Pakistan : FIA senior Director closing in on PM's secretariat transferred
Hussain Ashgar, Senior Director in Pakistan's Federal Investigating Agency (FIA), has been transferred as IG Gilgit Baltistan. The transfer orders came rather abruptly as the officer started closing in on the PM's secretariat during investigation in the Haj scam. He had issued notice to Prime Minister Yusuf Raza Gilani's son Qadir Gilani to join in investigations as there were strong reasons to suspect that Qadir had taken a luxurious bullet proof land cruiser jeep imported from Dubai as bribe in lieu of helping one Rao Shakeel to be appointed as DG Haj under whose stewardship the scam took place. Mr Zain Sukhera a family friend of the PM who was appointed as an officer in the PM's secretariat was also under the FIA officer's scanner. Lamenting the sudden and abrupt transfer of their Senior Director the team of investigators claimed, 'we were going to unmask more faces involved in the scam'.

Anna has done is really remarkable

It is well known that majority of politicians and senior bureaucrats are making a lot of money. I think the follow up to Jan Lokpal Bill should be Administrative reform which is blocked by IAS lobby. All the money making and high profile posts have been cornered by them ignoring suitability and eligibility. Expose to CVC appointment should be an eye opener.

Is it not surprising that any Tom, Dick And Harry IAS officer is suitable for any technical and professional post despite being generalist and not a single professional is suitable for the post if it is of high profile in nature. What a sad story where merit has no meaning. DOPT must be cleaned first and must be manned by professionals not bureaucrats.

Indian politicians and bureaucrats should take a lesson from USA in atleast one thing..the supremacy of RULE OF LAW. It spares no one..be it Nixon, Clinton or Chiefs of Army.. That has been critical to ensuring that politicians and bureaucrats remain relatively honest. The fight against corruption in India needs a similar approach. JLP will need to be as comprehensive as possible. No one denies that corruption exists and it needs to be fought on all fronts. Let us begin by fighting from top.

Delhi High Court disposed off 30 Service matters by single order

Delhi High Court disposed off 30 Service matters, which were pending since 2002, by single order on 21.12.2010 on the ground that Counsel for the parties fairly stated that the controversy is covered by the decision rendered in WP(C) No. 6013/2010 Union of India Vs. Krishna Mohan Dixit and other connected matters decided on 8th October, 2010. By this order, Court held that downgraded ACRs should be communicated within 4 weeks to the concerned officer and he/ she shall submit reply within 2 weeks. The said matters covered downgraded ACRs for the period of 15 to 20 years. So Delhi High Court order needs to be reviewed in the light of Supreme Court in Dev Dutt vs Union of India (2008) 8 SCC 725 has categorically held that every entry in the ACR must be communicated to the public servant within "a reasonable period". It is submitted that the expression "reasonable period" has got its own importance. After the Judgment of Dev Dutt, the DoPT vide OM dated 14.5.2009 has issued instructions to communicate the overall grading after the Report is complete with the remarks of the Reviewing officer and the Accepting Authority. Thus the communication is to be done within 8 months. So communication after 15-20 years shall not serve the basic objective of communication i.e. opportunity for improvement in performance. Most importantly, the Judgment is not in order as it is not in line with the Hon'ble Supreme Court's three Judges bench order in the matter of Abhijit Ghosh Dastidar vs Union of India (2009) 16 SCC 146. Moreover, the above said 30 matters were not disposed off in the light of J.S.Garg case, with which the Writ Petitions were connected and made 'Sine die' in 2007 till the outcome of Civil Appeal No. 5319 of 2003 filed by Union of India against the Full Bench Judgment dated 16.8.2002 of Delhi High Court in the case of J.S. Garg (CWP No.350/2001 Union of India vs J.S. Garg). The Supreme Court' dismissed this appeal on 24.11.2009 relying on the judgment of Abhijit Ghosh Dastidar Vs. Union of India and held that Review DPC should be conducted after ignoring downgraded ACRs. The Supreme Court also disposed off R.K.Anand and Ranjana Kale cases in the light of Abhijit Ghosh Dastdar case and ordered for promotion after ignoring the downgraded ACRs.

