Rahul: Momsy last time I asked Kapil to okay a speech he changed the total message I was trying to give....... there was a caveat with every promise.....and in the end there was a Disclaimer that he wanted me to read out after the speech! I promised jobs in the speech and Kapil added my promise was based on GDP going up to 9.5% and force majeure was applicable!!! Momsy how am I going to take over if I have to get even my speeches okayed?????? 1.In his first stint Nitish was able to restore law and order, provided excellent road and improved health care. 2.As a result he was voted back to power by the people. 3.However his performance in the second term is very disappointing. 4.The power situation is still grim, there is hardly power for two hours in my home district, he has not been able to woo industrialists, no major plan has been undertaken for flood control and bureaucracy is still extremely corrupt. 5.I hope the CM will work hard in these areas otherwise people will start looking for alternatives- He needs to either befriend likes of Ambani, Birla,Tatas or befriend congress to get central fund, or do both. 6. The CM needs to act fast if he wants to be counted among efficient CMs like Narendra Modi, Shivraj Singh Chauhan, Sheela Dikshit etc.

DoPT should issue instructions to ignore downgraded ACRs
Natural justice demands that the officers who had been graded below the Benchmark without providing opportunity and without communicating the Average/Adverse below benchmark grading and the same remain uncommunicated need to be protected. The Supreme Court in Dev Dutt's case held that overall grading should be communicated but within a "reasonable time". Accordingly, the DoPT vide OM dated 14.5.2009 issued instructions to the Ministries/ Departments to communicate the overall grading of the APAR after it is reviewed by the Reviewing officer and accepted by the competent Authority. Thus the communication is to be done within 6-8 months. The DoPT order is effective from 2009-10 onwards. But what about the downgraded ACRs which are old by 10-15 years and not communicated at the relevant time. Even if they are communicated now, and representation made against the same, no competent authority takes proper action to upgrade or modify the same and no proper or effective measure is taken to save the affected officers. Moreover, in the case of CSSS officers where there is no reviewing/accepting authority, the reporting officer writes the ACRs after 4-5 years and even if the same are communicated after lapse of such a long period, the competent authority never takes any proper action to take action on the representation against such ACRs. Communication of such ACRs at this stage shall not serve any purpose. The basic objective of communication is to give opportunity to the officer concerned to represent and most importantly to provide opportunity to improve the performance in future in the interest of the organisation. This procedure is totally baseless as if one ACR is below benchmark, it takes at least five years to recover the effect and unless the same is upgraded or modified, there is no remedy except affecting the promotion of the affected officer. That is the reason Supreme Court in its recent orders held in the cases of Abhijit Ghosh Dastidar (three judges order), R.K. Anand, J.S. Garg and Ranjana Kale that review DPC should be conducted ignoring the downgraded ACRs. In view of the recent judgments, DoPT should issue guidelines for the DPC to consider the promotion of such officers ignoring downgraded ACRs. This is the only remedy to protect the officers who are downgraded without any fault of theirs.

Abolish the system of ACRs
Having seen the working of a highly corrupt department from inside and its bosses over a long period of time, I have a suggestion for consideration to drastically reduce levels of corruption . Abolish the system of ACRs which enables a corrupt senior to play havoc with the career of any junior who may dare to resist and expose his corruption . For this no Lokpal bill is required. ACRs instead of being a tool for human development have become a mechanism to ensure dominance of the corrupt. Has any one ever asked how come corruption is so rampant when all the top posts are supposed to be manned by highly efficient persons whose integrity has been certified continuously over the years?

It is mentioned many a times that Corruption could be effectively reduced by transparency and 0% deviation in transfer and posting policy in all the departments. The authority responsible for transfer and postings should be made directly responsible for violation of policy. This would reduce money power, recommendations and buttering for getting prime postings. The power ministry is saving many Assistants and so for rotation transfers. So keep this in mind.

Another Civil Services Day means
Another Civil Services Day means another round of sermoning by our beloved PM and of-course some discussions by eminent panelists on the papers prepared by DAPRG. Then what? Does anything change in real life? Well judge yourself! Transfers and Postings will take place on the same consideration as they used to be. Cuts in contracts would be taken as they used to be. Serviceism, Casteism, nepotism, and favoritism shall continue as it is. You may say I am a cynic. Yes I am. Remember how many civil service days have been celebrated. Remember how many such sermons have been given by our beloved PM. He talked about administrative reforms where are they after seven years of such talks sir? He talked about corruption and what we got was a series of scam done at a scale which is unparalleled in the history of independent India. Sir you have talked and sermoned so much that we are now fed up. If you have any sense of seriousness or infect propriety then take some concrete action and on next 21st April enumerate the actions taken by you and their impact. Doing is believing sir. It is so very easy to come with a prepared speech and give it to a compulsive audience who have no other option but to listen to your speech. Let this year be of no speeches but of action which you would talk about next summer. Thanks

