Empanelment process in GoI is unfair
The present process of empanelment in the Government of India (GoI)
which is more or less on colonial lines is neither objective nor fair
or transparent and susceptible to bureaucratic and political pressures.
The above is the conclusion of the survey conducted by the whispersinthecorridors.com
asking the surfers - Is the empanelment process in GoI fair and legal?
And the response of the majority was that besides being bereft of
objectivity and unfair, the process is highly politicised and so secret
that it gives an impression of lack of fairness and something fishy
in the process.
"The present practice is neither objective nor fair nor transparent,
susceptible to bureaucratic and political pressures. It suffers from
serious lacunae as the assessment relies on Annual performance appraisal
reports", said one surfer adding that the methodology is subjective,
arbitrary, based on 'pick and choose' and thus legally untenable.
This, according to surfer explains why the former Cabinet Secretary
refused to disclose the selection criteria treating the process outside
the ambit of RTI Act 2005 despite CIC's directions to keep the selection
criteria in public domain in response to an RTI application.

Who Probes the Spurious Cardiac Drug Case: Punjab Police or FIA
After the federal investigation agency (FIA) arrested the medical superintendent
of the Institute of Cardiology, Dr Jaffar Saleem in the spurious drug
case in which over 100 patients lost their lives. The Punjab government
has deployed the provincial police at the residence of senior health
department functionaries to prevent their arrest by the FIA. The provincial
government has also formed a special investigation team under its own
DIG, Zulfikar Cheema with another DIG, Farook Mazhar and SSP, Zulfikar
Hameed assisting him. The senior functionaries of the health department
at whose residences the provincial police has been deployed include
the health secretary, DG health, Medico legal surgeon of the province
and the Deputy MS of the
cardiology institute.
ISI Beyond the Reach of Criminal Justice System
say Rights Groups
Commenting on the role of ISI in the killing of journalist Saleem Shehzad
and the failure of the government appointed commission to identify the
killers Human Rights Watch has commented that it illustrates the spy
agency's ability to remain beyond the reach of the country's criminal
justice system'. According to Brad Adams, Asia Director of HRW the ISI's
abuses shall stop only if the agency is subjected to the rule of law,
civilian oversight and public accountability adding, it is the government's
duty to insist on such accountability and the military's duty to submit
to the same. The ISI must stop acting as a state within state'.
Islamabad Police Starts Aerial Surveillance
to Combat Security Threats
Police has started helicopter borne aerial surveillance of the city
and the nearby Margalla hills after reports of some militants hiding
in the hills ready to strike the capital. The reports emerged after
interrogations of two suspects who were detained in Texila during combing
operations launched in the wake of rockets fired at the military academy
in Abbottabad a few days back. The surveillance shall continue till
5th February and the cops carrying out the same shall be fully equipped
for their own safety as well as for real time communication with their
colleagues on the ground.
Shobha De to Attend Karachi Lit Fest
Karachi will host a literary festival for two days from Feb 11, 2012.
The festival organised by Oxford university press and British council
will be the third of its kind in the Pakistani city. Indian writer in
English Shobha De, William Darlymple and Hanif Kureishi are some of
the prominent literary figures expected to attend. "The idea behind
the event is to celebrate the rich literary past of the city. Be it
Sindhi, Urdu or English, Karachi has always been the hub of literary
activities in past", says one of the organisers Asif Farrukhi.
SAIL gets MoU Excellence Award for 8th year
in a row (UPDATED)
Prime Minister of India Dr Manmohan Singh on January 31,2012 presented
the MoU Excellence Award in the Mining & Metals category to Maharatna
Steel Authority of India Limited. The award was received by SAIL Chairman
C.S. Verma in the presence of Minister for Heavy Industries & Public
Enterprises Praful Patel, at a glittering function held at Vigyan Bhawan,
organized jointly by Department of Public Enterprises and Standing Conference
of Public Enterprises (SCOPE).
On receiving the award, SAIL Chairman Verma said, "the fact that
SAIL has been winning this award year after year stands testimony to
our internal strength and our deep-rooted values. The award is an acknowledgement
of our efforts, and we shall strive ceaselessly to keep improving and
bettering ourselves". Starting from 2002-03, it is for the eighth
consecutive year that SAIL has won the MoU Excellence Award. SAIL is
implementing a massive modernization and expansion plan to enhance its
hot metal production capacity from 14 million tons per annum (Mtpa)
to 23.4 Mtpa at an investment of about Rs. 72,000 crore. This multi-pronged
plan, besides targeting higher production, also addresses the need for
cost competitiveness by introducing state of the art technologies and
eliminating technological obsolescence, achieving energy savings, enriching
product mix, reducing pollution, developing mines and collieries, introducing
customer centric processes and developing matching infrastructure facilities.
Under its long-term strategic plan called 'Strategy 2020', the company
plans to scale up production of steel to a level of 45 to 60 million
tonnes, and diversify into related areas of operation, so as to optimize
business opportunities and de-risk business from fluctuations in business
cycle.SAIL has been making continued efforts for ensuring raw material
security and forging alliances with global entities for tapping new
markets. In this direction, SAIL-led consortium of Indian public and
private steel and mining companies submitted a winning bid for mining
exploration rights at Hajigak, Afghanistan and has been allotted three
blocks with an estimated reserve of 1.28 billion tonnes of high-grade
iron ore. For facilitating acquisition of coking coal assets, a JV company
led by SAIL, International Coal Ventures Private Limited (ICVL), is
in the process of identification of coking coal assets and mines which
could become a sustainable source of coking and thermal coal for the
promoter companies. SAIL has also taken new strategic initiatives to
augment technological interventions, including the newly-launched R&D
'master plan' of SAIL aimed at facilitating "acquisition and development
of appropriate technologies for sustainable growth". SAIL is also
working for bringing emerging iron making technologies to India. It
has formed a 50:50 JV with Kobe Steel of Japan for setting up a 0.5
MTPA ITmk3® technology based plant at Durgapur and is in advanced
talks with POSCO for 3 MT Finex technology based plant at Bokaro.

