Sarkaar knew Ramdev was going to start a fast unto death at the Ramlila grounds so why was permission given in the first place for even a Yoga Camp????? And Sarkaar knew Ramdev's RSS connection!!! So what comes out .......Sarkaar was trying to create a rift in the Civil Society....... but then matters went haywire!! The general perception is Sonia and Mohna have once again bungled...... Sonia might try to distance herself from what's taken place but like they say ' I want to leave the blanket but the blanket does not leave me'......she cannot shake off the blame!!! And Ramdev's image has taken a beating too!!! Imagine he got schoolgirls to form a shield around himself and then he has the gall to say that Police were barbaric with women and kids...... had he bothered about those in the Pandal he would have not resisted arrest....... and then he tried to slink away least bit bothered about those who came on his call!!!!! What comes out is that the reception he got in Delhi gave Ramdev a swollen head and then he was misled by the RSS reps surrounding him!! And he's trivialized a serious National issue by demanding death penalty for the corrupt and black money hoarders and demanding declaring black money as National Wealth!! Had this National Wealth declaration been viable wouldn't have US done this and then US has the muscle power to recover what it has declared as its own from Tax Havens..... US battleships would have been 'threateningly parked' in Genoa ( Italy ..... Switzerland is land locked) after the decleration????? This declare Black Money as National Wealth was the brainwave of Govindcharya for whom practicability is something alien!! And then you have BJP trivializing the issue further!!! BJP held a day long Satygraha on Ramdev being sent packing and what did it do in the Satyagraha.....its leaders sang and danced.... or where they celebrating what they perceived as Congress's hara-kiri ?????

What now........ to damn Congress now Ramdev RSS will 'employ'!!

Have Anna and his lot got a touch of Politicitis after the meetings with the Congress Ministers on the Draft Panel????? Just a few hours before the eviction of Ramdev Anna's lot were showing their allergy to Ramdev!!!! Fact is they too doubted Ramdev's intentions….. his funny demeanor and non commmital attitude when Anna was fasting…… then Ramdev demanding PM be kept out of Lokpal's ambit ……….though later Ramdev said all that he wanted was a discussion (sic)…… then the special treatment he got from the Sarkaar…… Anna and his lot were convinced that Ramdev was a Sarkaari stooge and was being foisted up to take over the Civil Society movement!! I think after every Lokpal Draft Panel meeting all Civil Society members should bathe and meet for bhajan…… to ward off the ill effects of sitting in the same room as Congress's 'politically cunning and devious' four!! These lines from a Nida Fazli ghazal illustrate the phenomena of sangath or company..... achchi sangat baith karr sanghi baddle roop, jaise mill ke aam se meethi ho gayi dhoop...... paradoxically ……… boori sangath baith ke sanghi baddle roop, jaise mill ke durian (very obnoxiously smelly fruit) se aise laghe jaise dhoop smells of poop!!!

And even more when in one room there is Netas like Pranab, PC, Sibal and Moily ka confluence!!!

Seems in the month of June Gandhis get wonky!!!! History is a witness to this!!! Emergency (India got the tag of Banana Republic after Emergncy was declared and this taint still has not washed off totally), Operation Blue Star (the fire that led to Operation Blue Star was also kindled in June …….it was indeed insane to attack a place of worship when it was teeming with pilgrims on a religiously important day) and now this midnight eviction of those in the Ramlila pandal…….. why did they not call Ramdev to the Claridges again and arrest him and then they could have got the Ramlila Pandal cleared humanely…… without Ramdev there to incite those in the Pandal it would have been manageable humanely to evict them!!!! India and Indians have a lot to fear in the month of June if Congress is in power!!!! I feel it would indeed be good if the Gandhi family, if it's in power, took a month long vacation in the month of June...... in fact looking at what's happened I'm sure we (Indians) would not mind if they took the vacation at our expense..... how about spending the summer in cool climes in Europe !!!! What a 'Kodak Moment' it'll be..... Sonia and her brood all pink cheeked with Alps in the background!!

For Caesar it was Ides of March and if Gandhis are in power for Indians it's the month of June!!!

Gandhis going on a holiday in June if they are in power for India and Indians would be a boon!!

Rahul has found a new way to capture votes!!! He's going to use Bollywood Stars to make Congress win the 2014 general election!! Bollywood Stars have fans spread all over India and Rahul has his eyes on these fans!!! Rahul by getting pally with Bollywood Stars aims at making Congress popular all over India !!! He's already pally with Sharukh...... now he's become pally with Salman....... next on the list is Amir!!! And then he'll work his way down the Bollywood ladder….. right down to Rakhi Sawant (mind you she has her own fan following)!!!! Of course he will not befriend Big B and his family...... maybe at the nick of time Amar Singh will be pressed into action to cause a 'Big B and family fan purge'!!!! I think Rahul should also look at the TV Stars lot....... they are very popular too!!!!