Sonia writes but others voice
Sonia's letter to Anna Hazare is couched in polite language. Compared to the acidic tongue of the others attacking civil society or Anna Hazare, it promises to carry the political discourse back to decent language and respectful expressions. Of late, many politicians, including some extremely aggressive ministers, have brought down the political idiom to the base level of the street. For students of linguistics, it provides an interesting area of research to map the decline in the political idiom in the past 50 years. Sonia's letter reminds one of the civilized, polite & cultured political discourse even with the opponents, whom the aggressive motor mouths of today intimidate by word and expressions of mouth. Let all political parties revert back to those decent days(the decline perhaps started sometime when goongi gudiya/subah ke akhbaron mein taazaa chehra etc were lauded as the new idiom, which some seem to be reviving again).

The reason is that the state level vigilance bureaux are not as efficient and professional and independent as the CBI. To allay the situation, either the state vigilance should be manned by officers from the CBI or the CBI's jurisdiction should be extended over the officers of the state governments.

Anna Hazare's letter expressing concern to Sonia Gandhi about the non-stop and mischievous attack on the civil society's reps on the joint drafting committee ,is an exercise in futility particularly as the "dirty tricks department" of the Congress party works at the behest of its President, who has been labeled by the Opposition as the 'fountainhead' of corruption. Why should she be given the importance and reverence she hardly deserves? The Prime Minister aided by his close coterie of bureaucratic confidants is scared of the implications once the Jan Lok Pal bill comes into operation. It is like living in a fool's paradise to expect Sonia Gandhi to rein in her 'soldiers' who are always at her command, vying with each other to please the 'prima ballerina'. The no-holds-barred proxy attacks on Anna and his team members are inspired by the political riff raffs only to deflect public attention from the core issue of fighting corruption. This shows the paradigm shift in the fast declining ethical values , the Indian National Congress once stood for. Sonia Gandhi's assertion in her response to Anna Hazare that she neither supports nor encourages smear campaign, is an eye wash and a total falsehood. There appears to be a grand conspiracy by forces of corruption against the civil society. Anna, it seems, will be required to go for fasting, not once, but many times over!

Failure of IT Department in issuing of refund orders
CBDT tried their best by encouraging IT officials to complete the work related to issue of refund orders for AY 2010-11 by 20.4.2011 but failed. The last date was extended three times from 31.3.2011. CBDT should start reviewing of the circles performance at least in Delhi and Mumbai. Mumbai had already slowed down the issue of refunds in first week of April 2011. Recently promoted Commissioners IT should not be allowed to join till they complete the assessment work of their respective circles. They may be given proforma promotion to avoid financial losses. Circle 40(1)& 41 prime circles in Delhi. Can it be reviewed whether assessment work of AY 2010-11 is complete or pending. It will give an idea of pending cases in reality.

Confabulate on "why" instead of "how "
If Lok Pal arrogates to itself powers of a Disciplinary Authority ,as understood per the Draft (8(2)(c) )and administers the Conduct Rules,1964, it should as well order for rescinding the entire CCS CCA Rules and frame its own rules. In the same manner it has suggested repeal of CVC Act. To all conversant with the modalities of anti corruption measures and practice, this would be a gigantic load of paper work with little consequence. Indians love to write new laws every day or if that is not possible, to amend the law as if their life depends on it, without exploring in what manner the old laws have failed, and little realizing the consequences of a patch-work legislation ,as is the case here. Let the Draft Committee sit and confabulate the question of "why" instead of jumping to "how ".

Protest against violation
Samaalochak has rightly pointed out the violation of Para 3.3.2 of Sixth Pay Commission recommendation and acceptance by Ministry of Finance vide Resolution dated 29-08-2008 by DOPT vide their OM dated 24-04-2009 by incorporating additional eligibility condiotions. All Group A services and Engineering Services should not only protest against this violation but also take up before court of law for proper justice.

know about the disciplinary action taken in the matter of certain irregularities
detected by the auditors during the audit of a particular Branch of the Bank.
The denial of information without any reason by the CPIO was upheld by the First
Appellate Authority. The CIC directed the CPIO to provide the photocopies of the
relevant records and documents relating to any departmental action taken against
officers and staff members of the Bank following the said audit. If no action
had been taken against anyone in this matter, the same was to be informed. The
CPIO was let Comments All PIO's must note that no information can be denied merely at their discretion. Every decision to deny any information must be backed by very clear arguments and supported by specific provisions of Section 8 of the RTI Act.
