RTI

Inspection of records
The PIO had first given a date and time to inspect the records and then did not facilitate the inspection. The CIC held the PIO responsible for harassing an RTI applicant by first fixing a date and time for inspection and then not facilitating the same. Under section 19(8)(b) of the RTI Act, the CIC awarded a compensation of Rs. 2000/- to the applicant for the loss and humiliation suffered by him.
Comments
Before fixing an appointment, a PIO should ensure availability of records and any other requirements for inspection, lest there be a charge of dereliction of duty. A PIO must honour his commitment and abide by the responsibilities under the RTI Act.

Congrats for holding your head high: WIC & Dr Mehrotra
The year 2010 brought disgrace to many big shots & media personalities. The Whispersinthecorridors.com continued to maintain its ethical standards high even when others gave in for the charm of money or influence and specially Dr Suresh Mehrotra, the Editor-in-Chief, who proved the point that it is possible to be honest even in the most trying times. I am reminded of the famous lines of Late Dr Harivansh Rai Bacchan: "badnaam rahe ho mandir bhi, yeh to thahara madiralaya...".Practicing honesty in the Indian context is tapasyaa, sadhanaa or yog. Even then I would wish the WIC continues to serve the cause of clean administration and governance in India under the devout leadership of Dr Mehrotra. It inspires many surfers to give their best in public service, without caring for personal losses. Happy New Year to all!

ENOUGH IS ENOUGH. NOW TAKE CONCRETE STEPS TO CLEAN THE SYSTEM

1. The best way in which corruption can be routed is by making appointments to all posts clean, transparent, logical with no arbitrary powers or vague discretionary powers in recruitment.

(a) There should be no after retirement appointments because officers tend to become sycophants & jeopardize the interests of whichever department/organization they are heading in exchange for getting extension in service or after retirement job.

(b) All posts of Consultants and Advisers held by retired bureaucrats need to be abolished at once as vested interests have invented these posts for their own benefit & these are a drain on the exchequer. Retired Officers lobby for such posts of Advisers & Consultants so that they can enjoy car with driver, government house facilities etc & go about lobbying for another extension or post. Such Officers appointed as Consultants & Advisers are an insult to the capability & competence of serving officers & raise a question mark on their efficiency & ability to take on responsibility & decide matters or is it that these serving officers are busy lobbying for a post retirement placement & thus the government has to employ consultants & Advisers to do the work?

(c) Only serving Officers should be working against all available government posts. For example there are posts of Secretary equivalent posts against which retired IAS officers are working whereas there are a large number of serving IAS Officers who have been promoted as Secretary but for want of posts continue working in same post as re-designated as Special Secretaries & searching, waiting for posts.

(d) The Chief Justice of India should retire from service & not taking any posts like Governor or NHRC Head etc. For example if the senior most judge fulfills all criteria & becomes the Chief Justice of India then the second senior most judge should become the Chairman of NHRC incase he fulfills the criteria. This will ensure the impartiality of these judges & they will not bend backwards before Ministers etc for appointments & post retirement placements like endless Commissions of Inquiries etc. For example some Committees headed by Judges were given numerous extensions & they gave their reports after 5-10-15 years much after the subject matter of Inquiry had lost relevance due to long passage of time. While the country lost by way of not getting a Report on time & being saddled by huge expenditure these retired Judges gained by retaining all facilities like personal staff & office, government accommodation, car with driver etc which expenditure runs in Crores.

(e) The incumbents holding such high position like Election Commission of India should be debarred from joining any political party or post of Minister etc because it raises a question mark on the impartiality of the incumbent while he was holding the post of Chief Election Commissioner, like has he been rewarded for toeing the line of the party in postion, did he favour particular party etc. The credibilty of such posts need to be restored.

2. A systemic review of all such posts in which bureaucrats who have outlived their utility still clinging on to positions due to their clout, sycophancy & ability to manipulate the system needs to be carried out & all those who have completed their expiry date need to be weeded out. Have you not observed retired Officers preening & prancing & trying to appear attractive & all dressed up as potential candidates for re-employment when they appear in Television debates mouthing safe inanities & trying to attract attention. If youth is to be given a chance then let serving Officers be given priority in all available post so that accountability can be ensured & responsibility fixed and it will bring to an end the time wasting pre-retirement lobbying & playing safe mentality of Officers.

The ongoing loot of public money mentioned in this forum is not confined to the telecom deptt alone.Other deptt of that ministry,Postal deptt got infected with it around the same time.Postal deptt hired govt hall of TFAI in Pragati Maidan through a private party,Wisitex Foundation in March 2ooo for holding Postech Exhibition.Finance advice was systemetially bypassed and whistleblowers tortured and punished,as per the usual practice.
