20 HC judges superseded in being recommended for appointment to apex court
As many as 20 High Court judges have been superseded in being recommended for appointment to the apex court despite their seniority. The Law Ministry has, in its response to an RTI query, indicated that since 2005 at least 20 Supreme Court judges were superseded by the collegium comprising five senior most judges of Supreme Court. Some judges were superseded not once but as many as seven times. For instance, Justice HL Gokhale was superseded seven times in three years when he was Chief Justice of Allahabad High Court. He was elevated to apex court in April 2010 when he was Madras Chief Justice.

ITI to be merged with BSNL and MTNL
ITI may soon be merged with BSNL and MTNL if the Board for Reconstruction of Public Sector Enterprises (BRPSE) has its way. In a note to the government, the BRPSE has said, "The Board strongly recommends the merger of ITI Ltd with BSNL or its takeover by BSNL as a separate subsidiary, thereby ensuring strategic vertical integration. This should enable BSNL to combine service-providing with manufacture." The proposal has come at a time when all three companies are facing fierce competition from private telecom operators and causing huge losses to the exchequer.

Addressing a group of civil servants undergoing training at the National school of Public Policy Lahore Pakistan's Chief Justice Iftekhar Mohammad Chowdhary advised them not to follow illegal orders of their superiors. 'Permanent principle of bureaucracy is to maintain mutual respect and follow orders of superiors but this doesn't imply obedience of illegal or unlawful orders', Justice Chowdhary said. Elaborating his views he added, 'even if the political executive has no costs for forming illegal policies the civil Servant's choice must be for legal options mainly for the reason that their time horizon is different from the political executive and the possibility that the government voted in future may be different and have no interest in protecting them for any illegality committed earlier.'

SSP to change landscape of Kutch in Gujarat (UPDATED)
The landscape of the water starved regions of the Kutch in Gujarat would undergo a sea change with the completion of the Sardar Sarovar Project (SSP) on Narmada river. As it is, the eagerness of the Gujarat government to build canals and complete the SSP reservoir has led to increased irrigation in the otherwise dry region and is ushering a silent green revolution. Gujarat Chief Minister Narendra Modi has urged the Prime Minister to fund 90 per cent of the cost the Narmada Command Desert Development Programme under Accelerated Irrigation Benefit Programme (AIBP). Modi was speaking after laying foundation stones for five projects for the 360-km long Narmada branch canal network for Kutch.

Maharasthra's Agriculture Minister Radhakrishna Vikhe Patil had declared that the government would suspend about 500 officials of the agriculture department from the suicide prone Vidharbha region for corruption and for their inability to implement the schemes meant to tackle the agrarian crisis. Denying the charges all 500 odd officials have decided to go on a hunger strike . Looks like Anna effect at grass roots might not root out corruption but it can certainly be a bargaining and threatening ploy !

Anna's Triupmh!

People have Won! Finally, light is seen at the end of the tunnel! Godwilling, we'd soon have the Real Lokpal in Place to take on corruption in public life. Only some time back, Maharashtra's CM had voluntarily given up his discritionary quota. Other CMs, ofcourse, failed to give up the lucre! It's time that Anna directed his crusade against such corrupt practices. Then there are mushrooming MPLAD funds which cost the national in excess of Rs. 5000 crores/ year. It's any body's guess how much of this (in)discretionary splurge gets diverted towards funding elections besides providing seed money for the Elected Representatives' own enterprises. Similar funds have mushroomed in States. Don't they give undue advantage to the sitting politician against aspirants?

And what these indiscretionary funds doing in a planned economy?

The time has come for the people to raise their voice against such splurges.

Till that happens, it would be worthwhile to display all details of such funds on the web with all the minutest details.

Lokpal with administrative reforms required

Anna's movement may finally help us to get a Lokpal who may probably be also given some effective power unlike the Lokayukta in most states who are just dummy bodies with no substantial work or powers. However while it would be good to have a Lokpal but ultimately the governance shall improve only if we also carry out the long pending administrative reforms. Government should also revisit the constitutional protection given to civil servants to wake them up from their slumber. Today most of us know that certain positions shall be ours after putting in an x amount of years of service and by ensuring that powers that be are kept on right side. Professional excellence or ethics have no meaning under the current system. only two types of bureaucrats are successful in current era (a) who are corrupt and collude with the system and (b) those who look the other way when encountering any wrongdoing so that powers are not annoyed. Making adjustments have become a way of life in bureaucracy and the one's who have failed to so have also failed in the system.

Several aspects not taken care of in Jan Lokpal bill

In the present movement of Anna Hazare, everybody is supporting his cause which is also a cause for the country. However at least in one respect I would like to support the government. After reading the Jan Lokpal bill(JLB) I found that there are several aspects which have not been taken care of.

