Punishing people for no fault

The Article 44 of the Constitution of India states that the Government will secure a uniform civil code applicable to the entire country. I had been allotted a CGEWHO Flat in Sector 82, NOIDA in 2003. I wanted to get it registered at that point of time but could not as a judgment of Allahabad High Court came. Any endeavour in that direction would have meant contempt of court. NOIDA went against the decision of the High Court in the Apex Court and very recently the latter have come out with a judgment in favour of NOIDA. Now for registration I am required to pay current circle rates. Recently, HUDA had organised a Registration Camp for the CGEWHO flat owners in Gurgaon. This was done at the original rates. Are we not punishing people for no fault of theirs and flouting the Constitution.

Reforms in the CGHS required

It is high time that the Govt. initiates reforms in the CGHS. A good number of tardy procedures end up in practically depriving the benefits to its beneficiaries. The blanket ban of non reimbursement of medicines for OPD treatment, requirement of obtaining certificate and verification from the CGHS doctor end up in depriving benefits to its beneficiaries.

CGHS adds to woes

My old parents have to go to the CGHS dispensary off and on just to get the referral from CMO for getting the pathological tests done by the empanelled diagnostic centres. There should be some relief for the senior citizens. The procedure now being followed should be simplified to make the CGHS more patient friendly. The patients now feel very harassed. Because of a parallel system of Mediclaim being offered by Insurance Companies and Banks, many CGHS beneficiaries prefer the parallel system just to avoid harassment. If this trend continues, a day may come when CGHS may become redundant and may be scrapped altogether.

The atmosphere in CGHS dispensaries is so disgusted that one shudders to visit the so called Wellness Centres. The doctors in CGHS Dispensary Mahaveer Enclave catering to Dwarka patients are permanently on tea sipping spree. They close the doors of their rooms, ban entry of patients and go on tea sipping for one hour. It is very strange that the CMO incharge will not attend to patients. Why can't the doctors take tea and attend patients simultaneously and the CMO incharge be available for consultation to patients. The whole system needs revamping.

Postings in Punjab

The way this country is going is clear from the postings of Provincial Police Service officers in Punjab to head the districts. The Regular Recruits of the IPS are not heading the districts, the PPS chaps are. Why this discrimination? There should be a fair share of the IPS Regular Recruits in the districts. Actually, this suits the political masters who want only yes-men willing to obey all orders, right or wrong, as well as the IAS lobby, who wish to cut the IPS to size.

Confusion cleared

It has been stated that only 1990 batches of PT&FAS, IDAS, etc. have been promoted to SAG. In fact 1994 batch of PT&FAS and 1992 batch of IDAS have been promoted early this year. So IRS lags behind not only IAS/IPS/IAAS but also in comparison to almost all others central services. In fact the worrying factor is extreme delay in HAG. While it is only 1978 for IRS, it is 1986 for the all India services in almost all states including the IFS (forest).

Correct yourself

Adverting to Aarti Khosla,s comment about unduly quick promotions in P&T A/Cs & Finance Service, it is worthwhile to know that posts in that service are created by the Telecom without the knowledge and concurrence of the Finance as it has powers to create posts upto SAG level. Having officers promoted against such posts,the officers are thrust on POSTAL DEPTT whose accounts and finance wing posts are encadred in the service controlled by the Telecom Deptt. In recent years the accounts and finance wing of Postal has bloated due to such unwanted and unjustified posts. The department is incurring increases monetary loss due to the burden of these posts. It is not unlikely that the Telecom is deeply indebted to the accounts and finance officers for their collaboration in various telecom scams. If there were a special audit of the accounts wing of Postal department many startling disclosures would be there .

Cadre-controlling authorities shouldn't be blamed

As far as posts upto SAG level are concerned, it is within the purview of cadre controlling authority but his (or her) powers are limited by the committee. In HAG posts, DoPT simply sits on the proposal. Precisely due to this, Mrs. Sushma Nath agreed to put proforma promotion or non-functional upgradation system as recomendation in Sixth Pay commission, whose secretary she was. In addition, she made sure that the proposal was approved when she was Secretary(expenditure) to Govt. of India.

I did a case study of Ministry of Communication. There are three cadres? ITS, IPoS and IP&TFAS. How come the promotions are fastest in Finance cadre? I know, Aarti was in Railway accounts. But in Min. of Comm., for every 2 posts created at any level, Finance would demand one new post, despite their intake being one tenth. So now, the Finance Cadre is enjoying SAG for 1995 batch ( in BSNL and MTNL) whereas the operative cadres are stagnating.

Rising prices makes him happy !

