The ongoing debate on Jan Lok pal/ Lokpal poses one serious question whether strong centralised Lokpal will be an answer for the removal of corruption from the system? I don't think so. We have to look beyond the media savy debate on Lokpal. I would like to take the debate to other aspects of the issue. Let us prima facie start with question "what is corruption?". It looks as if the definition of corruption is "taking money for any work done by government servants". With one brush, all the 4.2 crore central and state government servants are painted as corrupt and the remaining 1.2 billion people are honest. Arvind Kejriwal and Kiran Bedi should also remember that they were also in the same category at one point of time. Is it not fair to define corruption as "any act by government employee or any private person influencing/ short circuiting the well established procedures". In other words, the rent seeking behaviour of an individual in cash/ kind should be considered as corruption. In this case, why only the government employees?, the media (who receive govt advertisements), NGOs ( who receive funds from government and international organisations), and Judiciary also should be included in Lokpal. I think through the Jan Lokpal or Government Lokpal bills, we are prescribing medicine without diagnosing the disease. I would like to request the civil society not to treat government servant as Draupadi in Mahabharat who is at receiving end both from her husbands and enemies. He should not be humiliated in open court for the faults of others. I want to ask one simple question to opinion makers. What is the protection to government servant in the Jan Lokpal Bill? Without any protection do you expect any bold or fair decision in government? Is government servant not a stakeholder in the process? Unfortunately, neither the Standing Committee nor the Anna team bothered to seek views of employees' associations on the bill. The government employees are covered under conduct rules as prescribed by different states. However, one can see that three classes are insulated from public scrutiny i.e law makers, media (fourth estate) and judiciary. To clean up the system, first, we have to remove the protection for these categories. Barring top bureaucrats, all other government employees who generally face the brunt are exposed to influence by the other categories. There is no one stop solution for all ills. The phase wise and coordinated action can only throw an acceptable solution which can restore public confidence.
I have some possible solutions
(a)
Delay fosters corruption. Time bound and expeditious clearance of proposals one way or other by government departments will reduce the presence of middle men in the system. This can be done by computerisation and transparent system of decision making. The online tracking system of files adopted by the Department of Personal and Cabinet Secretariat is one such technological solution. Strong public grievance machinery and citizen charter by each government department including hospitals, transport authorities, urban facilities and banking system will certainly give voice to public.
(b) At present the RTI applications do not differentiate between public and private interest. If an application is made with CIC, the applicant should justify the public interest issue before taking up with concerned department. Otherwise, the hapless government servants are being targeted to settle scores by individuals. This is important because, the government servant has no forum to defend himself/ herself. Strict action should be taken against frivolous complaints.
(c) The voice of government servant is throttled by CCS CCA Rules 8 and 9 which impose restrictions on freedom of expression. Is the government not a citizen of the country? These restrictions should be removed to make level playing field to expose the vested interests.
(d) The laws should be amended to prescribe exemplary punishment for corrupt practices which include life imprisonment and confiscation of assets as is being done in some states like Bihar and J&K. But it should be backed by quick and fair trial by enforcement agencies and courts. There can be special courts in each state to deal with corruption cases.
(e) The media should be regulated either through Press Council of India or through any self regulating authority. Under the garb of non disclosure of source, they can't get protection from publishing un substantiated stories. The paid news aspect should be seriously looked into by law makers.
(f) One can't understand why judiciary should not be included in Lokpal? There are glaring evidences where the judiciary is getting influenced in their judgements. If it is not constitutionally feasible, then judiciary should think of a self regulating machinery.
(g) The electoral expenses are the main cause for all the ills of corruption in political class. Strong electoral reforms including public funding of elections and debarring politicians from contesting elections in case of criminal records and right to recall public representatives are some of the solutions. The political parties have to come out with a solution for this.
(8) There should be an oversight on the activities of NGOs through financial audits and third party evaluation. The inflow of funds should be regulated by a transparent procedure.

