SC admits writ by IOOA
Supreme Court has admitted a writ filed by officers of the Indian Oil Corporation Ltd (IOCL)under the banner of IOOA for full disclosure of their APAR & promulgation of promotion policy. Similar grievances exists in all CPSEs. Many officers are superceded every year. The petitioner has contended that in IOCL nearly 50% of APAR consists of subjective parameters and this evaluation at appraiser and reviewer level has not been disclosed by Management, in contravention to a judgement by Supreme Court and directives of DOPT & DPE. Snatch the silver spoon from these privileged CSS & IAS Babus

I entirely agree that these CSS Babus do not come to office on time despite so called attendance monitoring machines installed at huge costs in entrance of every Ministry. Whenever a telephone call is given in Ministry there is no one to attend especially since IAS Babus are not approachable to small frys posted in field areas not knowing internal complicated process of Ministries, but even CSS Babus behaving absentee landlord like. If even these attendance monitoring machines have been rendered ineffective then Government must give a thought to recovering this huge expenditure from the respective Secretaries of these Ministries who do not have the guts to ensure punctuality. For a change let there be accountability fixed on top IAS babus. The normal practice of holding the LDC or even Class-IV responsible after a massive departmental enquiry which takes so long that by the time inquiry report is submitted the CSS babus retire & laugh at home sitting with collective wisdom of years of brow beating the system & milking it to maximum extent. If I remember correctly it had appeared in forum as expressed by one reader that the data of these machines need to be culled in hard copy & sent to Accounts Branch for deducting from salary of all such unauthorized absence. I pray to CAG to intervene in the matter. CAG should issue orders to all Chief Controllers of Accounts to start obtaining hard copies & deduct late attendance from salaries of these Babus sitting in comfort of Ministries with very little work, non existent accountability & enjoying all perks, facilities, free salary & easy life.

PIL in court soon to make CSSS officers bite dust

CSSS officers are expected to manage on their own the offices of their officers. They get themselves assisted by UDCs/LDCs of the Department and of PSUs, attached offices etc., which is illegal. I have already collected number of such information under the RTI Act-2005. As the tax payer's money is being involved due to over employment, I propose to file an PIL in court soon. Then only CSSS officials will bite dust and realize their calliber. I am ready or any open competition on reasoning, general mathematics, general knowledge and writing/drafting of the notes/DFAs to prove the metal of CSS officers. You also got in-situ promotion in 1988 & 1999 and Cadre restructuring in 2005 & recently. Why are you cribbing. You are only trained to take dictation and do typing work. Once again read the CSMOP.

Laaga Chunari mein daag ?

Here is some more addition from the dirty tricks department of CSS & IAS Babus. They connive & conspire & give all kind of negative notes & deliberately withhold complete facts while submitting notes in file. They are pompous & arrogant & show their authority & act superior not realizing that officers in the field have to bear the brunt of incompetent politicians & they often become scapegoats. There is one example of an officer who had approached CSS & IAS babus in a Ministry to regularize his suspension period. Now why was he suspended? The Chief Minister had come on pre-election tour in various Districts as a pre-poll gimmick & had received some public complaint about the Department of this Officer. CM came back & without so much as even bothering to check facts gave orders for placing the officer on suspension. The IAS Officers swaying to the tunes of politicians did not intervene. Why would they? he did not belong to the IAS. Their job is to protect only their own IAS Officers even if such officers have a proven track record of corruption & bribe taking. The hapless officer approached CM Office & wanted to explain that he had been posted in that Department barely two months back & cannot be held responsible for past laxities. The officer was sure of himself as he is a competent officer. Unfortunately to be on the safe side & earn some brownie points his Chamcha Reporting Officer gave him below Benchmark ACR & also recorded adverse remarks of Chief Minister. Anyway that CM lost elections & officer was reinstated after 3 months & transferred again. No charge sheet was issued to him, no charges pressed yet his promotion was affected. He had done nothing wrong, a hard working Officer who followed the rules & therefore did not have God fathers. He made several rounds but no one listened to him, frustrated the Officer appealed to President of India little realizing that even the mighty President of India is helpless & can operate only through our IAS & CSS Babus who both are born with divine rights of Kings. Now the CSS Babus & IAS Babus would humiliate him on daily basis as if he had committed some crime & he had to bow in obeisance because they wielded powers on behalf of President of India & President of India was unaware of misuse of its name & authority. After reading his Appeal CSS Babu looks through him with a straight face, no emotions reflected & tells him, ?you see once there is blemish on career it is impossible to clean the blot. I want to help you but this is very complicated case. Had you worked hard & lived upto expectations of CM, such a situation would not have arisen. The Officer has now left the matter to God. CSS Babu has no idea about stress & strain of field postings, frequent transfers, and dislocation as it takes at least 3-6 months to fully grasp working of new office. The IAS Babu above him had never worked as a Deputy Commissioner in a District, nor had he worked as a Commissioner of a Division & had managed safe headquarters posting & deputation in central Ministries. One of the post occupied by our IAS Babu was Special Secretary (Rules) in the State Government for two years. Therefore the Officer has now surrendered completely to GOD. In him alone we trust.