SURVEY REPORT : Does ACC system have its relevance for all posts?
Does the ACC system has its relevance as far as appointment of incumbents for all posts was concerned? No. If one was to go by the views of the respondents to the survey conducted by the whispersinthecorridors.com. Majority of the respondents said that it was not only time consuming but ministerial arbitrariness, which politicizes bureaucracy to a large extent, also defeats the whole purpose.

While some respondents said that the whole exercise was a sham as its implementation lacks honesty and public purpose, others opined that the system has been exploited so much by vested interests that honesty, devotion to duty, functioning as per the law etc are no more virtues.

Add to it, several respondents said that the CSB should have the final authority on all appointments in the Central Secretariat even as the CSB should have one member each from the IAS and two from Central Services to ensure fairness in selection and afford other services a chance to serve the Centre on their own merit rather than on
extraneous considerations.

Pakistan : PAC and I&B Ministry at logger heads over Rs 3 billion secret funds
The Public Accounts Committee (PAC) and I&B Ministry in Pakistan are at logger heads about utilisation of nearly Rs 3 billion secret funds allotted under the head 'other expenditures'. While the Auditor General Tanvir Ali Agha carrying out a special audit of the ministry on the direction of the PAC is insisting for all details of the expenditure the I&B Secretary Sohail Mansoor has refused to disclose the details on the plea that such secret funds have been utilised by successive regimes for the past over four decades without ever sharing the details with audit. The argument seems untenable since as per rules the exemption from disclosure of details to audit is available only on certification from the Presidency and the I&B Ministry has been unable to produce the same.

ITI's Yearly loss reduced to all time low in Eight years

ITI Limited has reported a net loss of Rs.382 crores in the year 2010-11 which is lowest ever loss reported by the company in the last eight years, i.e. from 2003-04 to 2010-11. The net loss for the financial year 2010-11 has come down by 16.77 % as against the corresponding period of the previous year when the Company registered a net loss of Rs.459 crores."This is a critical phase for us and we hope to achieve better results and even possible turn-around in next two years", said K. L. Dhingra, CMD, ITI Ltd. "Our expenditure in important areas like employee cost, financing expenses etc has come down during 2010-11 as compared to 2009-10. We expect significant orders in coming months and this should boost our sales which declined in 2010-11 due to lack of orders", he added. He said the Company is concentrating on new business opportunities in defense, banking, solar, LED lighting and railways.

I don't think that situation like 1996 will repeat. Both BJP & Congress will be able their numbers above 100 in the next general election. Though both the parties are having their own problems but even than they are still stronger than regional parties. I looks that BJP will emerge as a single largest party and will head the next Government.

Whatever happened with Baba Ramdev is very shameful and I think that this just like period of emergency. Now I come on Sibbal. Whatever he did was his job because politicians have no moral. They can do anything for gaddi/party. Isne CBSE board ko chaupat kiya, ab desh ko chaupat karega. Aise logo ko party main rakh kar Congress kya karna chati hai, Bhagwan jane. Digvijay Sing was also Mahan man. Apne ko kaise charcha mein rakhna hai, unse ja kar sikhiye.

Another Indian penchant for a new law

This clamour for repatriation of illegal Indian money stashed abroad through yet-another legislation is another Indian penchant for a new law, without seeing whether there is any existing law on the subject. We have put in place PMLA, 2002. We have put in place collaboration agreement with foreign jurisdictions :

"56. (1) The Central Government may enter into an agreement with the Government of any country outside India for-

(a) enforcing the provisions of this Act;

(b) exchange of information for the prevention of any offence under this Act or under the corresponding law in force in that country or investigation of cases relating to any offence under this Act.

and may, by notification in the Official Gazette, make such provisions as may be necessary for implementing the agreement.

(2) The Central Government may, by notification in the Official Gazette, direct that the application of this Chapter in relation to a contracting State with which reciprocal arrangements have been made, shall be subject to such conditions, exceptions or qualifications as are specified in the said notification."

We have defined offences with cross border implications :

2(1)[(ra) "offence of cross border implications", means -

(i) any conduct by a person at a place outside India which constitutes an offence at that place and which would have constituted an offence specified in Part A, Part B or Part C of the Schedule, had it been committed in India and if such person remits the proceeds of such conduct or part thereof to India; or

(ii) any offence specified in Part A , Part B or Part C of the Schedule which has been committed in India and the proceeds of crime, or part thereof have been transferred to a place outside India or any attempt has been made to transfer the proceeds of crime, or part thereof from India to a place outside India.