Price rise seems to evoke different feelings from the aam aadmi and the Prime Minister. The aam aadmi does not understand the economics of the Prime Minister, for whom rising prices are happy boding. The PM and his team of international economists(less national than international) see high growth and higher consumption by higher number of people, because of which prices have been rising. He is convinced that people's incomes have risen and so has consumption. But there is no shortage of production in essential commodities--in fact, the government has no place to keep the bountiful produce and hence puts it to rot in the open. Releasing them in the market would tame the prices, which will be bad economics. Jacking, manipulating, rigging prices are games the kings of corruption have successfully played in the past 7 years. Yeh Dilli ki loot hai bhaiyaa. Maal maal ki loot hai, loot sake to loot, phir pachitaye hot kya jo samaya jaayegaa chook! With growth in incomes and consumption, corruption too has grown astronomically. So what? It is sound economics only. One or two court cases against corruption and the economic advisers to the PM have sounded the bugle that business climate has already deteriorated and if this trend is not checked immediately, perhaps business activity may come to a complete halt! Indeed economic logic. Now the only remedy is the age old wisdom of India: keep fast for monday to please the Sun God and tuesday to propitiate Mars and wednesday for Guru and thursday for brahaspati and friday for sarva dharma sambhav and saturday for Lord Shani--the only God who can make or mar political destinies. How about joining Anna Hazare(a really non-religious good cause)? Meanwhile our economist prime minister can extend the same benefit of "tax-free pension" that majority of his team of advisers have been getting from the world bank, imf & other UN agencies(after all it is Indian contribution to the UN from which such money comes).

Inclusion of PM in Lokpal Bill:

It is ridiculous to say that PM should not be included due to sensitivity of his post. In fact, due to sensitivities of his post he should be included. I agree that that no frivolous omplain against him should be entertained. In fact, we can make a provision that at least 5 members of Lokpal should agree for such investigation and prosecution. Imagine, if PM is involved in any wrong doing, it can do immense harm to the country. Although I have greatest of regards for present prime minister.

What Rita is saying about the promotion of Grade 'D' Stenographers is only partially true. In every cadre, in every employee set up, there are examinations and on that basis promotions are given. But persons, unfortunately, who could not pass the departmental tests because of many compelling reasons, like family problem, could not spare time from his office or may be some other reasons; they have also a right to get the promotion. I am not saying promotion be given after every 8 years. Here a poor Grade 'D' Stenographer spends 25 years on the same post, is he not eligible for next promotion? 25 years are too much. Suppose a Collector is not given promotion for 25 years what will happen to this country. Argument about one should have attempted the Departmental test is an old hat. Does that mean a stenographer did not pass a test, should die on his seat? Many a Lower Division Clerks on his own turn became a Section Officer a post equivalent to a Private Secretary. After all a Stenographer is above an LDC. It is a big injustice against the Grade 'D' Stenographers who have not been given promotion even after two decades. Naturally, they will be wary about pushing and bossing by PSOs for the sake of it. All the Grade 'D' Stenographers who have completed more than 20 years of service should be given double promotion after amending Rules as an exceptional case, then only we can say balance of justice is met. Corruption is of two kinds

One not intervening when things are going wrong and remaining mere spectator, and then trying to find scapegoats. Other is non-decisiveness causing delays and escalation of costs. Opinion given by Ministry of Law and Justice

The Appellant sought information regarding the legal opinion provided by the Ministry of Law & Justice in respect of an incident for which action is being contemplated against Shri Pranav Kumar (IAS 2008 Batch, Bihar Cadre) under Rule 12 (d) of the IAS (Probation) Rules, 1954. The Ministry of Law informed the CIC that its opinion on any given issue is tendered on the file received from the concerned department. This opinion becomes a part of the File which is eventually returned to the Department concerned. The Commission clarified that the records of any advice / opinion tendered by the Ministry to other Government Departments do not fall under the category of fiduciary capacity and Section 8 (1) (e) is not attracted. The Commission held that the decision in respect of disclosure of the legal opinion given by the Law Ministry to the concerned under the RTI Act, has to be made by the Department seeking that advice.

Comments

There exists a two-way channel connecting the Law Ministry with any other Department of the Central Government. On one way, the File seeking opinion travels from the concerned Department to the Law Ministry and on the other way, the opinion tendered on that File travels from the Ministry of Law to the concerned Department. If the advice given by the Law Ministry is accepted as fiduciary, then such information which will never be disclosed in any contingency u/s 8 (1) (e) of the RTI Act even if the concerned Department is willing to disclose such opinion which is under its control.