Problems that plague India's intelligence community
If the speculative information were with 100% precision then they would never remain intelligence. The on going invisible slugfest and turf war between various intelligence agencies is the major cause of intelligence failures resulting into blast like the one that took place at Delhi High Court, killing over a dozen and injuring around 60. IB, RA&W, NTRO, NIA, MI, FIU etc all are at logger heads to prove each other inferior. Impression that is being generated in public is that MHA and PMO seem to be playing to the gallery,
Be it in J&K or Mumbai or in Delhi all these lapses are due to pressing desire of agencies to prove their organizations' supremacy over other and over politicization of selection of various Intelligence heads. Due to this identity crisis the sharing of information between agencies is not optimal. Senior officers who are authorized to take decisions rarely have time or interest to provide detailed requirements as they are more involved in taking orders from their political masters. If they have less time to concentrate on their actual job responsibilities, situations like these will go on occurring for time immemorial.
The recent spate in criticism from politicians, fear of getting reprimanded when strike rate in intelligence analysis is near to perfection and the biased statements in media seems to have encouraged some analysts and officials to play safe resulting into disaster of unprecedented magnitude like 26/11 or the one that took place yesterday at Delhi High Court. As a citizen I have a few questions for the government and the politicos as the whole:-
1. Is it not high time that MHA is segregated into Internal Security and Center/State Activity? Or can we not have two ministers under Home Minister looking after these two aspects of National importance independently?
2. Should there be more delegation of power and defined accountability for offers in MHA and Intelligence Agencies? Should the officers not abhor "intelligence to please"?
3. Should India not have an Identical Body like "Red Cell" of USA's Homeland Security? Should every intellect at district level not be made part of Red Cell Molecule under District Superintendent of Police for effecting /gathering intelligence?
4. Is it not ripe for India to have a law on the lines of USA's Patriot Act?
5. Should not all the Intelligence Heads post be separated from partisan politics? Should government not promote "Unity of effort" and "Foster Long-Term Research and Strategic Thinking" in the intelligence community?
6. Should there not be a blanket ban on Intelligence Heads taking up- government assignments like Governorship or head of enquiry committees, post retirement? Will not this ban instill more belief in the intelligence agency heads to perform better than lobby for assignments post retirement?
7. Should government not clearly demarcate the boundaries, assignments, domain and powers of various agencies, so as to stop time wasted in fighting/ destabilizing other agencies?
8. Should the Indian Embassies abroad not have independent units/TECHINT instead of having officers to passport and visa duty like US or other countries have?
9. Should GOI not have an Intelligence Coordinator as suggested in Dr. S.D.Pradhan's report for effective coordination between the numerous agencies?
10. JIC is doing a good job of acting as a post-office for NSCS, should Government not have NSA who has had a stint of policing and intelligence as minimum qualification?
11. Should NTRO be made accountable on the lines of NSA of US?
There has to be proper and friendly coordination in between agencies for having a near to perfection situation in internal security. The coordinates between HUMINT, OSINT, SIGINT, IMINT, MASINT and intelligence agencies have to work in tandem for countering intelligence failure like these where terror activity has been successful. Proper coordination amongst agencies will allow successful Analysis of Competing Hypothesis (ACH) that minimizes chance of failures. If still GOI does not awaken to systematic failures then India too would move towards becoming another state with total disharmony and anarchy.

It is not clear whether All India Services referred to includes other central services. AIS officers were benefited with this special allowance since years back. It was only the Central Services Officers like IRS, from Railways etc. who were not included. Does it now include other services along with IAS, IPS and Indian Forest Service officers is not clear.

I had purchased a CGEWHO flat in Sector 82, NOIDA in 2003 at cost of Rs.17.90 lakhs. I wanted to get my flat registered at that point of time. But a decision of Allahabad High Court came that NOIDA cannot charge additional registration charge from the applicants as they had paid registration charge to the CGEWHO for which they had purchased land. I could not get my flat registered as it would have amounted to contempt of court. NOIDA went against the verdict of the High Court in the Supreme Court. The Supreme Court has finally given its verdict recently wherein I will have to pay registration charges and that to at the current circle rates. This is ridiculous as I am being penalized for no fault of mine.
Recently, the Haryana Government had organized a registration camp in Gurgaon. The CGEWHO beneficiaries paid the registration fee at the old rates.
With due respect to the Supreme Court, while giving a recent judgment in the NOIDAs case they have perhaps infringed on the Preamble, Directive Principles of State Policy and Right to Equality of Constitution. The matter needs to be reconsidered. he Constitution of India talks about Right to Equality.

How can CBEC Chairman and Members who are in the grade of Special Secretary, become Ombudsman, whose grade is HAG+, which is lower than Special Secretary's pay scale as well as rank. So Chairman and Members CBEC should not be eligible for a post retirement job of Ombudsman.

Seniority list continues to fox GoI
IRS (C&CE) seniority list continues to fox the government of India. Why is it so? Even after various Supreme Court judgements the Central Board of Excise and Customs is not interested to finalize the IRS(C&CE) seniority list. The reasons are due to overtures to keep the Appraisers cadre in good humour. Thereby hangs the tale as the poorer lot of Superintendents of Customs Preventive and Central Excise continue to suffer. Not only them but also the directly recruited IRS(C&CE) face the brunt. Unless the CBEC is able to unshackle itself from the clutches of vested interests another example of poor governance and non-transparent practice will continue to plague the indirect tax administration in the country.

