Third law attack on regulators
The Government of India (GoI) under the UPA-II being led by Prime Minister
Dr. Man Mohan Singh is facing second attack on a regulator. First, was
against appointment of the then Chief Vigilance Commissioner (CVC) P
J Thomas. As a sequel to Public Interest Litigation (PIL) in the Supreme
Court, Thomas had to exit from CVC's post earlier. Second attack has
been made in the shape of another Public Interest Litigation (PIL) in
the Supreme Court whereby appointment of U K Sinha as Chairman of the
Securities and Exchange Board of India (SEBI) has been challenged. Third,
was a ruling by the Central Administrative Tribunal (CAT) whereby appointment
of Chief Statistician of India (CSI) was set aside.
Uniqueness in a family
Interesting family history of one of the lady officers in the batch.
The uniqueness lies in the family story of a graduating lady officer,
Ms Manusmriti, IPS, who represents the fourth generation of a family
serving police continuously since 1921. Uninterrupted police service
rendered by four generations of the same family. Manusmriti's father,
Kamlendra Prasad is an IPS officer of Uttar Pradesh cadre since 1981.
He is serving as Director of National Institute of Criminology and Forensic
Science, a training institute in Delhi. Her grandfather Arbind Prasad
had entered Bihar Police as a Sub-Inspector in 1952 and served up to
1988. At the police academy Manusmriti had been awarded trophy for topping
in Law examination held during the IPS training. She was earlier awarded
Director's gold medal at the National Academy of Administration, LBSNAA,
Mussoorie.

Pakistan : EC Secretary gets 2 years extension
in service
Pakistan's federal government has granted two years extension in service
to Ishtiaq Ahmed Khan, Secretary of the country's election commission.
There have been rumours of early elections in Pakistan but even if these
are held as per schedule in 2013, Ishtiaq Ahmed will continue as the
election commission's Secretary after the extension. According to government
sources the extension has been granted 'in the interest of continuity
on the recommendation of the CEC'.
ICFRE, IIFM Bhopal jointly hold forestry workshop
in Beijing
The sound professional background of India is gaining the attention
of the world on forestry. The Indian Council of Forestry Research and
Education, IIFM, Bhopal, jointly held a workshop on "Community
Forestry" as side event in Beijing on November 11, 2011, during
Asia Pacific Forestry week (7th to 12th Nov). The event was very well
attended by representatives of 20 countries including Ministry of Environment
and Forest officers. Dr VK Bahuguna, DG ICFRE gave the policy brief
on Joint ForestryManagement (JFM) and the recent thrust given by him
on undertaking livelihood research for the forest dwellers and Government
of India (GoI) policy. Dr R.B. Lal gave a brief presentation on the
work done by IIFM Bhopal. The balance approach of JFM was very well
received by the delegates as India's quest for balancing scientific
management with social issues. Representatives of other countries cautioned
on science loosing focus in community forestry. The Chinese Academy
of Forestry wanted ICFRE to lead the collaboration in Asian region on
forestry research and its Director specially met Dr V.K. Bahuguna DG,
ICFRE. A delegation of four officers from ICFRE was led by Dr.V.K. Bahuguna.
In all, a total 12 participants attended the Beijing meet from India
through sponsorship.

ITSA seeks intervention by Secretary, DoT
In the wake of repatriation of 1600 Indian Telecom Service (ITS) officers
who were selected by UPSC, the ITS Association (ITSA) has sought intervention
by the Secretary, Department of Telecom (DoT).The ITSA has urged the
Secretary DoT that officers may be allowed to report to the respective
territorial TERM Cell or CCA unit instead of TEC, Delhi. This will avoid
logistical nightmare for the concerned unit i.e. TEC, which will be
required to take care of hundreds of very senior level (HAG/SAG/JAG)
officers involved in this exercise. This will also save avoidable expenditure
of the Government around Rs. 20 crore in giving TA Advance cum Transfer
grant to the officers, once from their place of posting to New Delhi
and then again from New Delhi to their subsequent place of posting pointed
out ITSA.
Online ERS for CSS officers
The query module for the online ERS for CSS officers (based on IAS)
is to be out very soon. Few CSS officers have not submitted their proforma
for the same to US (CS-I). The DOPT has been again and again reminding
and sending out circulars to ministries and departments for the follow-up
of the same to implement the online ERS. The ERS would help to restructure
the CSS cadre and efficiently and effectively monitor the postings of
CSS officers likewise of IAS cadre.

quota agitations for Muslims, Christians, Dalits, OBCs, MBCs, BCs, EBCs.