Impact of WIC

Lot of thanks to sureshmehrotra.com for exposing various irregularities going on in NSSO (FOD) a subordinate office of Ministry of Statistics & Programme Implementation, specifically unconstitutional appointment of more than 250 consultants in all over India for routine work. These kinds of appointments would definitely damage the national identity and reliability of NSSO (FOD). In an establishment, such kind of scandal is not possible without involvement of higher decision making officers directly or indirectly of Ministry.

The NSSO is known worldwide for collection of quality and accurate data for future policy formulation of the country by using highly technical persons available in the hierarchy and following the existing guidelines of DOP&T & Ministry of Finance.

The promotion prospect is not at all satisfactory for NSSO (FOD) officials. Again the appointment of consultants is nothing but pinching of salt in a wound. The Government is incurring unnecessary expenditure because ASOs who have already received higher grade pay and waiting for promotion should be promoted and be given the work of the consultant. Here not a single paisa will be spend not to say about Rs. 12000/- as the so called consultants are receiving today from NSSO (FOD). Appointments of consultants are destroying office decorum in day to day function in various manners. The matter should be enquired and culprits be punished.

Behaviour of Metro Officials

The behaviour of officials representing various governmental bodies is well known - discourteous, impatient and unfriendly - be in railways, airports, bus services, hospitals etc. The atrocious behavior of Metro officials at Karkardooma Station is not any different, for they have also the same polluted blood running into them. But what shocked all of us was that it happened at a time when Sreedharan is at the helm of the Delhi Metro. We expected the present CEO to ensure training to Metro officials at short intervals and not just once (as is the practice in other public dealing offices - one training for whole service career), so that they are updated with the traits to handle the public. Anyways whatever happened was very bad but worse is the Metro Management taking the issue lightly. Just suspending the two of the four officials involved; no action against CISF officials; no FIR; enquiries will follow etc. etc., same as is heard in any other public dealing organization. I hope, CEO of Delhi Metro would again remind his officials that Delhi Metro Corporation is not like any other public service office, it is certainly different. At least that is what the common people believe in. To regain the public trust, Delhi Metro should ensure that these guilty officials are brought to book and charged for 'murder' or 'causing grievous hurt' without further delay. Any injury that forces the patient to be kept in 'ICU' for more than 12 hours should be treated 'grievous' and those who cause such injury must be charged for 'murder'.

The blatant cash for votes reports from Tamil Nadu and EC's confiscation of crores of unaccounted cash there raises more questions than answers. Is the job of the EC restricted to confiscating illegal cash used for getting votes and announce it to the public or is it not their duty to follow up and derecognize political parties indulging in such corrupt practices? Does EC has no answer to the freebee culture other than shouting about it in the media.What ever it may be it is a sad day for our democracy that our EC has been reduced to the level of a scare crow.

Don't raise retirement age

Instead check correct date of birth of officers working, either by verifying certificates issued by Municipalities or Panchayats. The employees who do not have birth certificates should be asked to undergo medical examination to verify age as most of the Govt. employees have shown less age.

Pay high salaries to check corruption

The way to reduce corruption is to pay high salaries to the Ministers. Let Cabinet ministers at the centre be paid Rs. 5 crore every year tax free and let Ministers of State at the centre be paid Rs 4 crore every year tax free. Let Chief Ministers be paid Rs 3.5 crore every year tax free and Cabinet ministers in state governments be paid Rs 3 crore every year tax free. Do not give them any perks except telephones and airline/ train travel. After that, nail every corrupt politician.

Application fee in the name of Accounts Officer
The RTI application was returned by the CPIO citing the reason that the application fee of Rs. 10/- was not in favour of "Pay & Accounts Officer" of the Ministry. The Complainant stated that the IPO was in favour of "Accounts Officer" as per the DoPT circular F.10/9/2008-IR, dated 05/12/2008 and 02/09/2009. The CIC noted that the CPIO, in his reply, had not indicated the name and address of the First Appellate Authority before whom the first appeal could be filed by the complainant. While directing the CPIO to clarify the reasons for the same, the CIC also issued a show cause notice for imposition of penalty for not providing the information within the stipulated time frame.

Comments
Lack of awareness of the RTI Act makes the CPIO commit these kinds of follies. The CPIO should invariably indicate to the complainant the name and address of the First Appellate Authority, before whom an appeal can be filed. All payments in the name of the 'Accounts Officer' should be accepted.
