Empanelment process in GoI is unfair
The present process of empanelment in the Government of India (GoI)
which is more or less on colonial lines is neither objective nor fair
or transparent and susceptible to bureaucratic and political pressures.
The above is the conclusion of the survey conducted by the whispersinthecorridors.com
asking the surfers - Is the empanelment process in GoI fair and legal?
And the response of the majority was that besides being bereft of
objectivity and unfair, the process is highly politicised and so secret
that it gives an impression of lack of fairness and something fishy
in the process.
"The present practice is neither objective nor fair nor transparent,
susceptible to bureaucratic and political pressures. It suffers from
serious lacunae as the assessment relies on Annual performance appraisal
reports", said one surfer adding that the methodology is subjective,
arbitrary, based on 'pick and choose' and thus legally untenable.
This, according to surfer explains why the former Cabinet Secretary
refused to disclose the selection criteria treating the process outside
the ambit of RTI Act 2005 despite CIC's directions to keep the selection
criteria in public domain in response to an RTI application.

Orissa Chief Minister Navin Patnaik has asked
Cabinet Ministers to maintain dignity of the office. Patnaik conveyed
his mind when a Minister addressed "Sir" to an IAS officer
in his presence. "You are Cabinet Minister and should maintain
your dignity" the Chief Minister said. How far it is appropriate
or inappropriate for an elected representative to address a bureaucrat
as "Sir".

NMDC's best 3rd quarter financial results
ever
NMDC Limited achieved commendable performance for the quarter ended
December 31, 2011. These are the best results for the 3rd quarter financial
results since inception. The unaudited financial result for the 3rd
quarter 2011-12 was taken on record by the Board under the chairmanship
of N K Nanda, CMD, NMDC today. There is an improvement in its iron ore
sales performance by 29.57 lakh tonnes (16.5%) during this nine months
ending with its previous corresponding period performance with a significant
improvement in off-take by its domestic customers. The turnover for
the 3rd quarter of financial year 2011-12 increased to Rs.2, 822 crore
when compared with Rs.2, 621 crore for corresponding period of previous
year, registering an increase of 8%. The turnover for the nine months
ended 2011-12 increased to Rs.8, 667 crore when compared with Rs.7,
599 crore for corresponding period of previous year, registering an
increase of 14%. For the third quarter PBT, in comparison with that
of the corresponding period of previous year, rose to Rs.2,752 crore
from Rs.2,281 crore, registering an increase of 21%. The PBT for the
nine months ended 2011-12 in comparison with that of the corresponding
period of previous year, rose to Rs.8,320 crore from Rs.6,587 crore,
registering an increase of 26%. For the third quarter PAT, in comparison
with that of the corresponding period of previous year, rose to Rs.1,859
crore from Rs.1,518 crore, an increase of 22%. The PAT for the nine
months ended 2011-12 in comparison with that of the corresponding period
of previous year, rose to Rs.5,623 crore from Rs.4,401 crore, an increase
of 28%. The Board of Directors has approved in its meeting held on 31.01.2012,
a further interim dividend of Rs.1/- per equity share for the Financial
Year 2011-12. With this the total interim dividend declared during the
year is Rs.2/- per equity share. The Earnings per share (EPS) stood
at Rs.4.69 per share for this quarter against Rs.3.83 of the 3rd quarter
of 2010-11). The Earnings per share at Rs.14.18 per share for the nine
months ended 2011-12 in comparison with that of the corresponding period
of previous year of Rs.11.10 per share. The EPS figures mentioned are
not annualised. The domestic sales of iron ore were increased by 25%
where as exports were reduced by 75% for catering to the needs of the
domestic market, improved physical performance coupled with higher prices,
transparent pricing systems and improvement in evacuation by railways
resulted in the company posting a net post tax profit of Rs.5, 623 crore
for the nine months ended 2011-12. The company has been pursuing all
its expansion programmes and NMDC as part of its forward integration
programme and value addition is setting up a 3 MTPA steel plant at Nagarnar
in Chhattisgarh, for which the land acquisition has been completed in
August 2010 and major packages are being finalized and awarded.

R P Singh has been appointed Chairman & Managing Director (CMD)
of public sector SJVN Limited by the Government of India. Earlier Singh,
as Director (Electrical), had been holding additional charge of this
position since March 1, 2011. In addition, R.P. Singh will continue
to hold the charge of Director (Electrical) till appointment of a regular
incumbent on the position. R P Singh has since assumed charge of the
new position.

communication in a democratic country as it goes against the tenet "Equality".
In India, it remains as a vestige of colonial rule and should be banished
now.

Does SC judgement calls for rectifying the procedures suitably?
Will the Supreme Court judgement of Jan 31, 2012 on delay by the PMO
in dealing Swamy's letter provide a defence to officers in the Government
hierarchy against charges of delay in dealing with letters and files
not put up to them and the dealing assistants would be solely held responsible
for delays in such matters? If that be so, does it not call for rectifying
the procedures suitably? Will some knowledgeable person discuss the
issue threadbare as the Indian bureaucracy is quick to take advantage
in such matters.

be finalised in this FY itself for AY 2011-12. It should not roll over
next FY. Let IT department to pay interest on delayed refund as IT department
charges penal interest on delay in payment of tax. ITRs which has been
filed electronically still waiting for assessment to be finalised. It
defeats all the merits of e-filing when it is not completed in time
bound manner. All the best.

Mocking Ourselves?
Elections are over in Punjab & Uttarakhand, but results will be
declared on March 4th (i.e. after 33 days!). This is strange in this
age of information revolution. The EVMs were made available so that
results could be declared the same day. Why do we display so much diffidence
in ourselves? Why do be stall application of technology? Why do we not
trust the wisdom of the mature Indian voter, who is past all absurd
influences? Why do we mock democracy so brazenly? The days of ideology
or two parties contesting are already over. In a country terribly divided
on caste and communal lines, nobody can influence anybody else. The
voters are committed. Elections are being fought on thoroughly local
issues. Results in one state don't matter in another. It is not parliament
election. Besides electronic data in the EVMs can be corrupted in this
era of high-technologists, who operate from cyber kingdom and are capable
of performing any technological wonders. There is no justification for
delay in counting & declaration of results for states where elections
are already over.

Using RTI to get a CGHS claim cleared
In respect of a CGHS claim, an appellant sought the details of items
of theclaim which weredisallowed by CGHS along with the reasons and
the copies ofcirculars on the basis ofwhich the items were disallowed,
and whether thecirculars were available onthe CGHS site. The PIO demanded
Rs. 8/- for the 4 pagesof information whichwere duly deposited by the
appellant. He was not satisfiedwith the replysupplied by the PIO and
filed an appeal before the FAA who askedthe appellantto visit the office
of FAA on any working day by appointment fordiscussing theRTI of Appellant.
After a perusal of the papers, the Commissionobserved thatthe information
has not been supplied to the Appellant despitepayment of theadditional
fee. The Commission directed to provide theinformation to theAppellant
before 05 February 2012 and issued a notice to thePIO why penalty shouldnot
be levied on him.
Comments
The case discussed above shows how the RTI Act can be used to solve
some of theproblems which the government servants encounter on day-today
basis.
