Assam government sticks to its guns
As the grapevine has it, the Assam government has decided not to send fresh names as far as selection of new Chairman of ea Board was concerned. The Assam government had forwarded four names. PPP big wigs stunned by Qureshi's statement in NA
In the midst of rising controversy surrounding the Raymond Davis case in Pakistan with mobs demanding his public hanging and the US government warning Pakistani authorities that they are squarely responsible for his security, Pakistan's former foreign minister Shah Mehmood Qureshi stunned the political circles by his statement in the National Assembly on Tuesday that the case was mishandled in the government and 'he should not be forced to disclose the names of those responsible'. Higher political and bureaucratic echelons within the government are busy guessing the names Qureshi might blurt out. Absence of transparency in promotions leads to sycophancy in PSUs

It was reported in WIC that in BHEL promotions from AGM to GM are being delayed because influential people want their persons to be promoted.

This speaks of the rot in PSU promotion system at AGM, GM, and ED level. Manipulability in promotions, leads to sycophancy and promotes corruption because officers at this level always have to bend to and please the bosses by any means.

A member from the administrative ministry in the DPC serves no purpose because there is no transparent promotion policy and such member goes by tradition i.e. to accept the promotion list suggested by PSU managements.

There are no protests because officers at this level are terribly scared of management (read Board Members) because in the absence of a transparent promotion policy management can mar the career of any officer almost forever.

It is high time DPE should review the promotion list of this level of officers in Navratnas and Maharatnas and instruct PSUs to make basis of marks awarded to each candidate known to them.

WIC has been taking up cause of Government officers. It is requested it should take up cause of PSU officers also, who are about 8 lakh in numbers (officer- staff ratio is high) and face too much arbitrariness in repeatedly being left out in their promotion. They are too afraid to speak up. Promotions at this level are not transparent at all, and there is outright high handedness,

Can the system change?

I have been thinking for a very long time as to the reason why some Officers are very arrogant while others are humble & polite. Such a trait has been observed across all services. Why have standards fallen? When Officers are selected by the UPSC they are all initially young eager officers' desirous of making a difference & want to overhaul the system & bring in improvements. Those who are first generation Civil Servants are the ones who boldly venture out & stick to their convictions & face all kinds of odds because of ignorance of hardships to come. Unfortunately these first generation officers are the ones who do not have any safety net & nobody to protect them & except for their honesty of conviction & determination they have nothing to support or back them. It is this category of conscientious Officers who are most hard working & upon whom the efficiency of the government actually rests. These Officers are humble & listen to the public grievances; they take initiatives & tirelessly work but are low profile & do not flaunt their achievements as a result there is a situation of jungle mein mor naacha kisne dekha? It is essential to blow your own trumpet loud & clear but coming from humble backgrounds they are the bold ones who take on & fight an unjust system because they had struggled against & been victims of this unjust system prior to their selection.

During two years Probation the young Officers start observing things around. On one hand they see honest hardworking but poverty stricken officers from economically weak backgrounds being kicked around. On the other hand they see easy going well connected Officers whose fathers & relatives are big men & woman of high position & have an easy going life for whom one telephone call is enough to settle any issue to their satisfaction. Be it managing transfer posting in Metros throughout career or deputations, selections for foreign trainings etc all is managed through sifarish. These are the royal class amongst Officers. The third & majority category of Officers are those who find it safe to blindly side with the bosses/powerful politicians/industrialists etc & angle for all kinds of favours & are members of powerful existing coteries & help each other by doing each others work. The Probationers look at their meteoric rise & comforts enjoyed & manner in which their careers are forwarded & their interests protected by these coteries of strong vested interest of senior functionaries.

Thus junior officers coming out fresh from the training centres are quick to choose the path. On one side they have officer who has strongly defended the government's interest & taken a stand & hence the common mans interests have been safeguarded but who has incurred wrath of his superiors is fingered, kicked around & frequently dislocated & given bad postings, implicated in false & petty nature of cases, given charge sheet on false grounds deliberately knowing fully well that the Officer can be kept busy in this way & will be pre-occupied in defending himself for years together as Disciplinary cases linger on for years & never mind if after all this long exercise the charges are not proved because even if he is let off the damage has already been done & career ruined. On the other hand young Probationers see good for nothing officers who do not take any decisions, play safe, are totally inactive with closed minds & are so focused that they do only that which boss asks them to do. Well going by the present state of affairs it is clear which path majority of young probationers will choose. Only the unwise will choose the path of struggle & toil.

Is it possible to withdraw discretionary powers?

