A bench of the Pakistan Supreme court comprising of Justices Javed Iqbal, Raja Faiyaz and Asif Saeed Khosa on thursday declared illegal the appointment of Retired Justice Deedar Hussain Shah as the Chairman of National Accountability Bureau (NAB) on the ground that the objection raised by the opposition leader in the National Assembly to Justice Deedar's selection was overruled by the President. In his petition before the apex court the opposition leader had argued that justice Deedar Hussain was known to be close to the PPP and he was made the NAB chief to put on the back burner cases of corruption pending against several PPP leaders including President Zardari involving billions of rupees. NAB is equicalent of India's CVC and CBI put together. The apex court has also issued direction to the NAB chief to step down from his post with immediate effect.

"Indians losing interest in Defence Services"-A debate

Reasons The modern Indian youth is exhibiting a decline in interest for serving in the Armed Forces. Reasons? With their changing mindsets and lifestyles, they have turned less adventurous and more materialistic. They prefer lucrative, armed chair BPO jobs. This declining trend has been a source of concern for the MOD for several decades. In this age of globalization, the modern (Indian) youth prefer to be addressed as "World citizen", with mobility to earn their livelihood .Last but not the least, with the growing employment opportunities worldwide in this age of globalization and liberalization, the options of pursuing career in defence services is at the lowest rung of their priorities:

Solution: While serving in GOI , I had suggested to MOD to consider lowering the qualifying standards by a fraction for the NDA and CDS written exams held by the UPSC, for a couple of years to facilitate filling up the large backlog of vacancies. This could be made up through a more rigorous physical training. But, the MOD was not convinced.

Implications: This resulted in demoralizing thousands of NDA/CDS aspirants who were left with no option but to look for alternative pastures elsewhere.

The people have, certainly, found the defence services a little less lucrative since when the MNC fashion thru lucrative Education business is in the hands of politicians. Besides politicians have a little edge over the defence services even they have tactics to disregard the zeal and enthusiasm of a Defence Service Officer on filthy grounds to save their polity. I submit my views that the Defence Services Officers must be allowed the take on their own decisions for the Staff under them and no political pressure be put on the Senior Degence Officers. Their perks may also be considered lucrative. In school and colleges, NCC training must be made compulsory for all the student eligible within the criteria and such students should be graded better in case they are Nationalists and taking much interest in joining Army, Navy and Air force.

However, this issue needs an elaborate National debate.

Cental government is run by the fugitives !

If the government is complying with the orders of the SC, shall his promotions after 1992 stand cancelled as his integrity can not be certified thereafter. Shall he get reverted to his 1992 level. Shall the Cabsec, CVC, Chiefsec Kerala be punished for the conspiracy of silence. Why did the Kerala government not recall him from deputation. Why was PJ Thomas made Chief Secretary and with what moral authority the left government in Kerala is now blaming central government despite being the first holder of all info on PJT .What is going to happen to the other 10 Secretaries in GoI whom PJ Thomas referred as being tainted yet appointed as Secretary in GoI and numerous other officers. In fact the Cental government is being run by the fugitives of the North East apart from the Kerala lobby. Why cant we allocate posts at different levels to different cadres pro rata as per their CDR rather than allow the Central Deputation Reserve to be manipulated by spineless officers.

Since the SC has held his appointment as 'non est', as if it did not exist, it means all decisions where he has signed as a reqd party , would have to be redone. For the same reason he does not have to resign since it is considered that he was not appointed at all legally.

PMs statement raises more questions than answers

Prime Minister's statement regarding acceptance of responsibility for CVC fiasco raises more questions than it answers:-

(a) PM says that he was not aware about the pending charge sheet against Sh Thomas till it was brought out by Mrs Sushma Swaraj. Here, a question arises as to why did he choose to force the choice of Thomas as CVC despite being made aware of pending charge sheet against Thomas (by Mrs Swaraj). Thus, he willfully ignored this fact and it was not an "error of judgement" as is being made out in his statement.