For Whom the Bell tolls ?

Please remember no one controls CSS it is the CSS which controls everyone including IAS Babus & Politicians. The all powerful, omnipresent, permanent Gods in Ministries. Now at last after a lot of dilly dallying the DOPT has put up the list of defaulting CSS Officers who have not submitted their property returns.

(i) As per DOPT O.M No. 22/5/2009-CS-I(PR) dated 22nd November 2010, about 1182 (02 - Additional Secretaries, 24 - Joint Secretaries, 150 - Directors, 207 - Deputy Secretaries and 799 - Under Secretaries) Officers of CSS have not submitted their immovable property returns for the year 2009. This list excludes Section Officers and Assistants.

(ii) what is the cadre strength of CSS Service? As per DOPT website information total cadre is 1840 posts excluding Section Officers and Assistants. Thus only 658 officers have submitted their property returns.

(a) Directors - 110,

(b) Deputy Secretaries - 330

(c) Under Secretaries ? 1400

(d) Section Officers - 3000

(e) Assistants - 4905

TOTAL - 9745

(iii) Now as per DOPT O.M No. 19/1/2008 CS I(P) dated 20th July 2010, all those CSS officers who are empanelled as Joint Secretaries, will be given in-situ promotion as Joint Secretaries in SAG grade at their current place of posting, till they are placed under Central Staffing Scheme, with such in-situ promotions restricted to 40 in number. As a result the combined strength of Joint Secretary (in-situ), Directors and Deputy Secretary of CSS will be fixed at 600, with inter se flexibility subject to a ceiling of 40 posts for Joint Secretary (in-situ) and 220 posts at the Director level. Now who will bear the brunt of this benevolence to CSS? The Net increase of 160 posts at DS/Director level in CSS will come from diversion of posts from the Central Staffing Scheme. Thus while the IAS Babus dominate Joint Secretary & above level posts in Ministries & are not affected, it is the Director level posts against which other services & Central Services were getting a chance to break into this coterie of favoritism & vested interests.

(iv) Unfortunately these IAS Babus & CSS cry hoarse when their in-situ promotion is delayed by even a day & walk around with gloomy faces & since politicians are such cowards as they stand weak & exposed before these two services therefore they fall head over heels to placate these services because they do not have guts to take a stand & do their bidding. The day will not be far when these politicians will have to bear the combined wrath of all marginalized services. All that is required is to take a united stand & fight against such injustice & favouritism.

IFS officers have done a very good job in forestry and they are recognised world over. However, of late there was tendency to post non performers by the biased people so lot of resentment. The DG selection was marred by those elements who wanted to perpetuate rule by proxy with those who had no research experience. It is Jairam Ramesh who is setting things right and this news is the handiwork of those who wanted to capture the post. Now international level Sceintist MS Swaminathan and Kasturirangan have been roped in by the dashing Minister Jairam Ramesh to clear the muck created by these people. Hope good things will happen now. Your website should not give any importance to news like this. Now the days of poor performers and jokers are over in MoEf. The first sign is the posting of new Secretary Chaterjee who is minnion tons heavier in all respect than the dubious tenure of his predecessor whose only claim to fame was to post his cronies to key positions and divide the Ministry officials and promote corruption. Do away with services of consultants

To complete the picture of the central secretariat, apart from the deputation mafia, the gang of retired officers in the garb of consultants must also be added. It is shocking that even offices like that of UPSC are engaging them in large numbers and entrusted them with the disposal of work relating to statutory functions such as advice on disciplinary cases. This is causing tremendous harm to the system without the affected delinquent officers ever coming to know about it. After showing favours to delinquents falling within their self determined quota based on their greed, they reject all other representation, petitions etc. It is high time that full complement of regular manpower is provided to the commission's secretariat and consultants services are dispensed with at once. Consultants who are beyond the orbit of disciplinary powers of the government can never be expected to do justice.

