UPSC to hold (Pre) Exam, 2012 for recruitment
to IAS, IPS, IFS, others on May 20
The Union Service Public Commission (UPSC) will hold the Civil Services
(Preliminary) Examination, 2012 on May 20, 2012 for recruitment to the
Indian Administrative Service, Indian Foreign Service, Indian Police
Service and certain other Group 'A' and Group 'B' Central Services/Posts.
The examination will be held at various centers across the country.

PM gilani may not face disqualification even if convicted
After going through the charge against Prime Minister YR Gilani as framed
by the seven judge bench of the apex court legal experts in Pakistan
feel that the PM may not suffer disqualification from holding public
office even if convicted by the court. According to article 63 (1) (g)
of the constitution disqualification is deemed if a person is found
to be guilty of "defaming or ridiculing the judiciary or compromising
the integrity or independence of the judiciary". The charge framed
against the PM reads, "You Syed Yusuf Raja Gilani, Prime Minister
of Pakistan wilfully flouted, disobeyed and disregarded the direction
given by this court............which direction you were legally bound
to obey". Pakistan's legal pundits term it as 'civil contempt'
and not 'criminal contempt' not liable to result in automatic disqualification.
Sentence of a prison term in the instant case too may not result in
disqualification as the maximum sentence possible in the case is for
six months whereas article 63 (1) (h) as amended vide the recent 18th
amendment lays down a minimum two years jail term to result in disqualification
for contesting elections to
the national or any provincial assembly.
Overseas Pakistanis get voting right
In a landmark decision the election commission of Pakistan (ECP) has
allowed nearly 4 million Pakistanis living abroad the right to vote
in the country's general elections. The decision was taken at a meeting
of the ECP chaired by its Secretary Ishtiaq Ahmed Khan on 14th February
2012.
Law permits ISI to pick up civilians
In Pakistan the army doesn't need armed forces special powers act as
the ISI has the legal right to pick up any civilian and try him under
the Army Act 1952. This was disclosed to media persons on 13th February
by a retired officer of the JAG branch Col Ianmur Rahim who after retirement
is a practising lawyer. The only requirement, Col Rahim said was to
ensure that the person so detained is produced for trial before a court
martial within eight days of the arrest. More often than not the ISI
fails to comply even with this basic requirement and the detainees are
kept in illegal confinement without trial for years together. The seven
detainees who were produced before the apex court on 13th February because
of a habeas corpus petition were picked up by the ISI from the Adiala
jail in May 2010 and they continued to be in custody without any trial
right up to the time they were produced in the court.
"We were treated worse than animals"
Detainees Narrate Their Ordeal
The seven detainees picked up by ISI who were produced before a three
judge bench of the supreme court on 13th February narrated their tales
of horror to journalists when they were briefly brought into the Attorney
General's office in the court premises to meet their family members.
Sick, famished and in tatters they said while in the ISI run detention
centre they were kept blind folded and given only two minutes twice
daily for answering the calls of nature. They were kept in a basement
and had to sleep on bare floor during winters with a window kept open
all through the night. A little bit of watery chana dal and stale dry
bread was the only food given to them. The supreme court has directed
that they will now on be kept in the custody of the provincial government
and not returned to the ISI custody.
PSU staffers up in arms over victimisation
of an honest colleague
Staffers including senior managers of the Sui Northern Gas & Pipeline
(SNGPL) a federal government controlled PSU took out a protest march
in Lahore against what they termed 'victimisation of an honest colleague'.
Shaukat Shahid an Executive Engineer of the PSU had earned the wrath
of Raja Riaz member of the national assembly (MNA) belonging to the
ruling PPP from Faisalabad as he had raided the MNA's factory and slapped
a recovery bill for 'theft of natural gas'. The MNA flaunting his political
connection had the engineer arrested by FIA on 'trumped up charges'
even after the engineer had been exonerated by an internal inquiry into
the same charges. The staffers claimed that Shaukat Shahid is an upright
officer who has during his service career
unearthed several cases of gas theft by influential persons and recovered
more than 340 million rupees from the defaulters.
Doctor duo ends up with plum postings pending
inquiry
Dr Fayaz Ahmed Ranjha has been appointed DG health in the federal government
and his erstwhile colleague Dr Ikram given the prestigious post of MS
of the Infectious Disease Hospital Lahore. Both of them are facing charges
of embezzlement of over Rs 1.3 million in a case relating to purchase
of insecticides and disinfectants in the last quarter of 2010 when both
were posted in the Lahore district government's health wing. An inquiry
ordered under the Punjab government employees efficiency, discipline
and accountability rules 2006 is pending as Amir Ashraf Khwaja MD of
the tourism orporation who was appointed inquiry officer was transferred
to the federal government before completing the inquiry and Chowdhary
Mohammad Iliyas Secretary GAD appointed in his place is yet to commence
the proceedings.

Nationalist approach of Pakistani Judiciary
In Pakistan on the issue of bringing back the wealth of their people
stashed abroad, the Supreme Court has not only summoned their Prime
Minister but also charge-sheeted him because this is the time when people
are shameless; thick skin and unless they are kicked they would not
buzz. In India, the burglary was taking place and the security
guard was looking away and when this was brought to his notice, he says
" manu durr rakho te zo marji karo'. The Courts in the India are
exercising restraints but how long and whether any change would come
in this way is a moot question. There are cases of CVC appointment;
2 G spectrum and non-action on the complaint. But it also happens only
in India. In real sense the effectively, the corruption can be curbed
by raising the moral values and our leaders should exemplify but it
is vice versa since leaders are indulge in corrupt practice and enjoying
the life, the followers also follow this practice.

Reasons for continuation of a person on sensitive post beyond policy
The appellant referred to the Railways policy for the tenure of four
years for the sensitive posts for officials. He sought information about
the continuation of two employees on the sensitive post beyond the policy
prescription. The Commission directed to provide the reasons in the
form of file noting or orders for not transferring the two employees
as available on record.
Comments
The transparency ushered by the RTI Act is likely to lead to more such
applications in the times to come as transfer / posting remains an area
of contention in the service. It is noteworthy that section 4 of the
RTI Act mandates a public authority to provide reasons for its actions
to the affected persons.
