Present bureaucratic perception on UP

Present bureaucratic perception about ensuing assembly polls to Uttar Pradesh indicates SP - No.1 slot with 110 to 140 seats; BSP -No. 2 slot with a tally of seats in double digit; BJP no.3 with 90 to 100 seats; Congress no 4 with 60 to 70 seats. This scenario stems out of the fact that voters of Brahmins & most backward classes i.e. Kushwahas & Mauryas are reportedly not backing the BSP + anti incumbency against BSP. Graph of Congress, BJP and JD-U -in Eastern UP to go up. Regional parties to get about 50 seats.

Empanelment process in GoI is unfair

The present process of empanelment in the Government of India (GoI) which is more or less on colonial lines is neither objective nor fair or transparent and susceptible to bureaucratic and political pressures.

The above is the conclusion of the survey conducted by the whispersinthecorridors.com asking the surfers - Is the empanelment process in GoI fair and legal?

And the response of the majority was that besides being bereft of objectivity and unfair, the process is highly politicised and so secret that it gives an impression of lack of fairness and something fishy in the process.

"The present practice is neither objective nor fair nor transparent, susceptible to bureaucratic and political pressures. It suffers from serious lacunae as the assessment relies on Annual performance appraisal reports", said one surfer adding that the methodology is subjective, arbitrary, based on 'pick and choose' and thus legally untenable.

This, according to surfer explains why the former Cabinet Secretary refused to disclose the selection criteria treating the process outside the ambit of RTI Act 2005 despite CIC's directions to keep the selection criteria in public domain in response to an RTI application.

Manufacturing, infrastructure, energy sectors need fresh impetus: Dhoot

ASSOCHAM president-elect Rajkumar Dhoot today emphasized the need for new impetus to manufacturing sector, boost in physical and social infrastructure with large doses of investments and tax relief and ensuring energy security with tax holidays for oil and gas exploration activities. At the pre-Budget discussion with finance minister Pranab Mukherjee, he also called for greater interaction and coordination between the industry and the government to keep up the economic growth momentum. Dhoot institutions like India Infrastructure Finance Company Limited (IIFCL) and Life Insurance Corporation should disburse more funds for developing infrastructure while the government coordinates effectively for timely clearances, approvals and implementation of projects. To curb the menace of black money, laws must be enacted to ensure transparent public funding during elections. Immunity should be provided to persons declaring unaccounted money so that funds stashed abroad illegally get back into the country's economic system. Dhoot said there is urgent need to improve social infrastructure and public private partnerships must be encouraged to provide education, healthcare and clean drinking water for all citizens. For the manufacturing sector which can create lakhs of new jobs, investment allowance should be introduced as deduction from profit to the extent of new investment in plant and machinery. The rate of depreciation on plant and machinery should be restored to 25 per cent from 15 per cent currently. "The increase in rate of depreciation in long run is revenue-neutral as the total amount cannot exceed the cost of assets." Tax benefits to hill states and northeastern states should be extended for two more years, said Dhoot. ASSOCHAM believes integrating excise and service tax into central Goods and Services Tax will make the Indian industry competitive. The chamber fully supported the government's initiative to widen the base of service tax and cover all services except those in the negative list.

Orissa Chief Minister Navin Patnaik has asked Cabinet Ministers to maintain dignity of the office. Patnaik conveyed his mind when a Minister addressed "Sir" to an IAS officer in his presence. "You are Cabinet Minister and should maintain your dignity" the Chief Minister said. How far it is appropriate or inappropriate for an elected representative to address a bureaucrat as "Sir".

Using RTI to get a CGHS claim cleared


In respect of a CGHS claim, an appellant sought the details of items of theclaim which weredisallowed by CGHS along with the reasons and the copies ofcirculars on the basis ofwhich the items were disallowed, and whether thecirculars were available onthe CGHS site. The PIO demanded Rs. 8/- for the 4 pagesof information whichwere duly deposited by the appellant. He was not satisfiedwith the replysupplied by the PIO and filed an appeal before the FAA who askedthe appellantto visit the office of FAA on any working day by appointment fordiscussing theRTI of Appellant. After a perusal of the papers, the Commissionobserved thatthe information has not been supplied to the Appellant despitepayment of theadditional fee. The Commission directed to provide theinformation to theAppellant before 05 February 2012 and issued a notice to thePIO why penalty shouldnot be levied on him.

The case discussed above shows how the RTI Act can be used to solve some of theproblems which the government servants encounter on day-today basis.
