As the grapevine has it B.C. Khatua who was re-appointed as the Forward
Markets Commission (FMC) Chairman last year and is due to complete his
one extended term on July 31, 2011 is unlikely to be spared from FMC.
This hinges on reports pouring in from different corners which suggest
that K. V. Thomas Minister of State (Independent Charge) in the Ministry
of Consumer Affairs had indicated about it. K.V.Thomas who is in Chennai
will be back to Delhi on late Thursday evening. Khatua is an IAS officer
of the 1976 batch who belongs to the Maharashtra cadre. Just in case
Khatua was not re-employed then Ramesh Abhishek (IAS, 1982 batch Bihar
cadre) may get officiating charge as he is already there in FMC as a
Member.

Pakistan : Supreme court to the rescue of
establishment secretary
Pakistan's supreme court on Thursday expressed its unhappiness over
the manner in which the federal establishment secretary Sohail Ahmed
was sidelined as OSD in the same ministry by the government within hours
of his complying with a directive of the court and gave one day's time
to reinstate the officer in his original position. The Advocate General
Maulvi Anwar ul Haq has been directed to convey the directive to the
PM, appear before the court on Friday and submit in writing the PM's
reaction. 'If the court passes an order no approval of any other authority
in the executive is required for its compliance' the bench declared.

SAIL Q1 turnover up by 20% (UPDATED)
The unaudited financial results of Maharatna Steel Authority of India
Limited (SAIL) for April-June (Q1) of the current financial year, showed
19.7% growth in sales turnover at Rs. 11,891 crore, over the corresponding
period last year (CPLY). Responding to this, SAIL Chairman C.S. Verma
said: "With coking coal prices expected to moderate in the coming
months due to stabilization of production in Australian mines that were
affected by floods, we are hopeful that our cost burden will ease in
the following quarters of this financial year. Also, though steel prices
have remained stable and demand for steel subdued so far, we are looking
at domestic demand growing progressively in the latter half of FY '12."

for Retirement benefits of employees of CPSEs who had retired before
1.1.07 and one of the sentence read as : It is clarified that scheme
should not become a defined benefit pensionary scheme".

CGHS facilities
I would like to raise this issue of CGHS facilities provided to the
Central government officers. It does not actually cater fully to the
requirements, for eg, if a test is required for a patient, a permission
from an officers' office becomes a necessity, despite the tests are
given from government hospitals. In weekends one has to buy medicines
from outside the CGHS dispensary. Why can't we have a simple card system,
the PSU's have for their employees and the bills could directly be sent
to the concerned authority for reimbursements. I just wish and hope
the government should come out with the scheme of cashless facilities
and it should be less cumbersome in terms of getting separate permission
for each and everything.

It is a 'medical problem' and no one should hide it. One should without
any delay and hesitation go to a Psychiatric Doctor, when he starts
suffering from Depression. Depression can take place in any one including
the 'Psychiatric Doctor'. A lot of dissemination needs to carried out
in this area of medical problem. The loss which you are causing to your
body and mind by not taking any medicine during the 'Depression episode';
is much more than the loss you are causing by taking some mild medicine.

This is in response to your whisper on IRS. My friend has regretted
delay in promotion as compared to IAS though he missed it by 3 ranks.
He should think of friends who missed civil services by few marks in
interview and joined bank or lectureship. Imagine their plight. As long
as all his colleagues are treated equally, he need not crib. He should
also see how many of these income tax and customs officers have grabbed
creamy jobs in mnistries and public sectors as compared to other sister
allied services. With whom he compares for promotion. Cum on you can't
have all.

Claiming exemption as the third party
Certain information about a property assessment was refused by the
PIO claiming that the owner of the property had opposed disclosure of
the information to the applicant. Since no grounds were advanced as
per Section 8(1) of the RTI Act to justify the denial of information,
the Commission did not accept the objection of third party and directed
to provide the information.
Comments
When a citizen applies for information which has been provided by or
is related to a third party, it can be denied only if it is exempted
under Section 8(1) or Section 9. Section 11 merely requires the PIO
to seek the objections of the third party and keep them in view while
deciding whether to release the information as per the provisions of
the RTI Act. Many PIOs fail to do so even 5 years after the enactment
of the RTI Act due to ignorance and lack of proper training. The third
parties too remain ignorant of their rights and fail to defend their
case.
