Pakistan : Senior Army Postings
Pakistan army has witnessed its first major reshuffle at senior levels after extension in tenure of Army chief Genl Keyani. Maj Genl Ashfaq Nadeem is the new DGMO as the present incumbent Javed Iqbal has been promoted to the rank of Lt Genl and posted as Adjutant General at the GHQ. He will assume charge on 29 April when the present AG Lt Genl Nadeem Taj retires on superannuation. Lt Genl Sardar Mehmood Ali presently DG joint staff has been appointed as Dy Chairperson Earthquake reconstruction and Rehabilitation Authority (ERRA). He replaces Lt Genl Haroon Aslam appointed as Corps Commander Bahawalpur. The new DG Joint Staff is newly promoted Lt Genl Mohammad Asif who till now was the GOC Sialkot area. Two more officers Ahsan Mahmood and Abid Parvez have been promoted to the rank of Lt Genls and posted as Engineer-in-chief and DG logistics respectively.

Are we headed for Dictatorship of Activistocracy?

Section 12 of Hazare's draft Bill states -

- Lokpal to be deemed police officer

(1) For the purposes of section 36 of Criminal Procedure Code, the Chairperson, members of Lokpal and the officers in investigation wing of Lokpal shall be deemed to be police officers.

(2) While investigating any offence under Prevention of Corruption Act 1988, they shall be competent to investigate any offence under any other law in the same case.

Section 10.2 of their draft Bill says - We are also deemed judiciary

(2) For the purpose of any such investigation (including the preliminary inquiry) the Lokpal shall have all the powers of a civil court while trying a suit under the Code of Civil Procedure, 1908, in respect of the following matters, namely:-

(a) Summoning and enforcing the attendance of any person and examining him on oath;

(b) Requiring the discovery and production of any document;

(c) Receiving evidence on affidavits;

(3) Any proceeding before the Lokpal shall be deemed to be a judicial proceeding within the meaning of section 193 of the Indian Penal Code

Lokpal, after getting such enquiries and investigations done as it deems fit, may take one or more of the following actions:

a. Close the case if prima facie, the complaint is not made out or

b. Initiate prosecution against public servants as well as those private entities which are party to the act

c. Order imposition of appropriate penalties under CCS Conduct Rules Provided that if an officer is finally convicted under Prevention of Corruption Act, major penalty of dismissal shall be imposed on such government servant.

d. Order cancellation or modification of a license or lease or permission or contract or agreement, which was the subject matter of investigation.

e. Blacklist the concerned firm or company or contractor or any other entity involved in that act of corruption.

Civil group's version of the Lokpal Bill, arrogates to themselves unbridled powers of parliament, police, CBI, CAG, judge, jury and executioner all rolled into one as shown above and essentially renders the Indian Parliament, the highest democratic institution of the country with powers to impeach judges and even the President of India, totally redundant and selling gullible idiots in the nation the lemon that what the nation's investigating agencies, police, parliament and judiciary have failed to do, Lokpal can and will do - impeach judges and Presidents for dessert even as they punish politicians and bureaucrats for breakfast, lunch and dinner. Such was the media-instigated hysteria over the fasting Gandhi cap that the nation collectively put its brain to sleep. Subjecting the components that will go to make the Lokpal to intense scrutiny is in order. The core components of the Lokpal are -

- Who are the people constituting Anna Hazare's drafting committee which will draft the Lokpal Bill

- The law itself (assuming the Bill is passed by a frightened and cowering parliament) and its provisions

- Members of Lokpal who will enforce and implement the law

- The selection panel which will appoint the all-important members of the Lokpal

The melodrama has already turned to farce with Kejriwal, Kiran Bedi and Co. bickering fiercely over who should form part of the drafting committee and who should become members of the supra-god selection panel which will select members who will constitute the Lokpal. We have already seen the relevant sections of Hazare's draft Bill which confers upon some of our foreign-funded activists who aspire to become Lokpal Members, the high status of deemed police and deemed judiciary. Now the norms for constituting the selection panel which will appoint the members is even more of a give-away of what really is the real intention behind this melodrama to pass the Lokpal Bill. Hazare, Kejriwal, Agnivesh and co. have listed -

- The Chairpersons of both Houses of Parliament

- Two senior most judges of Supreme Court

- Two senior most Chief Justices of High Courts

- All Nobel Laureates of Indian Origin

- Chairperson of National Human Rights Commission

- Last two Magsaysay Award winners of Indian origin

- Comptroller and Auditor General of India

- Chief Election Commissioner

- Bharat Ratna Award winners

Considering the sweeping powers that Hazare, Agnivesh, Kejriwal, etc want for the Lokpal, and considering that the Lokpal wants to be judge, jury, police and parliament in their dealings with politicians, bureaucrats and judges, to insist on foreign entities having a say in constituting the Selection Panel must cause grave disquiet in every thinking nationalist mind. Amartya Sen is married to Emma Rothschild who is a member of the Rothschild banking family in England, while the Magsaysay Award has a direct Rockefeller connection.