Explanation:- Nothing contained in this clause shall adversely affect any investigation, enquiry, trial or proceeding before any authority in respect of the offences specified in Part A or Part B of the Schedule to the Act before the commencement of the Prevention of Money -laundering (Amendment) Act 2009;

We have defined proceeds of crime :

2(1)u) "proceeds of crime" means any property derived or obtained, directly or indirectly, by any person as a result of criminal activity relating to a scheduled offence or the value of any such property;

We have also defined property :

2(1)(v) "property" means any property or assets of every description, whether corporeal or incorporeal, movable or immovable, tangible or intangible and includes deeds and instruments evidencing title to, or interest in, such property or assets, wherever located "

The list of scheduled offences in PMLA is exhaustive and includes legislations from Prevention of Corruption Act to NDPS 1985,Explosive Substances Act 1908,IPC 1860,Arms Act 1959,Wildlife Protection Act 1972, Immoral Traffic Prevention Act,1956,Antiquities and Art Treasures Act 1972,SEBI Act 1992,Customs Act and a host of other Acts. If an asset is created in a foreign jurisdiction from out of an offence punishable under PMLA, proceeds can be repatriated under this very law. The basic question is has any one identified any such account elsewhere ? Unless you have identified an account, what is the point in any pointless discussion. This breast beating is so meaningless.

Grave flaw in the Government rules

One more grave flaw in the Government rules is with the term relating to the word 'family'. One cannot get his of her parent declared as dependent if he of she is getting pension of Rs.1500/-. On the other hand if your parent was working in a private/public sector company or doing business and was drawing fat salary can be included in the term of 'family' just because you are not getting any pension. This is ridiculous and something should be done to set right this. The Supreme Court in Civil Appeal No.1368 of 1990 in the matter of State of Madhya Pradesh Versus M.P. Ojha vide a judgment dated 18.12.1997 has said that the terms appearing in the definition of 'Family' under the medical rules includes both financial and physical dependence - Meaning of expression cannot be interpreted or curtailed by applying Fundamental Rule - Retired Government servant who lived with his son - Can be treated as wholly dependent on his son irrespective of the fact he himself was getting pension - Son is entitled to reimbursement of medical expenses incurred on treatment of his father' In line with the aforesaid judgment the Government needs to change the meaning of the term 'family' in all its rules including medical, LTC etc. A government servant cannot be expected to leave behind his/her 'old parents' at the mercy of rogues when he goes on LTC. This also needs to looked into. As per Article 141 of the Constitution of India any judgment passed by the Supreme Court of India becomes the law of the land.

Hypocrisy of Congress

In Bhatta village, U.P, the protestor took hostage of the government officials and use fire arms against the police force even shooting D.M but Prince of Congress did not found it wrong and targeted U.P administration since it is ruled by non-congress govt. whereas in Delhi, Police used tear gas & lathi charge in the midnight when women, old people were asleep to target peaceful protest of Guru Ramdev and this action was unleashed by his own govt. quelling the freedom to speech and protest. But Congress Prince is nowhere seen. How farcical can congress be can be gauged by the statement of Digvijay Singh who stated that Congress is not afraid form Guru Ramdev otherwise he would have been in jail but later action of his government for issuing externment orders clearly depicts that they are indeed afraid.

In very poor taste

"Arm pit exposing vulgar looking guru" comment by Usha Natrajan on Swami Ramdeo is in very poor taste. She appears to have descended from some other planet and not aware of Indian culture of Sadhus and Rishis wearing one piece attire. She may be in agreement with Swami Ramdeo views but she has no right to comment on the apperance of anybody. Very poor taste.

Are Ministers covered under definition of 'public servants'?

The appellant desired copies of instruction under which Ministers are covered under the definition of public servant and the rule under which the Ministers could remain missing from their official duty for weeks and devote themselves for their party works leaving behind their official work unattended. He also wanted to know whether such prolonged absence from official work could be treated as a part of their official duty and whether a Minister could draw pay & perks for the period of absence from official duty to attend personal or party work. The PIO stated that as per records available there are no
specific definitions of whether Ministers are public servant or not. The CIC felt it necessary for the Government to define whether Ministers are public servant or not and this should be available as a requirement of Section-4 declaration.

Comments

The section 4 puts certain obligations on the public authority to pro-actively disclose certain facts about themselves. The civil servants have been at the receiving end for delay or absenteeism but the performance of ministers has not been questioned. Would the RTI
Act be able to force the attendance of the Ministers?
