Pakistan : US Ambassador asked to show NOC while travelling to Karachi (UPDATED)

Understand the importance of IRS vis-a-vis IAS

Our friend should understand the importance of IRS vis-a-vis IAS. IRS provides the bloodstream to the functioning of entire government including IAS. IAS can no more claim the age old supremacy. IRS performs the functions of quasi-judiciary, intelligence gathering, investigation, prosecution, representing government in Tribunals etc. In fact, IRS should stop comparing itself with IAS and should seek independence like in the case of Judiciary for assessment work and autonomy like in the case of CBI for investigation work. Unless autonomy and independence are given to I-T Dept, it will be difficult to raise upto the expectations of the people in our democracy.

This is regarding Manas Das's comment on WIC on 30July. Its incorrect that IRS are manning lucrative posts in ministries and secretariates. Only 2% IRS are on deputation and many times to posts IAS in not willing to take becoz these are not considered lucrative. As against this, more than 20% IAS in on deputation at any given time. Entire govt. of India is run by them.

Woes of an IRS officer

This is regarding woes of an IRS Officer expressed on your site this week. Everyone wants timely promotions and there is nothing wrong in aspiring for these promotions. However to say that the IRS should get them ahead of other Central services because they have joined the IRS at higher rank in the civil services exam is a misplaced thought. Firstly promotions in any service are a by product of the cadre size and efficient cadre management and not at all related to service rankings at the UPSC Exam. Secondly the ranking of the candidates at the UPSC exam is no indicator of the importance or otherwise of the service. Candidate's option for the services shows their values and motivations for joining a particular service . The mere fact that the IRS is getting a higher rank after the IAS/IPS does not make it a superior service . The entire service fraternity knows the obvious reasons for the clamour for joining the Revenue Services . So please don't sit on a high pedestal and look down on the other Central services. You have knowingly joined a service which has a huge cadre size and so the hard truth is that you will not get quick promotions. So accept it and be happy with the worldly gifts and perks of your service !! Every Central Service has a role to play in the System and hence don't display such arrogance !!

Why did he join Income Tax in the first instance when he knew that promotions in IAS is faster. Was there any other consideration? I fully endorse the view that the procedure required to be followed by beneficiaries of CGHS is extremely cumbersome and needs to be simplified. The requirement for obtaining prior permission from HOD and provision for non-reimbursement of medicines purchased from market during OPD treatment are a big roadblock to make the scheme user friendly.

IT return filing arrangements at Pragati Maidan

Kudos to IT Department for the excellent manner in which the IT return collection exercise for the salaried & pensioners is being managed at Pragati Maidan. It was a delightful sight to witness a disciplined "mela" of people (in fulfillment of their national obligation) being entertained professionally. It shows that there are imaginative ways to enthuse people and enlist their cooperation & contribution in myriad acts of national development. While IT Department appears to have geared up to meet the rush anticipated on July 31, one hopes that ITPO, DMRC, CISF, DTC, DP, NDMC and MCD would also pool in their resources in adequate measure in a festive spirit (of national revenue generation!), even though the subject may not be in their jurisdiction. It is also to be expected that treatment to the salaried in other parts of the country as also to the non-salaried in their specific context would also be an experience for them to cherish. Last but not the least, as always, increase in the efficiency of the process of refund to taxpayers would constitute the Litmus test of the functioning of the IT Department.

We can learn from Pakistan also

What is this cribbing going about fashion icon of the Pakistan minister, without attempting to understand the deft diplomatic move by Pakistan. The J&K CM was disappointed to have missed the opportunity to meet in person such a wonderful lady minister! Our fashion expert women media corps were overworked to describe for our great national benefit the brand of each item on the person of the minister, whether her purse worth US$ 100000 or her watch or her shoes or nail polish. Normally menfolk are known to indulge in the luxury of such kind of a nakh-shikh varnan or description of the person from head to toe! What does India offer to meet the Pakistani gesture? Are we even conscious of the diplomacy involved in such grand moves? Where do we really stand? To be honest we are a horrible mismatch!! Our foreign ministers and Pakistan's ? The entire diplomatic, political, media community goes ga-ga as soon as the Pakistan foreign minister lands in India and until she departs. It is all smiles and more warm smiles and smiles of two traditionally friendly neighbouring countries i.e. India & Pakistan! The smiles ? Of course, diplomacy is all about smiles. But some are winning while others are repulsive. When will India understand the value of smart personalities in winning diplomatic battles just by smiling the right way in the right measure! How can somebody demand that the Pakistan foreign minister should extend the warmth of the diplomatic smiles at them too? India better give up the Big Brother attitude and take a few lessons in the diplomacy of smiles from our friendly neighbour Pakistan!

By appointing leading lawyers as their spokespersons, Congress party has taken the shean out of the opposition by perplexing and confusing the average citizen. Many a time court battles are fought in the channels through these lawyers. Lawyers are accustomed to defend, criminals, murderers, law breakers and also defend the indefensible. It is no wonder Kapil Sibal defended the 2G scam accused by asserting that there was zero loss to the Government. His mocking smile revealed his contempt for the intelligence of the average citizen. While in courts Judges are learned enough to separate wheat from the chaff, the average public is left bewildered. Bar council should bring in some sort of restrictions on political lawyers from hoodwinking the public with outright lies.

It was finally cleared when Escorts threatened to stop cashless facility to Income Tax Department. Opinion given by Ministry of Law and Justice

The Appellant sought information regarding the legal opinion provided by the Ministry of Law & Justice in respect of an incident for which action is being contemplated against Shri Pranav Kumar (IAS 2008 Batch, Bihar Cadre) under Rule 12 (d) of the IAS (Probation) Rules, 1954. The Ministry of Law informed the CIC that its opinion on any given issue is tendered on the file received from the concerned department. This opinion becomes a part of the File which is eventually returned to the Department concerned. The Commission clarified that the records of any advice / opinion tendered by the Ministry to other Government Departments do not fall under the category of fiduciary capacity and Section 8 (1) (e) is not attracted. The Commission held that the decision in respect of disclosure of the legal opinion given by the Law Ministry to the concerned under the RTI Act, has to be made by the Department seeking that advice.

Comments

There exists a two-way channel connecting the Law Ministry with any other Department of the Central Government. On one way, the File seeking opinion travels from the concerned Department to the Law Ministry and on the other way, the opinion tendered on that File travels from the Ministry of Law to the concerned Department. If the advice given by the Law Ministry is accepted as fiduciary, then such information which will never be disclosed in any contingency u/s 8 (1) (e) of the RTI Act even if the concerned Department is willing to disclose such opinion which is under its control.
