At a time when families are breaking down and old parents are left to suffer without care, this will be the last nail.There seems absolutely no logic in this policy which apparently is designed to make the officer gain work experience in different place. Here too the nature of postal operations is similar and one doe snot gain anything by working in different places. Even if this the logic, why not confine the ceiling of 12 years to one state rather than neighbouring states grouped together?Why include the deputation outside the Department in this 12 year ceiling? Other than putting the officer to difficulties in what way it is going to serve the service? If this is implemented, it is going to make havoc as it will involve large scale transfers
immediately and put everyone to inconvenience. Department needs to look into this urgently.It was reportedly finalised without any consultations.

DoPT should issue Guidelines on Communication of Downgraded ACRs

The officers who had been graded below the Bench Mark without assigning any logic and reason should be protected. The Supreme Court of India in Dev Dutt' case held that overall grading should be communicated but within a "reasonable time". After the Judgment of Dev Dutt, the DoPT vide OM dated 14.5.2009 has issued instructions to communicate the overall grading after the Report is complete with the remarks of the Reviewing officer and the Accepting Authority. Thus the communication is to be done within 6-8 months. The DoPT order is effective from 2009-10 onwards. But what about the cases which are old by 10-15 years. In such cases there is no meaning of communication after such a long time. It willl not serve the basic objective of communication. The basic aim of communication of adverse and downgraded ACRs is give opportunity to the officer to represent and most important to provide opportunity to improve the performance in future. That is the reason Hon'ble Supreme Court of India after the case of Dev Dutt, in the cases of Abhijit Ghosh Dastidar, R.K.Anand, J.S.Garg and Ranjana Kale ordered for promotion ignoring the downgraded ACRs. There was no communication of ACRs which were below the Bench Mark. DoPT should issue guidelines accordingly.

The Economic Times conducted a Poll on: "Is the Performance Appraisal System in your Organisation Fair?" The outcome of the Poll was- (i) Yes-22%, (ii) No-73% and (iii) can't say-5%. This is true to a great extent in respect of all government departments. The targets or parameters for ACR are never fixed in the beginning of the financial year or the ACR period. So writing ACR becomes very subjective, where face value and other factors matters a lot. In most of the cases, it is seen that the Reporting officers award grading below the bench-mark where their subordinates come on their way or their interests are clashed. In most of the promotions, the bench-mark is Very-Good, so such Reporting officers normally give Good grading because 'Good' is a positive entry and was not communicated till Dev Dutt's case. But it badly affected the promotion of the concerned officers. The ACRs are the assets of the employee and are linked with the promotional and the extensional stage of his service career. So one should not play with anybody's career. Here it is also required that the Civil Servants should be given proper role playing field and they should be made more responsible and more accountable by providing proper delegation of administrative and financial powers, giving additional responsibilities, reviewing their performance by calling weekly or fortnightly meetings. This would be the great service in the interest of the country.

Evolve better system to check corruption

Through this site I would like to mention that recently GoI have issued a circular binding IAS Officers to submit their Property Statements on 31st of January but i would like to mention that officers who use unfair means to build their empires normally purchase property or other assets in the name of their spouses and near relations and even benami also. A better system needs to be evolved to check that type of investments and contain the menace of corruption. I would rather like to mention that GOI should ensure placing the first and current copy of property statement of the officer on it's website so that the assets made during the period is generally known to the public and public can come forward with the evidences ,if some officer makes property and other assets disproportionate to their known source of income. It will give more transparency and open the assets and living style of the IAS officers to the general public for scrutiny.

Increasing retirement age has not helped on earlier instances nor ever will. I think, it was a mistake to enhance the retirement age form 58 to 60. These issues are raised by person for their vested interest. It should again be reversed to 58 years.