NMDC's best 3rd quarter financial results
ever (UPDATED)
NMDC Limited achieved commendable performance for the quarter ended
December 31, 2011. These are the best results for the 3rd quarter financial
results since inception. The unaudited financial result for the 3rd
quarter 2011-12 was taken on record by the Board under the chairmanship
of N K Nanda, CMD, NMDC today. There is an improvement in its iron ore
sales performance by 29.57 lakh tonnes (16.5%) during this nine months
ending with its previous corresponding period performance with a significant
improvement in off-take by its domestic customers. The turnover for
the 3rd quarter of financial year 2011-12 increased to Rs.2,822 crore
when compared with Rs.2,621 crore for corresponding period of previous
year, registering an increase of 8%. The turnover for the nine months
ended 2011-12 increased to Rs.8,667 crore when compared with Rs.7,599
crore for corresponding period of previous year, registering an increase
of 14%. For the third quarter PBT, in comparison with that of the corresponding
period of previous year, rose to Rs.2,752 crore from Rs.2,281 crore,
registering an increase of 21%. The PBT for the nine months ended 2011-12
in comparison with that of the corresponding period of previous year,
rose to Rs.8,320 crore from Rs.6,587 crore, registering an increase
of 26%. For the third quarter PAT, in comparison with that of the corresponding
period of previous year, rose to Rs.1,859 crore from Rs.1,518 crore,
an increase of 22%. The PAT for the nine months ended 2011-12 in comparison
with that of the corresponding period of previous year, rose to Rs.5,623
crore from Rs.4,401 crore, an increase of 28%. The Board of Directors
has approved in its meeting held on 31.01.2012, a further interim dividend
of Rs.1/- per equity share for the Financial Year 2011-12. With this
the total interim dividend declared during the year is Rs.2/- per equity
share. The Earnings per share (EPS) stood at Rs.4.69 per share for this
quarter against Rs.3.83 of the 3rd quarter of 2010-11). The Earnings
per share at Rs.14.18 per share for the nine months ended 2011-12 in
comparison with that of the corresponding period of previous year of
Rs.11.10 per share. The EPS figures mentioned are not annualised. The
domestic sales of iron ore were increased by 25% where as exports were
reduced by 75% for catering to the needs of the domestic market, improved
physical performance coupled with higher prices, transparent pricing
systems and improvement in evacuation by railways resulted in the company
posting a net post tax profit of Rs.5,623 crore for the nine months
ended 2011-12. The company has been pursuing all its expansion programmes
and NMDC as part of its forward integration programme and value addition
is setting up a 3 MTPA steel plant at Nagarnar in Chhattisgarh, for
which the land acquisition has been completed in August 2010 and major
packages are being finalized and awarded.

