Does ACC system have its relevance for all posts?
Does the ACC system has its relevance as far as appointment of incumbents for all posts was concerned? It is time consuming. Under the system it is examined at each level and in every Ministry there are at least six levels. Broadly speaking it goes from concerning Ministry to DoPT Ministry, then to cabinet secretariat and then to the Ministry of Home Affairs (MHA).Finally it goes to the PMO. It is extremely time consuming .In the wake of this please give your valuable views to us.

Next International Monetary Fund chief could be non-European
An Indian or a Chinese could be the next chief of the International Monetary Fund (IMF), British Prime Minister David Cameron has indicated IMF chiefs are by convention from European countries. DoPT should issue guidelines on downgraded ACRs

Natural justice demands that the officers who had been graded below the Benchmark without providing opportunity to represent need to be protected. The Hon'ble Supreme Court in Dev Dutt's case held that overall grading should be communicated but within a "reasonable time". Accordingly, the DoPT vide OM dated 14.5.2009 issued instructions to the Ministries/ Departments to communicate the overall grading of the APAR after it is reviewed by the Reviewing officer and accepted by the competent Authority. Thus the communication is to be done within 6-8 months.

The DoPT order is effective from 2009-10 onwards. But what about the downgraded ACRs which are old by 10-15 years and not communicated at the relevant time. Communication of such ACRs at this stage shall not serve any purpose. The basic objective of communication is to give opportunity to the officer concerned to represent and most importantly to provide opportunity to improve the performance in future in the interest of the organisation. That is the reason Hon'ble Supreme Court in its recent orders held in the cases of Abhijit Ghosh Dastidar (three judges order), R.K. Anand, J.S. Garg and Ranjana Kale that review DPC should be conducted ignoring the downgraded ACRs. In view of the recent judgments, DoPT should issue guidelines for the DPC to consider the promotion of such officers ignoring downgraded ACRs.

Transparency in transfers can check corruption

Corruption could be effectively reduced by transparency and 0% deviation in transfer and posting policy in all the departments. The authority responsible for transfer and postings should be made directly responsible for violation of policy. This would reduce money power, recommendations and buttering for getting prime postings.

People discuss corruption, bureaucracy not affected

While the whole country is discussing corruption like never before but there is little or no impact on bureaucracy of all this. I found the attitude of 'I care a damn' still very much prevalent in most senior bureaucrats and the 'nanga nach' of corruption is going unabated. I also find it difficult to fight with the system because the system has been so designed that it favours only the corrupt and powerful. If one is ready to live with a compromised career, sullied reputation and frustration then only one should take panga with the powerful bureaucracy which has mastered the art of 'how to harass or sideline an honest' officer. I in person also tried to find out from CVC whether a whistleblower would have any protection if the culprits are senior bureaucrats the answer was that 'risk is entirely yours'. How does one live in this system without being totally suffocated?

Corruption in Offices

I am a strict pleader for the Lokpal Bill having a functional mechanism for dealing with the victimisation of honest, straightforward but devoted & efficient ones ( including Sr Executive rank officers / Sr officers in Government setup )at the hands of dishonest Sr Officers and the Top Management of govt. Organisation/ Deptts. It is happening everywhere and victims have no where to go for justice. I call this "Official Terrorism" or "Office by Terror" where Act & Rules are blatantly misinterpreted to save the corrupt ones. In such a situation, one can't move Courts as it involves huge cost that is very difficult to bear by any such victim, very long time to see the end of the proceedings and most discouraging factor-further victimisation by the office in so many different ways like giving bad Annual Appraisal Report, No further promotion, bad & frequent posting and transfers to tough centres etc. While Lokpal will be expected to oversee corruption at very high level, a provision could be made in the bill to cover such "Office by Terror" cases. If data on this are collected, I am sure the number shall be in lakhs and one can assume the level of corruption and the number of human resource so harassed, their morale, their sufferings in silence, bearing all kinds of excesses etc,. It adversely affects the national productivity. Therefore, people from every corner could raise this issue also to create an honest & effective office culture that should impact positively the working with the people at large.

Can we trust you, our scientists?

On nuclear energy projects, people do not trust their leaders. Can our scientists, who alone can legitimately bare all before the people, muster courage to speak the truth and nothing but the truth? They can give a comprehensive status report for people to evaluate the pros & cons before voicing any opinion. Some issues that come to mind and are definitely not included in any DPR(Detailed Project Report) are:- 1) what is the opinion of the world scientific community on disposal of nuclear waste?(Small Is Beautiful by Schumakar also be referred);2) what is the life of the plant beyond 60 years? 3) what investment is needed once the life span of the plant is spent? 4) Will India remain dependent for nuclear fuel on foreign countries for only 25 years(period planted news stories hold out in the name of Areva-the French company); 5)Can we hope for supply of fuel at reasonable price by the French after the expiry of the 25 years for the remaining life of the project i.e. another 35 years? 6)can we not save the 10000 MW power of T & D (transmission & distribution losses)losses and rampant power theft by unscrupulous politicians, bureaucrats and business persons?; 7) who is going to benefit from this nuclear energy? the aam aadmi? the Indian businesses or the foreign importers, who are shifting hazardous operations to hungry but corrupt to the core countries in the developing world? 8)what mechanism for "effluent" disposal/treatment is going to be put in place? Is it adequate to protect human, animal & plant life and environment? 9)What is the harm in taking the people into confidence when their safety is at stake, Bhopal type disasters occur without any succour to the sufferers, Fukushima cautions us, Chernobyl and USA n-plant experience educates us? Or we are determined to learn our lessons only from the European countries, who will set the guidelines for the world in the next two decades? Wake up, dear scientists, and reveal the truth to us. You owe it to the Nation !

Was Army Chief underage when he appeared for entrance exam ?

Apropos reports of fudging of date of birth by the Army Chief General V K Singh, one feels that if the correct date of birth of Gen V K Singh is May 10,1951 as contended by the Law Ministry as well as the general himself, Gen VK Singh was most probably not eligible, being under age for appearing in the NDA Exam in 1965. UPSC needs to examine the issue and clarify. It appears that wrong date was entered in the application form for NDA with the aim to make him eligible for the exam. Keeping in view the consequences of inaction, there is an urgent need for the government to take decisive action not only against the beneficiary(ies) of fudging but also against those who have allowed it to happen and kept the matter lingering on for decades..

Instead of Lok Pal we should instead be focussing ourselves on Right to (Administrative) Service. It will ensure that service by government servants, which is a due right of each citizen, is provided in the desired form and in the desired time frame. It will kill corruption in one go!

Action taken report following an audit

The Appellant wanted to know about the disciplinary action taken in the matter of certain irregularities detected by the auditors during the audit of a particular Branch of the Bank. The denial of information without any reason by the CPIO was upheld by the First Appellate Authority. The CIC directed the CPIO to provide the photocopies of the relevant records and documents relating to any departmental action taken against officers and staff members of the Bank following the said audit. If no action had been taken against anyone in this matter, the same was to be informed. The CPIO was let
off without any penalty as the Respondent submitted that it was because of plain misunderstanding on his part.

Every decision to deny any information must be backed by very clear arguments and supported by specific provisions of Section 8 of the RTI Act. Otherwise, such decision could be interpreted as plain denial of information and penalised u/s 20(1) of the RTI Act.