The Magsaysay award may sound Asian because it is named after the late Ramon Magsaysay of the Philippines, but the award is all American and the money component of the award is funded by the Rockefeller Foundation. The Vigil book on NGOs exposed the intent behind the selection of persons for the Magsaysay award. Like the Nobel peace Prize, the Magsaysay too, no matter for what reason and in which category it is awarded, is political in its ultimate intent. To have a Rothschild and Rockefeller connection to the Lokpal no matter how distant and how remote, is still nothing to laugh about. AND lastly who are the last 2 winners of the Magsaysay Award, Kejriwal, P Sainath, Deep Joshi and Prakash Amte and Mandakini Amte. What background the last 4 have in any of the issues raised by Vocal minority activists is a mystery?

I am personally witness to the kind of lobbying that is done by these 'voluntary retired' bureaucrats. Some of the organisations like IL&FS are in any case legitimate parking grounds for the bureaucrats and their wards. Nowhere else in the world one would see such an open misuse of authority by executive as you see in India.

Government at its wicked games !

So they have started their nefarious designs to thwart and demolish the gains made by Civil society led by Anna Hazare. Doctored CDs, leaked misinformation, false propaganda, chracter assasination, lies etc. The Government has enough in its armoury to finish a revolution before it takes off. Our media which played such a marvellous role in the growth and momentum of war against Corruption can easily be bought to reverse the same. Government is at its games and in this power play it is to be seen whether Anna Hazare and his team mates will continue to bat with the same ferocity. Let us see in this war of powers that be and the society at large who wins this battle.

Several questions to be answered

I have been following things on this Anna Hazare. He is no doubt an honest man but his IQ, knowledge of administration, social studies etc is very poor. It is equivalent to any other sepoy in the army who would have failed in metric. It appears ridiculous for the entire representative form of government with accountability and checks and balances have to go under Lokpal. Can we rest the country under the hands of few like Hazare and Bhushans. Who are they to speak about what country has to do? Already through the form of election, the people have mandated some party x, y or Z to look after the helm of Affairs. Now it is upto them to do what they want. If things are wrongly done they go to jail, loose the elections and so on. Few hundred people sitting in Jantar Mantar and few social butterflies converging on one issue, members of electronic boxes, serious newspaper readers etc is not even 1 % of the population of country. So if these people shout around with the connivance of media, should we hand over the constitutionally functioning system to be battered by few. Rest of the 99 % people have not even been consulted. Consult all of them through an election. Inspite of doing this what nonsense is going on. Was Kiran Bedi good to her fellow officers ? She grew with media assistance. Did these Bhushans were clean in their activities. What is IB doing ? There are several people who have renounced them. From where did the money flow for this agitation. Atleast now Anna Hazare would have realised that to do a movement he needs money. And he spent 32 lakhs . So the same way is for a political party. The solution is that the political party should divulge their funding position. Why the PM must be under Lokpal. Why the judiciary should be above Lokpal? Are they sages? Anan Hazare is drifting with his some preconceived notion of an small town villager. Dear all don't spoil the country. Yes we need to cleanse the system , we need to set right things . That must be through the consultative process among the accountable people. Not the media and NGO. We need to bring even the NGO and media under Lokpal in that case. Take any media , check their growth against the circulation they had, it will never match. Did AGS audit the NGO's ? No audit them and bring out the squandering of money. These things need to be done rather than rallying around few people to get cheap publicity and increase the circulation. Be a constructive catalyst for a country with illiterates and poor people . Don't play and dilute the accountable establishments of the governance or else things will reduce to that of an african nation.

Parliamentary Committees for what ?

I tend to agree with Arun Shourie that the Parliamentary Committees enquiring into corruption cases will come to nothing since they are political bodies. As one can see Congress who are past masters in such tricks are already on the job disrupting the procedures ably supported a tainted media. As every one will agree corruption is a cancer eating away our nation, it should be treated as a war against nation and punishable even with death. It is sad that a Binayak Sen can be sentenced to life for keeping a few proscribed pamphlets while people who have looted lakhs of crores of rupees of public funds are roaming free. We have seen how one late CM's son who had only Rs.10 Lakhs assets in 2004 is having a declared asset of Rs.366 Crores now. Our Constitution should be amended to form special Anti-corruption tribunals with vast powers all over the country with an appellate tribunal in Delhi to tackle this menace.We should not forget that it is the rot in the political system that brought Pakistan Army to take over their country.

Misuse of vehicles in NRAA

Staff car facility is provided to Joint Secretary and above level officers from the residence to office & vice versa and for all official meetings. Vide Tender Notice dated 6 October,2010 and 7 April,2011 uploaded / placed on the website of NRAA [ nraa.nic.in / nraa.gov.in], the quotations for dedicated private No. vehicles (not DLY Taxies as per guidelines of MOF) have been invited on monthly basis as against 22 working days. This way the vehicles are being misused by the officers of NRAA on holidays or undue commercial profit is provided to the transporters for 8-9 closed holidays. Will the Ministry of Finance (D/O Expenditure) and Planning Commission do something to stop this kind of corruption in NRAA, going on since its inception.

