So if Kalmadi can get the people he owed money to give statements he can prove he suffers from forgetfulness... one of the symptoms for dementia!!!!

Maharashtra Govt meets supplementary demands from Contingency fund
The finances of Maharshtra government are in such a bad shape that it has to meet the supplementary demands of various departments by dipping in the contingency fund. The coffers of the state government are empty and out of the Rs 3000 cr demand , only Rs 2000 crore worth of supplementary demand could be met, say sources in finance department.


MHADA to take action against defiant builders
Nearly 33 builders have duped the MHADA ( Maharashtra Housing Development Authority) for the redevelopment of old buildings. The state government is likely to take stringent action against the builders soon. The builders promised redevelopment but have delayed construction and in some cases not done any construction and have acquired the premises, said a builder.

Pakistan : federal secretary penalised for compliance of apex court order
Pakistan's establishment secretary Sohail Ahmed has been sidelined as OSD in the same ministry apparently for complying with a directive of the supreme court. The matter pertains to a senior police officer Hussain Asgar who was transferred from the federal investigation agency (FIA) as IG Gilgit Baltistan after investigations being supervised by him in a politically sensitive Haj scam case seemed leading to the PMO. As the case is being monitored by the apex court it directed the establishment division to bring the police officer back to the FIA and when compliance was not forthcoming a contempt notice was issued to the establishment secretary. Submission made by the secretary during his personal appearance on Tuesday that the proposal for compliance of the court's direction was pending consideration of the 'competent authority' irked the court and he was granted a few hours to produce the government order or 'face the music'. Poor secretary had no option but to produce the concerned transfer order in the court but the federal government removed him from his post within a few hours for 'violation of the laid down procedure'.

Uncertainty over FMC Chairman looms (UPDATED)
As the grapevine has it B.C. Khatua who was re-appointed as the Forward Markets Commission (FMC) Chairman last year and is due to complete his one extended term on July 31, 2011 is unlikely to be spared from FMC. This hinges on reports pouring in from different corners which suggest that K. V. Thomas Minister of State (Independent Charge) in the Ministry of Consumer Affairs had indicated about it. K.V.Thomas who is in Chennai will be back to Delhi on late Thursday evening. Khatua is an IAS officer of the 1976 batch who belongs to the Maharashtra cadre. Just in case Khatua was not re-employed then Ramesh Abhishek (IAS, 1982 batch Bihar cadre) may get officiating charge as he is already there in FMC as a Member.

Indians are a depressed lot

The report that almost 30 percent Indians are suffering from depression is a cause of concern and needs further study to understand why this is happening. This is perhaps the right time to look at building the case for promoting mental health ( sadly neglected). The role of impact of school education system, changing social norms ( due to social media..), internet/tv revolution..that largely sell negative stories or pornography needs to be investigated. Also, there appear regional disparities with places like Pondicherry having unexplained but highest prevalence. GOI should set up a GOM under the Union Health Minister to look at the health and other social dimensions that are leading us to become a unhappy lot.

Political dementia a robust defence

Kalmadi is likely to sing under interrogation and cross examination. Whatever he had done was done to serve other hidden individuals for whom he played just a stooge. If he blurts out the names of the real beneficiaries of his doings, it might pose grave danger to those elements. He being in judicial custody can not be handled like the few others silenced differently. So the shield of dementia will give that escape route. Even if he were to give out names now, it will be alleged that he suffers from memory loss or cognitive capabilities and hence his testimony can't be relied upon !!!

RTI

Claiming exemption as the third party

Certain information about a property assessment was refused by the PIO claiming that the owner of the property had opposed disclosure of the information to the applicant. Since no grounds were advanced as per Section 8(1) of the RTI Act to justify the denial of information, the Commission did not accept the objection of third party and directed to provide the information.

Comments

When a citizen applies for information which has been provided by or is related to a third party, it can be denied only if it is exempted under Section 8(1) or Section 9. Section 11 merely requires the PIO to seek the objections of the third party and keep them in view while deciding whether to release the information as per the provisions of the RTI Act. Many PIOs fail to do so even 5 years after the enactment of the RTI Act due to ignorance and lack of proper training. The third parties too remain ignorant of their rights and fail to defend their case.