Apart from a deputation mafia operating in GoI there is also an assortment of after retirement asylum posts of consultants, advisers & heads of various committees etc thrown in as bait for gullible, bending, crawling Officers who spent their career in obediently proposing on files & becoming his master's voice without any application of mind. For example in the Ministry of Urban Development itself around 65 consultants were appointed under JNNURM etc. However the Media avoids highlighting such negative facts because the Ministry has powers to distribute largess like Government accommodation in prime locations to its favoured journalists from private sector. Will the Ministry have the guts to withdraw this facility completely & restrict allotment of Government accommodation to eligible Government Servants only & not start cultivating a breed of chamcha journalists from private sector who are taunted as sarkari journalists by even their own colleagues & have no credibility left. A dedicated bureaucracy has been achieved & so has a dedicated retinue of journalists in private sector by distributing largesse which is not their due. Will the government allow its own government officers who have not been allotted houses due to shortage of accommodation to accept accommodation from large industrial houses? Then why it is selectively favouring a handful of Journalists from private sector? The CAG has pointed out in its Performance Audit - Report No. 6 of 2009-10) 2007-2008 in respect of Land & Development Office, Ministry of Urban Development. Para 9.5 states that L&DO had allotted land to nine Presses in Bahadur Shah Zafar Marg. The outstanding dues are given as under :-

(i). M/S Express Newspapers Private Ltd. - Outstanding dues Rs. 400 Crores,

(ii). Daily Pratap - Outstanding dues Rs. 12.72 Crores,

(iii). M/S Gulab Singh & Sons Pvt. Ltd. - Outstanding dues Rs. 12.00 Crores,

(iv). M/S Associated Journals Ltd. (National Herald) - Outstanding dues Rs. 2.89 Crores.

TOTAL AMOUNT OF LOSS - Rs.427.61 Crores.

Thus despite inefficiency and corruption in the Directorate of Estates nothing negative is highlighted. Every file related to out of turn allotment of accommodation is a scandal in itself and if the CVC or CVO scrutinizes such out of turn allotment or change of quarter's file the irregularities & breaking of rules will be evident. But since the CVO system is defective because the Ministry does not have a separate CVO & the concerned Joint Secretary is handling the administration of Directorate of Estates as well as looking after vigilance thus question of anyone pointing out any lapses does not arise. The administrative authority & vigilance authority is same. Instead of strengthening CVO of Ministry it is more advantageous to have part time CVO in main Ministry & close your eyes & full time CVO in CPWD & DDA. It is correct observation that not a single CVO has ever caught any corrupt action. The CVO post is merely a temporary resting place for deputationists wanting to extend their stay in Delhi.

Blocking the vision of effective & progressive administration

" I would like to brief you that PS Association is not writing copious letters. They have been trying to wake up the establishment from their deep sleep. I must also inform that PS Association had written number of letters to the DoPT but not even a single one has been answered by DoPT. PS Association, through their letters, has only been requesting the DoPT and other Government Departments to stop selective implementations of the 6th CPC Recommendations which have been accepted as a package by the Cabinet and Notified through the resolution dated 28/2/2008. PS Association has been stressing for versatile use of PS, who could serve the establishment in a better way. This would not only provide the Government with multi talented people but also save lot of tax payers money. But the biased interpretation, red tapism and greed for power are blocking the vision of effective & progressive administration".

Extend tenure of Chiefs of two Revenue Boards at two years

The tenure of the Chiefs of the two Revenue Boards needs to be two years. This would be in line with tenure given to Director CBI. It may be recalled that even when the Chairman CBDT was an Additional Secretary post, the Chairman did not report to the Revenue Secretary. It was only when the post was upgraded to Special Secretary, a new reporting channel through Revenue Secretary was introduced. So the status quo ante may be restored without any problems.

The question of retirement age at 62 or 65 may be answered once and for all in the Budget to make way for funds for implementing NREGA and Food Security.

Absurd relation - retirement age & inflation

With the advent of Budget session, the outlandish pleas for increase in retirement age of government servants have started. A few wise souls have even linked with increase in retirement age with reduction of inflation!! Nothing can be more cockeyed and absurd than this. The need of the hour is to get fresh induction with young men and women with open mind and ideas than the half-witted inane jonnies who are occupying the positions for over 30 years with little or no work, particularly at group B and C levels. Any proposal for extending their tenure for two more years will be disservice to the nation and will push back the government work at least by five years.