(b)PM says that it was presumed by him that vigilance clearance angle must have been checked by the people working under him before putting up the name of Sh Thomas. Here, the question arises that in government functioning, many officials make mistakes due to incorrect/ inadequate inputs provided by their subordinates. The officers making such mistakes are invariably proceeded against and penalized. Can they get away with making statements "owning responsibility" and suggesting "error of judgement"? If PM is immune from accountability on the above mentioned plea, then the officials making mistakes due to so called "wrong/ inadequate inputs presented by the subordinates" should also have immunity from accountability.

The people of India are not so gullible that they will gulp this "utter nonsense" version of "owning responsibility" and "error of judgement".

Prez should remove CVC on advice of SC

As per CVC act, President is supposed to remove CVC on advice of Supreme Court. Why formal order of kicking is not being issued by the President? Why Supreme Court judgement is being treated as presumptive executive order? Is there any game plan to leave intentional lacunae so that Thomas can take advantages at later stage?

Phone tapping powers to IT Department-

1.The issue to be looked is whether it is in national interest to give I T Department power to tap phones.

2.It is a fact that the Income tax department has a huge intelligence network to check black money. However in the case of many businesses, before conducting raid, the department has to go by strong possibility of tax evasion, as definite evidence of tax evasion is hard to get.

3.In case of powerful people I T department can't take any action on the basis of strong suspicion, in such cases phone taping comes in handy , as it gives definite evidence of tax evasion (which is useful in case of powerful people).

4.There is need to amend Telegraph Act to empower Income Tax to tap phone in case of widespread suspected tax evasion.

5.I agree that there is also a need to delete private conversation from the Tap.And introduce strong checks to prevent misuse.

6.But forbidding Income tax from taping phones is only in the interest of the corrupt and anti nationals.

After implementation of sixth pay commission we are equated with Peon and in some case Group D employees are drawing more pay that UDC. while Jr. Accountant/Auditor are getting 2800 GP but for UDC it is 2400 and it is also here mentioned that Jr. Accountant/Auditor is getting 4200 GP after 3-4 years of service while there is no provision for UDC in this regard. Why UDC are treating as step motherly? who is responsible for their pitiable condition? while UDCs are working equivalent work to Assistant in central secretariat but in front of wages they are equated with Peon. Biggest tragedy

This is the biggest tragedy for our young generation that our country is ruled mostly by old and re employed ( and useless people )who are only concerned with their own safety. What happens to young people whether they get killed raped or held hostage by Somalian pirates is hardly of any concern to them . Having lived their life fully (in Lutyn's Delhi virtually free of cost at tax payers money ) they still want Z category protection as if policemen ( of Delhi Police )deployed for their personal safety can prolong their life.

Law being misused by miscreants

It is unfortunate how the law is being misused by miscreants in this country. Unscrupulous in-laws blackmail the bridegroom's parents in the name of anti dowry law, tenants blackmail property owners and seek refund of all the rent paid to vacate the property, unscrupulous sons-in-law who get into anti dowry troubles threaten their in-laws with RTI applications to be sent to income tax authorities against their in-laws, the list is endless. Misuse of the law has to be stopped. Mechanisms to prevent misuse have to be built into the law itself. Will lawmakers think about it?

Another Fiasco in Statistics Ministry

After the fiasco in the GDP estimates and Industrial Production Index, it is now the turn of sample surveys. The Ministry of Statistics under the charge of an Economist Professor turned Chief Statistician thought that it was their fiefdom to conduct large scale sample surveys and give results. No one could challenge their results as they had monopoly. But the inevitable has happened sooner than expected. A survey on Employment - Unemployment conducted by Labor Ministry which is the nodal ministry on the subject has produced results which are highly divergent from NSSO results. To save their skin, the Economist Chief Statistical gave some illogical reasons like wrong survey methodology, small sample size and wrong sample selection by Labour Ministry to condemn their results but forgot that very senior officers of his ministry were involved in the Labour Ministry exercise. The Chief Statistician managed to get a letter issued from Cabinet Secretariat through DC, Plng. Comm., to all departments of GOI putting a stay order on the conduct of surveys by them. The blaming game is not yet over. Labour Ministry has sent a rejoinder. One after another, scams are happening in statistics ministry after the joining of the Professor as Chief Statistician. Lets wait and watch what is coming next!