Will the Indian middle class do like in Egypt ?

Why is it that in our system the same type of scams/scandals keep on repeating that too in the same departments. For example we had a telecom minister who was arrested while sleeping with the cash under his bed. But his successor instead of correcting things continue to follow the footsteps of his esteemed predecessor. Similarly we had one Chairman of Punjab Service Commission arrested for corruption in recruitment of PCS officers. However his successors instead of correcting the bad perception of the institution continue to follow his policies and even today the recruitments made by PPSC are questioned in vigilance inquiry. Same is the case with Haryana Public Service Commission. Have we come to a situation that where even the basic lessons from the history are not being learnt and our hunger for money has killed very basic tenets of human existence? Will the Indian middle class ever shoulder the responsibility of nation like their counterparts in Egypt or we are now totally bankrupt ideologically?

Yes it is harassment by AO of Income Tax to Naryana Moorthy. There are hundreds of rules which you can invoke whenever you desire. Can any AO question about thousand politicians where large amount of money is available for appropriation. The income tax authorities can only harass salaried persons or small professionals asking unnecessary questions and raising objections. I am not clear what they gain from this only some small amount of money and mental satisfaction to raise objections.

Loathed & detested Finance and account personnel

Seeing the comments about the Postal Department, I am compelled to say that Finance & account personnel are loathed and strongly detested. The DOP is a dept full of accounting irregularities which are committed by the Postal Operations personnel headed by the IPoS. The normal practice is to have FA's one step below the administrative heads like in Telecom & Railways. But in DOP the CPMG of HAG rank is advised by a JAG/NFSG and in fields where the PMG's who are SAG level are advised by an AO who is Group B. Reports of committees headed by IP&TAFS regarding restructuring of Finance & Accounts system are put in cold storage by the Top brass in DOP instead of Forwarding it to MOF.

The MOF,C&AG,DG P&T Audit should look into the following-

1.There should be FA one step below to the Executive in circles and Regions.

2.Savings Bank(SB) &PLI accounts, CC are all in a mess resulting in excess payments without any check and control.

3.Software Programmes are developed for Accounts but without taking into consideration feedback or opinions of the Accounts personnel who are supposed to handle these programmes. SW Programmes are purchased they are not compatible and are dumped after few years and again the cycle of purchase starts.

4.Examine all the Consultancy Contracts, a potential area for corruption and kickbacks.

5.Examine Purchases-hardware and software. PC'S Printers, Gensets are recklessly purchased and dumped, without being used.

6.Examine whether Project Arrow has yielded any Revenue for the Department, it's become a golden cow with money flowing and corruption following.

Since the Department is always out of focus, it helps Corruption to thrive and financial rules are flaunted with impunity and they ensure that the Finance is never strengthened and the Reports for additional IFA posts in all Circles and Regions never reach MOF.

Ethical governance deficit !

Dr Mehrotra is asking his question so innocently that I am tempted to attempt a possible reply. The Home Minister or rather Chidambaram, is only echoing what all the contributors to the whispersinthecorridors.com have been writing all these years. It is not only deficit of governance or ethics, but ethical governance in totality. There are two governments, two councils of ministers, several committees or commissions over ministries/deptts, whose work they are doing for the PM. In fact, there has been no governance in the past 7 years, only wheeler-dealers have a field day. Rules have been broken more violently than ever, service tax(sorry-corruption) has replaced the system, institutions compromised(ISRO being the latest casualty). The number of cases in the courts is not getting reduced, even though litigation is the last choice for the aam aadmi. It speaks only for the injustice suffered by the aam aadmi, who seeks justice from the courts, having been disappointed by the government. Chidambaram's interview is timely and change in the climate is beckoned by it. Time for the wise to reposition themselves, in case there is some political upheaval in the near future. The question is: who after Man Mohan Singh? Or even, what if NAC is dissolved? This is for the first time that the Leader of the House and the Prime Minister are two different persons. More than that, there are three of them: the President of the Congress party. There used to be a time when one was equal to three. Now even three is not equal to one! Political developments in the coming weeks are worth watching. For when politicians start talking "ethical", it is a presage.