CSSS - Future of Feeder Grade (Steno Gr.'D')

Recently The Cabinet approved cadre restructure for CSSS as done in the past in 1993 and 2006 with the main intention of providing some relief to Gr. 'D' Stenos which is the feeder grade and are stagnating in the same grade for more than 25 years. Although Grade 'D' stenos of 1983 batch were promoted from 1993 on ad-hoc basis only, but unfortunately, nothing happened till now and their services are still not regularised. Now also, it appears that PPS and Sr. PPS posts have increased and will also be promoted, but there is no increase in the number of posts of Steno Gr'C' (PAs), but only posts vacated due to promotion of PSs and PPS will go to them. This time also the main motive behind the whole exercise, i.e. providing relief to stagnating Gr 'D' will not be served as still those promoted in 1993 will hardly get regularised and even if regularised, they are on ad-hoc for more than 15 years without regularisation. Now nearly one and half month has elapsed but nothing has happened till date. Again, it seems Steno Gr 'D' will be left where they were only to work as a subordinates to these "British PPS/Sr.PPS officers" for sitting late for a small salary and help in all their duties and get them Outstanding grading and will be given Average/Good grading. The faulty system is responsible for their equivalent UDC, who even junior to Steno 'D' have been promoted as regular Assistants and some have become SOs; and probably the poor steno D will remain where they were. WILL DOPT wake up to help the poor Gr 'D' Stenos?

Why Cong chose embarrassment ?

There was king who gave punishment to a convict to choose to eat either a bucket full of onions or a bucket full of cowdung (gobar). He was happy to choose onions.

After eating two-three onions eyes were bleary and he could not bear the taste. So he thought may he will try gobar. After eating a little bit, he chose back to onion. Then again gobar. Finally he ended up eating both. So congress had to concede CBI inquiry on Raja, Kalmadi and others, as well as it conceded on JPC. Those in know wondering why it did not concede to JPC in the first instance as that would have saved it from lot of embarrassment and all these inquiries.

Revivalism or Transformation ?

We dreamt of equality, justice, liberty, fraternity and dignity. Those who inspired us to so dream were men and women of high moral character, vast knowledge and enormous wisdom. They were the great Indian freedom fighters. They were the great Indian leaders. They were great Indian thinkers. Why am I using were instead of are? I am just one among lakhs of us who are using it. It is because deliberate efforts are being made to resort to revivalism. Revivalism of the pre-dream order; revival of the regimes of the Shahanshahs, the Nawabs, the Maharajas and the Laat Sahabs. India is being violently pushed into inequalities( couched in constitutional jargon). Liberty is being curtailed through legislation or implementation of legislation. The number of cases in ourts bear abundant testimony to the injustice suffered by the people. Venom is being spewed to divide the nation on communal lines. Trust deficit is proved by setting up separate ministries to cater to the specified segments of the nation as if the government is incapable of meeting their aspirations. The language used and the treatment meted out to dignitaries or the common citizen is infradig. Physical and verbal violence is common in the elected bodies or on the streets. In fact, the very concept of a nation is under threat? Kashmir is just an indication but attacks on persons from one state in another is on the rise. The status of law & order generally is no less disturbing. Officers are humiliated and kidnapped. The federal structure has become so centralized that even the Indian Prime Minister feels helpless. His defence that he is not as great a culprit as is being made out and awards himself 7/10 marks. That was not the case when India practiced democracy, but revivalist forces have regained their territories lost to democracy and are more powerful today than they were earlier. Today they are a formidable and united force. So India today stands divided and stratified. So much conflict has been injected into its socio-political body that it will not be easy to dream of the nation that the constitution of India talks about. The India conceptualized by the constitution was a plan to transform ancient India into a modern vibrant democracy. Our feudal structure built in less than 40 years is the opposite of all those concepts of Transformation. It was my fervent hope that in the 2nd decade of this 21st century , the government would do something concrete to strengthen that plan of democratic India. But all that the President said in her address to the joint session today was: We are blessed with the benefits of democracy. Our founding fathers gave us institutions, conventions and practices that have stood us in good stead. We owe it to ourselves and to the coming generations to strengthen these institutions, conventions and practices so that our future as a strong, free, prosperous and democratic nation is assured. I offer my best wishes to all of you in this endeavour?

It will be an achievement of great value if we can deploy Leaders, who would fulfill the hope of the President.

Prosecution record

Copies of certain documents were denied to the Applicant claiming that it consists of analysis of evidences by various decision taking authorities and their opinions thereon which has the potential to influence these evidences and to interfere with the proceedings of the court wherein prosecution of the Applicant is already under process. The Commission noted that copies of the relied upon documents submitted by the Respondents to the Court have already been provided
to the Applicant by the Court and that there is no order from the Court not to disclose any further information available with the Pubic Authority. The Commission directed to provide the documents after severing those portions that are exempt from disclosure under any of
the sub clauses of Section 8(1) of the RTI Act.

Comments

Public Authorities tend to avoid disclosure even after the filing of the charge-sheet, on various pretexts. With the filing of the charge-sheet which marks the end of the investigations, the documents should no longer be held as exempt.