For example section 9 of JLB has been taken verbatim from section 132 of Income tax Act 1961 which relates to raids in case of tax offenders. In JLB in corruption cases raids will be conducted by a police officer. Now plight and (in)efficiency of police officers is well known to all. The prosecution rate police departments of all states is very low and in financial matters it is abysmally low. This is due to the reason police officer has no knowledge on financial aspects. There fore there should be suitable changes in operational sections of JLB to provide that raids will be conducted by an officer of IT department or police department depending upon the nature of corruption of the particular suspect.

Unlike political rallies/meeting, this movement against corruption is spontaneous and people from all hue and cry joined from their own resources even the films stars came in support wholeheartedly otherwise they people usually take money for opening restaurants/shops etc. Since these political people from their heart knew how they manage people by giving them money, alcohol, transportation, food etc. for their rallies, meeting etc. got afraid off and relegated. But they are thick skin and we should continue to keep momentum of the movement. Dr. Man Mahon Singh has sullied their community as they are born fighters but his conduct is wanting in every aspect.

Is Anna really so bad as portrayed in WIC's Aaj ki Awaaz (9th April)? This portrayal is out of sync with the reality. It looks as though Dr Suresh Mehrotra, the WIC Editor-in-chief, is almost on his way to join the Congress party. The Media, it seems, is getting sold out slowly and steadily. Barkha Dutt and Vir Singhvi were not cautious enough like others who are reportedly more infamous in cultivating the power that be. Rajdeep is supposedly close to the government of the day. Arnab Goswami has lost his teeth and the sting to boot. He has suddenly mellowed so much as though he got a dressing down from 10-Janpath. His show- down with Mani Shankar Aiyer during a live debate on 'Times Now', left the former visibly shaken. How could the media be bulldozed like this? What happens to 'Right to Life' and flowing from it the 'freedom of speech and expression'?

Fast By Anna Hazare: A Shame on Nation

Mother India is carrying the burden of many shameless personnel and of our many shameless Actions. We have a big list of Ghotalas - Hasan Ali, 2G, Commonwealth, Aadarsh, Public Distribution System, Chara, Bofors, Telgi ...........................and list of Ghotalebazs include so many politicians, public servants, businessmen ......................and latest addition to our shameless Acts is "Fast by Anna Haazare" - a 73 years old Gandhian. Will any of sensible human being ever permit his or her father or grand father to go on hunger strike. This is the age when Seniors need most care, attention and proper food, but at this ripe age one Senior has to sit on hunger strike, for the sake of coming generations, due to our shameless and irresponsible acts. How can we get rest, get sleep and food is going down?

Gandhi fought with British for Independence and now this modern Gandhi is also fighting war for an independence where only difference is that the British has been replaced by our very own Corruption. What an Irony!

Let's wake up, unite and march together against corruption for a better, educated, liveable, prosperous, strong, displined and Corruption free India.

Extend and Convey your support to Anna Hazare, in any form (physical, emotional, mail, sms, dharna, pradarshan, phone, mouth-to-ear, discussion, debate etc. or as you like it) please convey & propogate the issue as much you can. The funds of NGOs are grants from government or tax free income, so there is a large element of people's money in it.

Similarly, business income that remains untaxed has a 30% component of income tax which is also people's money.

So why be hesitant to include NGO's, Trusts and Business companies, in the scope of Lok Pal and RTI laws.

CS and IAS have power and have to share responsibility

The Cabinet Secretary is for the entire government, however it turns out that he is just another IAS officer protecting their turf. As the head of the bureaucracy he advises the cabinet on all appointments and matters. He cannot hide behind the political masters on the 2G scam and on the appointment of the CVC and all the flawed appointments of Secretary level officials by completely bypassing all the specialist services. Did the Cabinet Secretary advise the government against the appointment of a CVC who had a pending charge sheet? Did he advise the Cabinet against signing off on a flawed 2G allocation.

People are frantically searching for some crucial files which are reported to have been misplaced or lost. There is a scam. Thanks for exposing the tip of the iceberg.

Application fee in the name of Accounts Officer
The RTI application was returned by the CPIO citing the reason that the application fee of Rs. 10/- was not in favour of "Pay & Accounts Officer" of the Ministry. The Complainant stated that the IPO was in favour of "Accounts Officer" as per the DoPT circular F.10/9/2008-IR, dated 05/12/2008 and 02/09/2009. The CIC noted that the CPIO, in his reply, had not indicated the name and address of the First Appellate Authority before whom the first appeal could be filed by the complainant. While directing the CPIO to clarify the reasons for the same, the CIC also issued a show cause notice for imposition of penalty for not providing the information within the stipulated time frame.

Comments
Lack of awareness of the RTI Act makes the CPIO commit these kinds of follies. The CPIO should invariably indicate to the complainant the name and address of the First Appellate Authority, before whom an appeal can be filed. All payments in the name of the 'Accounts Officer' should be accepted.
