Pakistan Government's open challenge to the apex court
In what looks like a direct challenge to the authority of the apex court the government of Pakistan decided to reappoint Deedar Hussain shah as the Chairman of the National accountability Bureau (NAB) in spite of the apex court's ruling declaring the appointment illegal on 10 March. President Zardari has written to the opposition leader in the national Assembly about the proposal to secure due compliance of the process of consultation for want of which the apex court had declared the earlier appointment illegal. The President's legal team has advised that that the reappointment notification may be issued irrespective of whether or not the opposition agrees with the proposal as the legal requirement is consultation and not necessarily consent, consensus or unanimity. In a shocking related development the ruling PPP gave a strike call in the Sind province to protest against the supreme court verdict against Deedar Shah who is a sindhi. The Sind Provincial Assembly also passed a resolution condemning the opposition leader in the National Assembly for approaching the supreme court against Deedar Shah's appointment as NAB chief.

Steel Minister assures of all help for Jagdishpur unit
Indian Steel Minister Beni Prasad Verma held a meeting with senior officials from SAIL in Jagdishpur recently for reviewing the progress of the ongoing revival work of Jagdishpur SAIL Unit (JSU), the erstwhile plant of Malvika Steel at Jagdishpur (UP). The Steel Minister envisaged an investment of around Rs. 10,000 crore for
building a modern state-of-the-art steel making unit at Jagdishpur. He stated that Ministry of Petroleum at the Centre has been requested for extending support for natural gas resources. Verma assured that all possible efforts shall be made to expedite the completion of the project, and said that he would personally take up the matter at the highest levels in the Government. In response to a letter from SAIL Chairman C.S. Verma expressing solidarity with the quake-affected people of Japan, Kobe Steel has informed that the loss of life and infrastructure in Japan is huge. However, all employees and plants of Kobe Steel were almost unharmed. Therefore, they can continue the joint work of feasibility study on the new steel works at JSU, shared the Minister. SAIL is carrying out many activities under Corporate Social Responsibility (CSR) in and around Jagdishpur.

Why single out defence services only for the shortage. You take any cadre like University professors(IIT/IIM in particular)/Doctors/Engineers/Judges, there is shortage ranging from 20% to as high as 50%. One wonders how come shortage in defence services is only at junior level only, whereas there is absolutely no deficiency at Colonel and above and equivalent. Logically shortage if real should be evenly dispersed across all officer ranks. One tends to believe that the shortages are either artificial or deliberate.

DEBATE (2) there has been a perception of armed forces being sacred cowsw and that they work in inhospitable conditions.someonr has even commented that officers have to prove themselves daily in battle field.this is far from truth.the officers of armed forces are a pampered lot and at the same time as corrupt as any other institute.that they live in sealed cantonements hide this fact from general public.the shortage of officers has nothing to do with willingness of people to get into army.they have deliberately chosen not to recruit people for fear of loss of promotional or other avenues.any criticism of these officers is taken as if it is a threat to national security.its time to understand the hypocricy of our armed forces officers.

UPA govt & its IMF/World Bank stooge PM has sold India to foreign interests

The UPA government, with its IMF/World Bank stooge PM, and "international" chairperson, has essentially sold India to foreign interests. FDI in real estate has made housing unaffordable for the average Indian, and foreign interests are buying up all of India. So called SEZ's which produce nothing that is exportable are buying up fertile agricultural land to build universities, apartments, and god knows what else. Food is unaffordable, yet agricultural exchanges are trading our grain and vegetables away, making tonnes of money while India starves, and grain rots in warehouses. The media are infiltrated by outside interests and capital. Policies are inexplicably made which favour foreigners over Indians. Our space assets, built with care over decades, are sold off for a song. The 2G spectrum is auctioned to the highest briber. Our defence policy is a shambles, and the armed forces progressively demoralised even though both Pakistan and China are increasingly belligerent. The CVC is appointed, and is tainted. In the national capital, an air of the colonial era prevails, where being white automatically ensures special treatment from government and other persons. Corporations rule the roost, and the common man (by which I mean anyone who doesnt make several crores a year)! is left to starve. Everything is topsy turvy. We, the people of India, are betrayed.