In India the corruption has taken deep roots because our fabric of democracy was allowed to be deliberately get weakened. Present rampant corruption calls for hard measures and Anna deserves full credit in highlighting it. The civil society has done a fabulous job in overwhelmingly supporting it .Cleansing of our stables is going to be difficult because power is with those who have tasted the scent of corruption and ingenious ways have been evolved to twist and turn the issues through ethical and non ethical means. Anna needs huge support from every sensible citizen of this country. Let us join him in this Cleansing Mahayagna.

Unconstitutional Government

The Election Commission of India has seized more than 65 crores of rupees in cash, gold, silver, gadgets and clothes in the states that went in for general elections this month. That explains why gold and silver have touched the peak in prices in more than 30 years. It seems gold and silver coins are being traded freely. What choice has the voter? One of the two or three are the only choices before them. It is not corruption, but unconstitutional government. The elected government simply looks the other way as each single government service delivered to the voter comes with a price. It is well organized business of the unconstitutional government, with exact data on investments & return and the rate of return. The payback period is not full 5 years but lesser. All data is maintained in digital form. It is time any government laying claim to honesty orders a special income tax scrutiny of all politicians worth more than 1 crore rupees. Had they all paid their taxes honestly, our tax burden could have come down drastically. Until then, anybody raising even the feeblest voice against unconstitutional activities would be a marked person, who will be delivered the deadliest blows by the unconstitutional government(I am sick of the word corruption being talked about for more than 63 years!).I would prefer to call it unconstitutional government v/s the constitutional government. Since the constitutional government fails to deliver, compelling people to seek the unconstitutional government, there is loud outcry against corruption by the people, who number more than 121 crores!

Concern not well founded

I see that few people are saying that NGOs, private sector etc. should also be included in the Jan Lokpal Bill. I appreciate the concern but it is not well founded.

My dear friend, if politicians and bureaucrats are not able to make money do you think they will allow others to make money. It is the weakness of them that others also indulge in fraudulent practices. Let Lokpal Bill pass, which i still doubt because of some planted divisive forces, rest will be taken care of. An honest king always have honest people. Keep it simple stupid.

Congress spokes persons do harm to party

Congress should understand that the moment Manish Tiwari or Kapil Sibal open their mouth, Congress is bound to lose lakhs of votes. The difference between these insufferable spokes persons is that Tiwari does it with a straight face and Sibal does it with an arrogant smile.

Rather they should write their memoirs or engage in some useful social work.The best way would be to adopt some village and teach the poor students.

Accomplishments of NRAA

A visit to the site of NRAA [NRAA.nic.in] shows that the accomplishments of NRAA are silent about the dates / years of achievements since inception of NRAA; Governing board of NRAA is also to be reconstituted after its transfer to Planning Commission & thus updated; recent workshop / seminar on Rights of Foresters under the control of Technical Expert (Forestry) was organised beyond mandate of NRAA just to gain access to MOS(MOEF)/DG(Forests) & thus a waste of money since this matter falls under the mandate of MOEF. Dy. Chairman Planning Commission & Finance Minister may review this workshop / seminar held on 30.3.2011 at NASC complex for future releases of funds which are used to gain personal favours by Technical Expert (Forestry) than in national interest and as per mandate of NRAA.

Application fee in the name of Accounts Officer
The RTI application was returned by the CPIO citing the reason that the application fee of Rs. 10/- was not in favour of "Pay & Accounts Officer" of the Ministry. The Complainant stated that the IPO was in favour of "Accounts Officer" as per the DoPT circular F.10/9/2008-IR, dated 05/12/2008 and 02/09/2009. The CIC noted that the CPIO, in his reply, had not indicated the name and address of the First Appellate Authority before whom the first appeal could be filed by the complainant. While directing the CPIO to clarify the reasons for the same, the CIC also issued a show cause notice for imposition of penalty for not providing the information within the stipulated time frame.

Comments
Lack of awareness of the RTI Act makes the CPIO commit these kinds of follies. The CPIO should invariably indicate to the complainant the name and address of the First Appellate Authority, before whom an appeal can be filed. All payments in the name of the 'Accounts Officer' should be accepted.