Fashion in itself to project oneself

This also has become a fashion in itself to project oneself. Since, 1990 I have been submitting my balance sheet to IT dept. With my income returns Annual property return are being regularly submitted by me to the Govt. as per All India Service Rules. There is no further need to showoff ones probity in public as many of them are now showing, more important is to do their duty honestly without propaganda.

Retirement age of govt servants must be raised to 65 because:

1. When private sector people, politicians etc continue in their professions which they have expertise in and know well, and not asked to change their careers at the age of 60; why should government officers be asked to do so

2. By the same token, why should the private sector not be asked to retire at 60 and go for a new profession; same for politicians, and so on.

3. Government officers will be able to discharge their responsibilities by 65.

4. India is the only country stupid enough to ask people to start a new profession at 60 years

Implement DOPT's OM

Vide DOPT OM No. 22011/1/90-Estt.(D) dated 22/4/1992, the detailed procedure lists the number of candidates to be considered for zone of consideration for selection. As per this OM if No. of vacancy is 1, the No. of officers to be considered is 5, if No. of vacancies is 2, the No. of officers to be considered is 8, if the No. of vacancies is 3 the No. of officers to be considered is to be 10 and for 4 or more vacancies, the No. of officers to be considered is to be 3 times the No. of vacancies. But in practice this OM is not being followed by DOPT itself. Even for ACC appointments, DOPT without any circular superseding the above OM, is accepting the single name recommendations of the Ministries / Departments which makes the recommendations of Ministries as Nominations instead of selections because option of selection applies only when there are two or more options available. Will the Prime Minister / Cabinet Secretary or Establishment Officer be serious to implement DOPTs above OM to contain corruption or the Ministries / Departments would continue to have their own way leading to and opening the gates of corruption because the system of accepting single recommendation i.e. nomination itself is open to question mark?

Patronising voters

In Tamil Nadu, from good old days all the parties including the Congress were distributing cash before elections for votes to poor people and even patronised some slum creations as vote banks. Now DMK with lot of disproportionate wealth and the probe is frantic to win this election willy nilly. They will go to any extent with Congress support or otherwise. To delay the "process of 2G" probe against DMK family they are still in coalition. Also time gained can convert all black money into more benami wealth and hide in foreign countries. Also elongate "process" of enquiry gives room for destruction of evidences and witnesses in all connected cases. Despite SC monitoring CBI is cunning enough to further delay the process. ED and IT should go very fast with arrests because Kanimozhi says it is a "process" wait and see indicating that they will go off the hook if they got reelected in TN.the very connotation of the word indicates to me that thaey have adopted devious ways to keep all loot bribes and money got by influence and coercion in benami in India and foreign countries. Even the total of DMK family upto all grandsons and their relations may exceed Rs 5 lac crroes as declared in all the magazines. How this can contineue. Even in Election nominations they have declared assets of high disproportionate growth indicating their illegal accumulations. Much and more has been kept as assets of their extended families

CISF's attitude a cause for major concern

CISF, when first introduced in a public dealing role at airports and metro type areas was a big improvement. However, recent news is a cause for major concern. Repeated incidents have occurred where members of the public have been roughed up, thrashed, mistreated, etc, and no action has been taken. This sends a very wrong signal. CISF Jawans manning posts have begun to think any sort of action is acceptable. Recently, they wrongfully confined, and thrashed an engineer traveling by Delhi metro, for daring to ask for a refund. Enough is enough. Why is action not taken where required? When someone does something wrong, they must be disciplined. Otherwise it will end only with a terrible tragedy, if we allow public servants to get drunk with power. The police should immediately register a case of wrongful confinement, hurt, and assault. Wrongful confinement is a cognizable offence, and they should already have been arrested. The video footage is clearly available, of the wrongful act in progress.

Way for honest working

Kejriwal, IRS 92, retd has paved the way for honest working in government, judiciary, private sector, NGOs, trusts, etc or wherever money that could belong to the people [be it from the exchequer [government schemes]; or from grants [Plan funds] to NGOs; or from right taxation [if business paid their right taxes]; etc].

What a long and arduous journey it has been from IRS to conscience keeper.

The law should be prospective so that all sectors of India can start on a clean slate and give the people a clean governance. If there is retrospective application, Lokpal will be bogged down like CBI and CVC in flogging dead horses ['gada murdas']

Action taken report following an audit

The Appellant wanted to know about the disciplinary action taken in the matter of certain irregularities detected by the auditors during the audit of a particular Branch of the Bank. The denial of information without any reason by the CPIO was upheld by the First Appellate Authority. The CIC directed the CPIO to provide the photocopies of the relevant records and documents relating to any departmental action taken against officers and staff members of the Bank following the said audit. If no action had been taken against anyone in this matter, the same was to be informed. The CPIO was let
off without any penalty as the Respondent submitted that it was because of plain misunderstanding on his part.

Comments

All PIO's must note that no information can be denied merely at their discretion. Every decision to deny any information must be backed by very clear arguments and supported by specific provisions of Section 8 of the RTI Act. Otherwise, such decision could be interpreted as plain denial of information and penalised u/s 20(1) of the RTI Act.