Why is govt hesitant to disclose names of black money hoarers ?

The loot of the 60 odd years can definitely be running into billions of dollars. Why is the government hesitating to inform the court the names of these people? Are some of them so powerful in the government and the party? I read that government plans to tax 20% and let them keep the rest. Is the government for the people, or is it for these criminals? Who is the PM shielding? He is reported to be against disclosing the names. What service is he doing to the country? what to do of the oath he took? Please resign, if you cannot stand up to protect the rule of law in this country. Or, let the court allow all citizens NOT to pay any taxes, if these people are to be allowed to go scot free. Can such a system ever work? Has the economics scholar, who happens to be the unfortunate prime minister, lost his sense of what is right? Do the rulers realize what happened in French revolution? There was a Dr. Guillotine, whose work sent shivers through the spines of the powerful. Should India go through that situation to cleanse itself of the corrupt?

Why would the govt. reveal names when they are themselves involved in this.......

Govt has still not learnt from B S Lalli, PJ Thomas and many such episodes...to keep irrelevant people out of professional services. Corruption in Prasar Bharati is only because of inefficient, untrained deputationists. Shame on this Government for encouraging corruption and inefficiency.

PM has betrayed innocence in various scams

Dr Manmohan Singh has betrayed innocence in various scams which have taken place under his tutelage. His public posturing and soft-spokenness should not be taken as a proof of integrity. He may have not been directly involved in the crime but his is a case of complete failure of "Command and Control" as is mentioned in army parlance. Secondly his etiquette and soft-spoken-ness should not be confused as a proof for his innocence. He is guilty of "conspiracy of silence".

Delhi CM should act

C.M., Delhi has given her views regarding non-cooperation by the citizens of Delhi towards aggrieved or in solving the cases. Her statement is like a quotation "A crow sitting on tree doing nothing! A rabbit doing the same on ground. A wolf came and ate him. Moral : To sit & do nothing, you need to be on top".

Has she ever thought of the misery of the common people who if even tend to help the accident ridden person or came in contact with police personnel? Our channels are such that it is impossible to get fair dealing from these police personnel, or to justify the help extended due to questioning and harassment by the system.

However, the least can we do is to raise our voices to reach our politicians or top bureaucrats to at least ban the vulgarity, the semi-nudity, cheap comedy, stories based on revenge and crimes in the Hindi films and off late in Hindi serials. It is high time we should find the root cause behind all these increasing magnitude of rapes, criminal activities by the adolescents. I think, lot of grounds and ideas are readily comes into the minds of people through these films, who in the name of entertainment are ruining the society. We should think thrice to treat these actors and actresses as celebrities who to earn money, can do anything but to........... It is an old but true saying, that the surrounding in which you live has great effect on your mind and body. More you see the vulgarity or violence in Hindi films or serials, more you are prone to these.

Stagnation in CSSS

CS II Division of DOPT is completely biased with the CSSS, especially Gr.D employees of CSSS. They still appointing Gr.D to Gr.C on ad-hoc basis. The Gr.D of CSSS who have rendered almost 24 years of service in the same grade were actually appointed on regular basis after completion of 24 years of their sincere and dedicated service. The employees belong to Gr.D service of CSSS are hereby requested to forego this ad-hoc service and asked the DOPT to appoint them on regular basis so that they may not suffer as their seniors suffered earlier. My appeal to the DOPT to appoint the CSSS in the CS.II Division of DoPT upto Dy. Secretary level so that they can put up their cases in right perspective. I can assure the DOPT that CSSS service personnel are equally competent to their counter part (CSS)and able to handle all administrative matters. Give them a chance.

