Pakistan : Khyber Pakhtun Khwaha for revival
of Executive Magistracy
The provincial government of Khyber Pakhtun khwaha (KPK) is considering
revival of the system of executive magistrates through an amendment
to the CrPC. The system under which District magistrates enjoyed widespread
judicial powers primarily for maintenance of law and order under the
CrPC during the British colonial rule was done away with to secure total
separation of the executive and the judiciary in both India and Pakistan.
Pakistan amended its CrPC in 2001 transferring all the powers of adjudication
enjoyed by DMs to Judicial Magistrates. The KPK government considers
the revival of the colonial system essential for proper maintenance
of law and order the legal fraternity suspects that executive magistrates
being directly under the control o0f the state government might act
only as per the whims of their political masters and not as impartially
as judicial magistrates do.

UT administration seeks fresh panel for UT
Home Secretary
Having rejected the earlier panel sent by the Haryana Government for
the post of UT Home Secretary due to the ineligibility of the IAS officers
(as they have already got higher ranks than FC scale), the UT Administration
has now sought a fresh panel for the same. The three officers named
in the earlier panel were 1986 batch IAS officer RR Jowell, 1988 batch
officer Anil Kumar and PK Das. Jowell and Das are now Financial Commissioner
and Principal Secretary. The tenure of the present incumbent Ram Niwas,
who was appointed in September 2008, ends on September 24..he is 1985
batch IAS officer.

CAG's factual Audit Report
The CAG has presented an explosive and factual Audit Report, the findings
of which conclusively show evidence of massive corruption and huge expenditure
which the government is trying to pass off as irregularities, genuine
mistakes or resulting from time delays.
This is an urgent appeal to all honest officials and others involved
in the organisation of the games with any agency, public or private
to come forward and in the interest of the country, turn whistleblowers
by approaching the authorities including the PAC with full details of
all wrongdoings. Even those who might have participated in the wrongs
unwittingly should come forward.

One thing that strikes in this web site - in the viewers' sections
- is what makes and ails this polity. There is absolutely no connection
between what one says and what another reacts. A reader writes passionately
on CGHS and expects voices to support or criticize him, seeing his view
point at least. Next morning, he gets voices , dozens of them, on house
allotment by the Estates Directorate or promotion issues of GrD in some
Ministry.

There is another department DGS&D , presently dealing with Rate
Contract for Central Government and New Public Procurement Law to curb
corruption in public procurement with eight vacant posts of Deputy Director
Generals and two more in the offing out of total Eleven posts. Neither
the DG (S&D) nor Ministry of Commerce is concerned to fill up these
posts. This will reflect on the quality of work but who is bothered.

Scoop of the week
We should always remember that the one who delegates the work- remains
accountable for its outcome. Thus we should always be clear about the
work and to whom and when it should be delegated. Poor delegation, on
the other hand, might cause frustration and confusion to the involved
parties.
The Wolf and the Shepherd
A Wolf had been prowling around a flock of Sheep for a long time, and
the Shepherd watched very anxiously to prevent him from carrying off
a Lamb. But the Wolf did not try to do any harm. Instead he seemed to
be helping the Shepherd take care of the Sheep. At last the Shepherd
got so used to seeing the Wolf that he forgot about the inherent traits
of the Wolf.
One day he even went too far as to leave his flock in the Wolf's care.
But when he came back and saw many of the sheep killed and carried off.
Then he knew, how foolish it was to trust a Wolf. He exclaimed, "I
have been rightly served; why did I leave my sheeps to a Wolf?"

Copies of documents in Vigilance cases
The copies of documents sent by the Central Board of Excise and Customs
(CBEC) along with enclosures on the basis of which the Central Vigilance
Commission (CVC) issued the 'advice' in the case of the applicant were
sought. They were declined claiming exemption u/s 8(1) (h) of RTI Act
by CVC after consulting the CBEC as a third party. It was submitted
to the CIC that although the proceedings against the Appellant himself
had since been completed, the proceedings against the remaining employees
who had been charge-sheeted in connection with this case were still
pending and, therefore, the disclosure could adversely affect the pending
enquiry. Further, the case involved a large number of employees and
the records and documents received from the CBEC had common references
to all those employees, distinguishing the information related to the
Appellant from the rest might not be possible. The CIC held that upon
the conclusion of disciplinary proceedings against the Appellant with
the advice of the CVC, there is no reason why the desired documents
should not be disclosed.
Comments
Even if the communications from the CBEC contained some references
to other employees, it would hardly matter when the CVC has already
given its advice in relation to the Appellant. The increasing number
of such cases point to a need for a change in practice and training
in RTI Act.