The inevitable has happened! The hidden "hand" of the High Command has wielded the magic wand. The State Govt. has buckled under pressure and initiated the process of convening another DPC meeting to reconsider the cases of those who fell by the wayside in promotion to the Additional PCCF level. The moot question is, whether the Panel already approved by the hon'ble Chief Minister will be quashed? Well, the rules do not permit, but such are the ways of High Command! Anything is possible. What, however, needs to be seen whether the ball will swing the second time around and bowl those selected by the earlier DPC out? Aam aadmi ki sarkaar mein merit ka kya kaam?.

What's the logic ?

Some time PIOs intentionally do not provide information sought by the applicant. They compel applicant to knock the door of First appellate authority or to file again the application or to inspect the records for seeking information under RTI act. I do not understand the reason of suggestion given by the PIO of inspecting of records, whereas the information sought by the applicant is always specific. Knocking the door of First appellate authority is a wasting of minimum of 3 months time, as the response by the First appellate authority is mostly similar to given by the PIO.

Poor Grade D stenos:

Grade stenos who have put in more than 20 years of service as on date. Please realise that when Cadre Restructure was approved by Cabinet in 2006; it was not implemented by tampered by PPS/Sr.PPS and as a result the no of posts which were increase in our favour was converted into PPS/Sr.PPS post and silently we were made fool. Now again Cabinet has approved Cadre Restructure. But though it is going to be implemented; mind you the date of seniority is going to be from 2011 and not 2006 which actually it should be. So we well retire as PA and the present PS/PPS/Sr.PPS/PSO will again enjoy the benefit of this restructure. As these persons cannot individually handle a senior officer's office; as usual we will be roped in for sitting late/taking dictation for no benefit but to assist these English officers who will take more bulky pay with more benefits. DOPT is knowingly silent over this but they are so inefficient that they are afraid to issue any order for fixing more responsibility on these PPS/Sr.PPS/PSO. Is such DOPT necessary for we CSSS(Steno D & C). Let the DOPT take care of UDC/Assistant/PPS/Sr.PPS/PSPs. After all, they are capable of doing this only.

What ails the government ?

This is exactly what ails the government. Bhaskar joined DIPP a few months back. He completely changed ( kudos to him for doing the right thing) India's stand in all international negotiations in a very sensitive area which is Intellectual Property. Now when he has just got the hang of the subject, he is leaving his assignment. Now another officer will come to this post and again start learning (hopefully) his subject. No other government in the world allows this kind of ad-hocism, in such sensitive areas. Ultimately India is always led by persons who have just started to understand their subject, and are pitted against skilled, experts who really know their field inside-out.

Misuse of the Act

The appellant sought information regarding grant in aid given to DAV College etc. and was offered the opportunity to inspect all the records. He instead filed second appeal before the Commission. Respondents stated that the appellant was in the habit of filing RTI applications and had filed 250 RTI applications to date through which he sought voluminous and old information. Usually, the appellant does not appear before the First Appellate Authority when his appeal comes

live for receiving the information. They submitted that the appellant who is a former contractual employee of D.A.V. College has already been provided information under the present RTI application running into over 200 pages and have so far provided him thousands of pages of
information against his other RTI applications. The Commission ruled that such vexatious applications can be summarily dismissed at the level of the CPIO since it is obvious that these applications are not being preferred in public interest and are in fact adversely impacting
the functioning of the public authority instead of strengthening it, which is contrary to the letter and spirit of the RTI Act.

Comments

Cases where the appellant is misusing the RTI Act to settle personal scores with his former employer are not uncommon. This ruling provides a definitive way for summarily dismissing those applications at the level of the PIO which causes disruption in normal work and strain on
the financial resources.