Is govt serious to eradicate corruption ?
If government is really serious in eradicating corruption it should
call for information from officers about how many cases of corruption
have been suppressed/closed. Since ministries and departments will never
provide such information, therefore the best way is to allow staff to
provide this information and provided protection to anyone giving correct
information. But unfortunately whistleblowers are heavily penalised
in the present system. A thorough review of government instructions
on vigilance clearance needs to be carried out. Anyone having vigilance
case against him even if no charge sheet issued must not be promoted
because charge-sheets are being delayed deliberately. Such officers
get promotion, then charge-sheet is decided. They keep low profile for
5 years and then get next promotion. government needs to be tough against
such cases but it takes soft stand and always safeguards interest of
corrupt. This is reason why corrupt officers are provided free lawyer
in Lokpal but the whistleblower can be jailed. In such a scenario, corruption
can not be rooted out.

Manipur is a failed state
Manipur as on today is a failed state. Congress government at the center
& state have failed miserably on all fronts. Four months of economic
blockade by ethnic groups of Kukis/Nagas have left the peoples fuming.
Any agitation will be dealt under the Arm force special power act. Democracy
has been massacred. Nobody can raise a voice. In corruption, Manipur
is no 1.Even appointment of 4th grade staff, one has to shell out Rs.10/lacs
minimum. Center does not care as it has only 2MPs in Lok sabha. Armed
forces available in spite of using to clear the blockade are being used
against the innocent public. Peoples are regretting that state's merger
with India in 1949 for better has become nightmare. Government of India
is ready to help Lybia for its reconstruction but not willing to sort
out the problem in Manipur. Government does not want to extend construction
of National highway/Rail link to the valley of Manipur for the best
reason known to the Congress Government. How long to live as 2nd class
ctizen ? CM is center's chosen inefficient & corrupt representative.

In violation of rules !
From the number of the missing files of Telecom Department given in
print media, it is apparent that it was a part file. Through the specific
rules governing the opening of part files, my personal experience is
that certain ministries open part files in violation of rules on the
subject with fraudulent intent. However, there are specific rules to
the effect that if enquiry into a fraud is frustrated on account non
maintenance of record through negligence or violation of rules the officer
responsible therefore should face adverse consequences and should accordingly
be dealt with. It remains to be seen how far this rule for fixing responsibility
is followed in the instant case.

Why the tradition has been undone?
A long long back important countries like, UK, USA, then USSR etc.
etc. used to have Ambassdors/High commissioners from political field
who used to reflect in a better way the programmes of the Indian government
as they were directly from the ruling political party as they used to
have easy asses to political heads. Why and how this tradition has been
undone. Will some body in high ups may kindly throw some light on this

I do appreciate the opinions expressed by Zeenet Jahan and Alok Vidrohi,one
a journalist and one from the mass communication sector. But what put
me off is the opinion of AK Saxena, a seasoned bureaucrat. He has used
the forum to thrash the messenger instead of the message. While calling
Katju's remarks as gross misuse of freedom of speech, he has forgotten
the fundamentals that in a democracy, freedom of one ends when the freedom

of millions of silent uncommitted TV viewers all across this country.
Instead of being news presenters, some of them have become news makers,
thrusting their biased opinion on viewers. Some like Arnab Goswami have
become a law unto themselves intervening, calling names and throttling
desenting voices, in the process cornering to himself more than 50%
of the debate time lecturing to others usurping the role of the prosecutor
and the judge. To most of the English national channels, South India
does not exist. Second hand news are frequently presented as 'breaking
news'. The unabashed promotion of an untested, unprepared and unqualified
scion of the dynasty can only be compared with the shameless bashing
of one of the most efficient CMs in this country. It has also became
routine for the channels to present lawyers of defeated clients to give
marathon speeches even ridiculing the judiciary. What they lost in the
court of law, these lawyers are allowed to make up with the legally
ignorant public. Some lawyers use it for self promotion like in the
case of Kasab trial. The unbridled power they have, allow the channels
to misuse the broadcasting time. All these make Katju,s comments relevant.