Orissa Chief Minister Navin Patnaik has asked
Cabinet Ministers to maintain dignity of the office. Patnaik conveyed
his mind when a Minister addressed "Sir" to an IAS officer
in his presence. "You are Cabinet Minister and should maintain
your dignity" the Chief Minister said. How far it is appropriate
or inappropriate for an elected representative to address a bureaucrat
as "Sir".

Stop the menace
Renting of government accommodation is a menace and it should be stopped.
The inspectors of Directorate of Estates are hand in gloves and nothing
happens.

Illegal retention of govt accommodation
The normal period of retention of Government accommodation after retirement
is four months and extended by another four months on medical grounds
but unfortunately one can retain accommodation for any number of years
with the connivance of UDM employees. The fact can be verified from
the Directorate of Estate website that retired employees keep on manipulating
their extended stay in connivance with the DOE employees and ex employees
of UDM/CPWD are the main culprits. Are
these irregularities not known to higher ups in the Ministry or they
tend to ignore it. Most of the accommodations allotted to UD employees
and CPWD officials are available on rent. Please look into it and have
mercy on the employees who are in dire need of accommodation. One can
only wish and hope that Directorate of Estates gets well soon.

Apropos comments appearing in WIC (31.01.2012) under caption 'Date
with RTI', Section 4(1)(d) of RTI Act, 2005, which stipulates that every
public authority shall provide reasons for its administrative or quasi-judicial
decisions to affected persons, is relevant. Therefore, apart from its
underlying spirit, RTI Act, 2005, specifically mandates proactive dissemination
of decision on representation (rather than invocation of the RTI Act
to force its disclosure).

Hussain & Rushdie have made millions by making fun of India's religions
M F Hussain and Salman Rushdie have one thing in common. They have made
millions of dollars by making fun of India's religions in the West.
They pander to their Western audience and will stoop to any depths to
insult their motherland for a few dollars more. Their mindset is colonial
and the west, particularly Britain pampers such traitors. The Indian
intelligentsia follows in the wake of the West and it has yet to get
over its slavish mentality, that's why they are all wringing their hands
over the so called denial of freedom of artistic expression to Rushdie.
So far I have yet to come across one English news channel in India which
has the courage to call off Hussains and Rushdies bluff. Both are artists
and novelists of very dubious value. Rushdies Midnights Children is
a rehash of Gunther Grasses, novel, The Tin Drum. This is straightforward
plagiarism. As for Hussains paintings, the less said the better. The
Emperor has no clothes and no one in India has the guts to say so. Arundhati
Roys novel ,The God of Small Things, was much applauded in Britain but
I could barely read it as it was so awful! This is yet another example
of the west telling the Indian elite what is in good taste by rewarding
those who serve its own political and cultural agenda of global domination.

Using RTI to get a CGHS claim cleared
In respect of a CGHS claim, an appellant sought the details of items
of theclaim which weredisallowed by CGHS along with the reasons and
the copies ofcirculars on the basis ofwhich the items were disallowed,
and whether thecirculars were available onthe CGHS site. The PIO demanded
Rs. 8/- for the 4 pagesof information whichwere duly deposited by the
appellant. He was not satisfiedwith the replysupplied by the PIO and
filed an appeal before the FAA who askedthe appellantto visit the office
of FAA on any working day by appointment fordiscussing theRTI of Appellant.
After a perusal of the papers, the Commissionobserved thatthe information
has not been supplied to the Appellant despitepayment of theadditional
fee. The Commission directed to provide theinformation to theAppellant
before 05 February 2012 and issued a notice to thePIO why penalty shouldnot
be levied on him.
Comments
The case discussed above shows how the RTI Act can be used to solve
some of theproblems which the government servants encounter on day-today
basis.
