Pakistan : C J Iftekhar Chowdhary quotes Amartya Sen advising Military officers to keep away from Politics
Pakistan's Chief Justice Iftekhar Chowdhary addressing a delegation from Command and Staff College Quetta advised military officers to stick to their constitutional role of defending the country against external aggression under the directions of the federal government and not to engage in politics as it hampers the evolution of democratic institutions. Quoting noble laureate Amartya Sen that 'a country does not have to be fit for democracy rather it has to be fit through democracy' the CJ termed the previous brief spells of civilian governments followed by prolonged martial rules as 'vicious circle that has brought many setbacks for democratic system of governance'. Justice Chowdhary's advice to military officers comes just a week after his address to civil service trainees from the National School of Public Policy Lahore to 'not obey illegal orders of the superiors'.

All should support Anna's movement

We should all support Anna's movement against corruption before it becomes too late and causes irreparable damage to our social, political and administrative system which is already mired deeply into it. Anna's movement may probably be the last opportunity for the silent majority of honest right thinking men and women of integrity who are made to suffer the demon of corruption in day today life due the weakening of the social, political and administrative fabric of the country by the vested interest of the few powerful people.

Making assets of public servants public

Making assets of public servants public and on-line is a double edged sword. Prima facie, it is an innocuous measure, but is it necessary to stand on the rooftop and Tarzan-Bundolo the details? in a democratic country, why should one be compelled to publicise his assets? in some states, it can be used to blackmail the official by unscrupulous politicians, extortionists, etc. Some public servants may be ashamed to put their details for they have nothing worthwhile. Doesn't a public servant have any right to privacy ? Is he earning without any work ? Building wealth is an art and just because someone is more alert to adding value purely from his earnings, why should he be forced to make it public? There is a system of filing about 4 copies of Property Returns by an AIS officer every year, which many of us do. We do not know where it goes, who opens it, where it is stored and who scrutinizes it. I think it is an ill-advised move, fraught with risks and pitfalls. For a beginning, why can't the authorities have a look at the obvious burgeoning asset details of election-contestants, MLAs, MPs, who have become multi-multi-billionaires in a very short time? By all means, catch and crush the corrupt public servants but spare the straightforward ones who have nothing to hide.

The single reason for corruption in India is that the CBI does not have jurisdiction over officers working in the state governments. All that is required is to extend the jurisdiction of the CBI over them. Nothing else is required.

CISF considers itself to be a law unto themselves

It has been noticed that the CISF considers itself to be a law unto themselves and treat the general public with contempt and disdain. This attitude is specially noticeable at Railway stations, Metro stations and Airports. They treat ordinary innocent citizens as criminals and actual criminals are let off without any question being asked and one can guess the reasons for this. The Senior officers of the force should carry out surprise checks periodically so that they discharge their duties diligently.

Dictatorship of Activistocracy

Politicians under Indian democracy has failed completely. Even if the supposed to be Lok Pal under draft law enacted by Anna Hazare and other patriots results into Dictatorship of Activistocracy, let it be. Why most of us do not support change. For 60 years we have been harassed, suppressed and exploited by the politicians without fear of masses and God. We should all therefore support Anna to bring a change first. Another Hazare would appear if the proposed Lok Pal too fails people's expectation. Let there be a beginning to change the system first. Therefore, please do not create any more hurdles in the passing of Lok Pal Bill.

Amar Singh is a symbol of what is wrong with our politics. A small time industrialist turned power broker who wormed his way into Mulayam Singh's inner circle through methods unknown, utilized this friendship to cement his access to luminaries like Ambanis and Bachans. It was Sonia Gandhi who once threw him out of her house when he came uninvited to attend a party. Now having forsaken by Mulayam Singh, he is busy cultivating Congress by methods he is familiar with. His accusations against Bhushans are a part of his sinister strategy.

It is not a question of Anna Hazare's qualifications but the Strength of an individual to fight for a genuine cause. Though the elected representatives have all the rights to govern it is only when they do not perform their dutied that such a movement takes place. What is Anna saying ? How can a bureaucrat who is privy to so many files during his postings in different capacity be allowed to use the platform of NGO to bully the system? Action taken report following an audit

The Appellant wanted to know about the disciplinary action taken in the matter of certain irregularities detected by the auditors during the audit of a particular Branch of the Bank. The denial of information without any reason by the CPIO was upheld by the First Appellate Authority. The CIC directed the CPIO to provide the photocopies of the relevant records and documents relating to any departmental action taken against officers and staff members of the Bank following the said audit. If no action had been taken against anyone in this matter, the same was to be informed. The CPIO was let
off without any penalty as the Respondent submitted that it was because of plain misunderstanding on his part.

Comments

All PIO's must note that no information can be denied merely at their discretion. Every decision to deny any information must be backed by very clear arguments and supported by specific provisions of Section 8 of the RTI Act. Otherwise, such decision could be interpreted as plain denial of information and penalised u/s 20(1) of the RTI Act.