Spotting the CBDT's mischief
Bazooka is right in spotting the CBDT's mischief in putting up on the
web a false vacancy position for CIT. The unsigned, unverified communication
having no letter number, file number, no diary number ,no date was put
on the web on 10-10-2011 showing no vacancy at Delhi at CIT level. Exactly
18 days hence on 28-10-2011 it posted 2 CIT to Delhi against existing
vacancies. No officer superannuated between Oct 10, 2011 and Oct 28,
2011. None died in this period also. No posts were created in this period.
So the question is, some one in the CBDT was lying about the vacancy
position and bent on misleading the public and the officials. Is this
the level CBDT has come down to ? The more frightening thing is whether
the CBDT has started believing the untruths as truths, fictions as facts
, oppression as rule of law ,and it's battalion of sycophants and hangerson
as it's true man force ( sorry about the pun, wholly unintended )

Detrimental to the health of both the telecom PSU's
This entire development is very detrimental to the health of both the
telecom PSU's BSNL as well as MTNL. Only the private Telecom operators
are bound to gain something out of this. The existence of BSNL/MTNL
is essential to take care of the vital security concerns of the country.
A properly negotiated settlement with ITS officers is the need of the
day to save BSNL/MTNL. ITS officers are a very specialized cadre in
Telecom and have been instrumental in the rapid growth in the telecom
sector in India.

Check the facts first
Before unfairly commenting upon number of officers of 1978 batch empanelled
as Secretary from this cadre or that cadre, Rana should have first checked
the facts. The empanelment takes place on certain guidelines, and not
on arbitrary considerations. There were 4 officers in Kerala Cadre,
out of which 2 resigned much earlier, only 1 of the balance 02 has worked
in GOI, and is presently posted in Kerala. He has been empanelled as
Secretary equivalent as he retires in less than a year. So, what is
the problem?
UP had a big batch of 24 initially, out of which 12 came to GOI and
therefore, 10 out of them got empanelled. Please don't imagine things
and try to unnecessarily create North-South wedge!

Grouse Kiran Bedi has against the govt
Everyone knows the grouse Kiran Bedi has against the government because
she was not made the CP of Delhi. She assumed that she was the only
capable police officer in Delhi. It is also in public knowledge how
she misused the provisions to secure admission for her daughter for
the MBBS course while she was posted in the NE. If one points fingers
at the corruption of others one must be 100 per cent neat. She has been
fully exposed with the single incident of her misuse of the gallantry
award for monetary gains and no excuse or explanation will absolve her
from her unbecoming action. In fact she has devalued the award and converted
into an avenue for making profit. She has in fact disgraced the award.

Scam after Scams exposed
Thanks to the news-hungry media and some valiant leaders who are hell-bent
to bring the culprits to book. But, what happened in Bofors case and
again our poor voters. The opposition party might win the next elections,
but the ruling part would do everything to destabilise that government
and would be re-elected to power. Only God can save this country. We
need real Bhagat Sings today. Annagiri shall have no takers, because
the rulers are insensitive to criticisms and are thick-skinned too.

Get BSNL/MTNL rid of black British men for performance
No need to worry about the condition and services of BSNL/MTNL if ITS
are relieved since the actual and the practical work are being done
by absorbed junior officers/officials. Performance may improve if BSNL/MTNL
are rid of these black British men.

Decision makers responsible for systematic rot of Govt machinery
It is the decision makers (read civil servants) who are responsible
for the systematic rot of Government machinery; the Sarkari Tantra.
It has now been damaged to irreparable limits. And they are not bothered
because they remain Government VIPs till their deaths through redeployments
as honourables. Abnormal situation ahs abnormal solutions. Just full
stop to any and evry kind of redeployment of retiring Civil Servants
either honorary or paid. And see the sea change within 10 years in Government
Tantra - the system!

Free travel by police
The Applicant wanted to confirm whether a wireless message i.e. WTM
dt. 15/16.09.1997 was issued by the then Chief Minister of Delhi allowing
Delhi Police personnel to travel for free in Delhi Transport Corporation
(DTC) buses in contravention of the decision of the cabinet No. 259
dt. 28.06.1997. It was intimated to the Applicant that the records relating
to the issue of WTM dated 15.09.1997 are not available with the office
of the public authority. The Appellant claimed that the Delhi Police
personnel are still travelling free of charge on DTC buses resulting
in loss of revenue amounting to over Rs. 60 crores annually. In view
of the above unsettled dispute between the Delhi Police and the DTC,
the CIC recommended that the Principal Secretary, Transport Department,
Government of NCT of Delhi settle this dispute between the two organizations
decisively through an order or notification by December end. The CIC
also directed the PIO to file an affidavit before the Commission - with
a copy to the Appellant - affirming that the public authority has no
document authorizing the Delhi Police Personnel to travel free on DTC
buses.
Comments
The above case indicates how RTI Act can be used not only to obtain
information but also get directions issued for some action by the public