Sympathise with Steno D(adhoc-c)

I belong to CSS. Though UDC and Assistant of CSS constitute equal number of ladies; still when a female UDC/Assistant is on leave; the burden of sharing is not there. But in CSSS; where considerable number of ladies are PS/PPS/Sr.PPS; and when it comes to late sitting; taking dictation after 4.00 P.M.; coming on holidays during Parliament Session and as directed by JS level and above officers; the poor Gr'D' who have put in 20 or more years of service or Steno C is rubbed. Apart from this, designation of Steno D. Steno C, PS/PPS etc. is not taken care of by senior officers while giving the work/posting. They simply want somebody to take dictation and take care of their office properly and in the process most of the male stenos and that too who are waiting for promotion for more than 20 years are rubbed without any benefit and the senior staff i.e., PS/PPS/Sr.PPS/PSO in CSSS enjoy the most. DOPT is only a silent spectator to this because as on date they are yet to issues to issue any order strictly directing senior officers to make full use of PS/PPS/Sr.PPS/PSO and thereby asking these persons to carry out their jobs individually and not escape by passing on their burden Steno D/steno.C. who have put in 20 years of service without any promotion.

What is common in all ministries and government offices ?

We do not know why certain officials protect some culprits knowingly and harass others who are genuine. This could be due to the fact that in a system, you hardly find one or two good people. So, when the people with vested interests gain majority, they collectively loot public money. The audit party from AG or Ministry just come for sight seeing and enjoying. For instance, these two parties point out minor lapses and ignore major financial irregularities. I am sure, it happens in all offices. So how we could wipe our corruption. Unless people correct themselves, we cannot prevent corruption. I am told in one office in Chennai a lady official had given her home town as New Delhi while she was born and brought up in Chennai. She has been claiming LTC Home Town every year. Does this not visible to Ministry or AG Audit ?

Hats off to DGCA !

Hats off to the present DGCA for going hammer and tongs against corruption in the department. Presently only few pilots have been caught for fudging the examinations. But the big fishes who are the facilitators are inside the Directorate itself. For some years now strong rumours were afloat that one can pass any paper in the Pilot written exam if one can pay around three lakhs per paper. For renewal of pilot Licence standard underhand charge is said to be Rs.50, 000. Similarly flying hours can be fudged through Flying Clubs like Jaipur Club who have no aircraft even. Many of the children of officers and staff in the Directorate are pilots. One hopes that the present DGCA, an IAS officer who has a track record for integrity , efficiency and strong will, will clear the Augean stables in the DGCA and start the cleaning up from the entrenched top hierarchy itself. If necessary CBI should be brought in to investigate and the assets of all officers and staff in the Directorate should be enquired into. After all unlike other departments, DGCA is responsible for the safety of passengers.

Humorous interest

I am observing with humorous interest the comments in your column about raising retirement age. The ridiculous plea for somehow raising the age is floated by the vested interests. The Finance Minister has recently announced income tax concessions for persons of and above age of 60 years. The cynical elements within bureaucracy hell bent upon thrusting the increase in retirement age are doing so with the expectation that they can continue to enjoy the fruits of exploiting the Government system as 'senior citizens' for two more years without any accountability. I only fervently hope that this idea is firmly quashed by PM by making a firm statement once for all.

Retirement age can be raised with certain condition. The official who has been rated outstanding at least 8 years in the last 10 years in the annual confidential may be given extension of service for 2 years. This will help to prevent corruption. Also terminate the person who could not perform in the last five years.

Disclosure of agreed list file

The file pertaining to the preparation of 'Agreed List' for the year 2004 containing the recommendations of higher authorities was sought. The RTI applicant referred to Instruction No. 1881 dated 13th February 1991of the Department of Revenue, Central Board of Direct Tax (CBDT) which laid down guidelines regarding preparation and operation of the 'Agreed List'. (i) In every case where an officer's name is being
included in the 'agreed list', a gist of the material, on the basis of which this is being done, must invariably be put on record. (ii) Normally, an officer should not remain on the 'agreed list' for more than one year on the same ground, extended in exceptional cases by one year each to a maximum of 3 years with the prior approval of the CBDT. The Delhi High Court dismissed the appeal against the order of CIC directing disclosure of file applying section 10(1). The HC also directed payment of Rs. 5,000/- as costs to the RTI applicant.

Comments

Under Section 4(1)(d) of the Act, every public authority is required to indicate the grounds for taken for decision, at least to the affected person. Unfortunately, the name of an officer tends to continue on the agreed list indefinitely due to lack of adequate care and the affected person having no means to know about the same. The whole concept of 'agreed list' needs to be revisited in the post RTI era.