This is in response to the kind observation of Alok Bhatt about I-T Dept.
It may be noted that the actions of IT Dept are always shrouded in mystery and secrecy. It is not known why the dept does not give wide publicity to its actions, whether search or survey or assessment orders. In the era of RTI, every action should be disclosed to the public through press and electronic media. CIC himself stated that assessment order is public document. Still the dept does not publish the names of those persons against whom huge demand notices are issued. The work of the efficient officers is not known publicly. They are neither recognised by the superiors, nor by the government, nor by the public and hence will be discouraged to work. With this secrecy in vogue, the fence sitters, whether efficient or not tend to become corrupt. It seems that there is a rule in the department that none should speak to the media. It is for the media to debate, which is called the fourth estate in democracy, as to whether public has the right to know what IRS Officers/I-T Dept are doing for the public good. Don't they have the duty to inform the public through media or any medium as to what they are doing. When everything is transparent, there will be no chance for manipulation. Officers in I-T Dept are afraid of answering even a simple querry from media like name of the official who passed the order, or name of the person who carried out/conducted survey or search operations, or who raised tax demand, who passed a beautiful order, etc., Everything goes in the name of I-T dept, whether good work or laxity in work. This should change. The bright officers should come out of the shell and show themselves up.

Nab thriving culprits first
The Government is targeting Team Anna. When Arvind Kejriwal got a notice to pay up his due to the Government, why the same department does not even bother to check corruption. Corruption is rampant in all Government offices, more so in revenue earning offices like Income Tax, Central Excise, etc. Let the IT Department first collect taxes as per laid down norms. They are trying to find fault with someone after a lapse of more than 8 years, but does nothing to nab thriving culprits.

Team Anna may be correct in asking for the extension of Lokpal to the state governments. As it is, the CBI does not handle cases of the state governments and it is in the states that corruption has crossed all limits (this is because most of the government spending is in the state governments and not in the central government and leakages are therefore more in the state governments, most of these leakages do not come to public knowledge because there is no CBI to unearth them since there is no CBI watching over state governments). The reason why IAS officers are today caught along with their political masters in the Central Government (CWG scam, 2G scam etc) is that while in the state governments, the word of the political masters is the law and no CBI is watching them, so the IAS officers do the bidding of their masters and get away. The same officers carry their mental makeup to the central government and unquestioningly follow their masters while at the centre too, since that is what they have been trained to do in the states. This causes them no problems in the states where the Central Bureau of Investigation (the CBI is actually only an agency to catch crooks in the Central Government and nothing parallel to it exists or can exist in the states) over whom the CBI does not have jurisdiction. But in the central government, when following their habits formed in the state governments, they are caught by the CBI like other errant central government officers. Extension of Lokpal/ CBI to state governments will remove this lacuna. However, the CBI and Lokpal would have to be trained properly and power given to officers senior in rank so that there is no miscarriage of justice and no honest officers suffer due to shoddy/ malafide/inept/ investigations carried out by ill trained/ ill educated junior officials. For this, and for the additional manpower needed, large chunk of IPS officers will have to be inducted into the CBI at the level of SPs who may be further trained and posted in the CBI and Lokpal only, though they would remain IPS officers and they should not be repatriated to their cadres unless they opt to go back. These SPs and senior level officers should be in charge of investigations and not ill trained and ill educated DySPs and Inspectors.

These institutes are not only arm twisting parents to charge huge fee but arm twist to collect even more money on many pretext because being run by some mafia. they not only ill treat innocent young students but also call parents and threat them openly for not toeing their line. Their behaviour is like a thanedar and child and parents are criminal. Atleast they must improve their behaviour and try to be just and logical. It is hoped that authorities should also listen and address upon.

RTI DPS is a Public Authority
Information related to admission made by the Delhi Public School (DPS), Rohini under the policy framework specified by the Department of Education (DoE) for the academic year 2010-2011 was denied claiming that since it is an Unaided Private Institution, the RTI Act is not applicable to the school. The CIC noted that 10,000 sq. mtrs. of land was allotted to the School by the DDA at a nominal rent of Rs. 10/- per annum while another 6000 sq. mtrs. have been allotted at concessional rate of Rs. 65 lacs per acre. The CIC observed that the terms and conditions of service of employees of DPS are as per the norms of DoE and the School enjoyed exemption from Income Tax on its earnings. The presence of two nominees from the DoE in the Managing Committee indicated the Government control in the running and administration of the DPS. The CIC held that the DPS, Rohini fulfills the essential elements of being called a 'Public Authority'.
Comments Getting a child admitted in a good school has been very difficult
for the residents of Delhi. Hopefully, this order would usher in transparency
in the working of the educational institutes in the country who shall
now be bound to designate PIOs.
