.
Consider the flip side. The CBI officer asked A Raja, former DOT Minister
: "Sir, may I arrest you? I have the warrant". Raja did not
oblige by 'Sirring' and was soon arrested .
The lesson is : Do not dare bribe CBI. But, treat its officers with
respect. Let Navin Patnaik re-visit his advisory in this backdrop and
hope for the best !

Agitating with Anna & legislating with the Government?
The MPs have been repeating in & out of context the "supremacy"
of the parliament & its sole right to legislate. Can they stir their
"conscience" to examine honestly if this half-hearted, mechanical
exercise in drafting a proper and sturdy law against corruption for
a large democracy like India serves the objective? It is no use attacking
some people as laying claim to be the second Father of The Nation and
sparing the second Karl Marxs or sole repositories of all that is democratic
in the heads of those they venerate as the legal inheritors of the legacy.
No use shedding crocodile tears, indulging in diversionary debates only
to confuse the masses and feigning to be against corruption while in
practice promoting it actively. Any serious government can yield visible
results in less than one week in thrashing corruption even without this
piece of legislation. With what moral integrity can anyone raise a finger
against Mayawati Government or any other government, when historical
corruption has landed many in jail in spite of the best efforts of the
powerful and the saviour advocates of the corrupt? What meaningless
exercise is it to give constitutional status to the Lokpal and appoint
the best as its Chairman? MPs must do their constitutional duty and
do some service to the people. Those threatening Anna or his team are
inviting their own doom. Please don't indulge in the charade of agitating
with Anna for a clean government or against corruption and consider
such an ineffective piece of legislation, because the people understand
such show businesses very well and are sick of it. There are several
other such exercises the government indulges in for the sake of sheer
formality wasting crores of rupees and providing opportunities for all
kinds of representatives(elected/nominated/otherwise) to make hay while
the sun shines(or even when it does not shine!).

Certified copies of the photocopies
Background
The appellant sought certain attested documents and information regarding
the rule of the RTI Act, under which the attested copies of documents
should be given. The PIO denied the attested copies of documents claiming
that the Public Authority does not possess original documents. The Commission
directed the PIO to provide the relevant provision of law to the appellant
regarding attestation and to supply attested copies of the photocopies
of documents available in the records to the Appellant along with a
note on each page clarifying that the same are only copies of photocopies
and not copies of the original documents.
Comments
The RTI Act empowers the citizens of India to obtain certified copies
of the documents from the Government Organisations and the PIO should
not refuse to certify the documents even if the Public Authority does
not possess the original documents. In such cases, a note should be
given that they are only copies of photocopies and not copies of the
original documents. It should be remembered that certified copies of
the original may be used as an evidence in a court of law.