Stop lecturing, show results

P Chidambaram?s statement (during an interview with the Wall Street Journal) about ?Governance? and ?Ethical? deficit is a serious indictment of the Congress-led UPA government headed by Dr Man Mohan Singh that has been ruling the for about seven years. Is he not aware of the concept of collective responsibility of the political executive that includes him as a senior minister? It seems either the PM or HM is on the way out? PC forgot that he was neither in the opposition's nor in Finance ministry. He made the puerile remark against his own government at the behest of the captains of the corporate world? Is PC entitled to pass judgment on UPA's performance when he himself contributed to corruption while pushing through the appointment of P J Thomas as CVC , violating all norms of propriety by bulldozing the ?dissent? of Sushma Swaraj as the Leader of Opposition? The Aam aadmi of the Congress manifesto expected the Home minister to clean up the augean's stables instead of indulging in the luxury of senseless rhetorics. The fact of continuous moral decay under the UPA regime is too well known to need reiteration. What concrete steps were taken by P Chidambaram as the former FM and now HM? The black money remains stashed in tax havens. There is no transparency in the appointments in GOI at higher echelons made by the ACC that includes HM as a member. No prescribed criteria are followed in transfers and appointments of officers. It is simply arbitrary and discretionary. Orders of the extra-constitutional de facto PM are merely translated by the de jure PM. Merit is the obvious casualty. The same set of officers with the support of politicians, business houses and the builders? mafia, are returning to the Centre frequently from the States? cadres to coveted ATM ministries without completing the mandatory cooling off period. There is a deputationist's mafia, as some browser had pointed out in these columns. The corruption in NCT Delhi, local bodies, Delhi Police, para-military forces, the internal security and other wings of MHA is an open secret. The law &order situation in Delhi has reached its zenith with rapes, looting and murders being committed with zero accountability. All higher level appointments in NCT Delhi and its associates are made by MHA. Instead of addressing these concerns, PC is trying to divert the public attention by sidetracking his allocated responsibilities by massaging the ego of the corporate world. One could feel his growing frustration after exit from M / Finance. Let him stop lecturing and prove his worth in carrying out his allocated responsibilities.

Tahrir Square has come to symbolise freedom

The 18-days protests there by all and sundry-men, women young and old rich and poor presented such an awesome unity. A nation united against the authoritarian rule of Hosni Mubarak who suppressed them for three decades. There are lessons in the Egypt uprising for all those who take the people for granted and enrich themselves at the cost of their people. While middle-east could soon be in turmoil, lessons cannot be lost on corrupt democracies of our part of the world. We know what is happening in our own country. One scam after another is making headlines. The mafia like nexus between the politicians, bureaucrats and business is looting the exchequer. The figures of loot are mind-boggling. How long can people tolerate this. We can say that in our scheme of things elections give chance to the people to change Government. Yes if only these are absolutely free and fair. But 5-year is too long a period to let our elected robbers loot us right and left. Let our politicians learn a lesson or two from the events in Egypt. Egypt story is inspiring but there is also a danger of its being cited as a wrong example by those who wish to break away from the country. Already the separatists and foreign funded elements are making this reference point in Kashmir. We have to be vigilant not to let monocracy take over in our troubled spots in the name of 'freedom'.

Minutes of DPC in sealed cover

The Commission directed to provide (i) the marks awarded by the DPC to the Appellant under all heads, if necessary by opening the sealed over in which the evaluation sheet for this particular DPC has been kept;
and the (ii) photocopy of the action taken report including the file noting concerning the disposal of his representation dated 19 January 2010 addressed to the UPSC.

Comments

Sealed cover proceedings no longer enjoy absolute immunity from disclosure. The procedure of 'sealed cover' needs to be re-visited to evolve a new mechanism to deal with the current realities.
