Bihar Government being headed by Chief Minister Nitish Kumar, will be organizing a three day global summit in Patna to draw a road map for the development of Bihar. It will be held from February 16, 2012. A galaxy of experts, besides NRIs from Bihar, based in UK, USA and Canada will attend the summit. Certain economists including those from London School of Economics (LSE), London, who have studied Bihar in the past, will as well attend the maiden mega event of its kind.

Joy ride for police, magistracy in stolen cars

Islamabad High Court has ordered a thorough inquiry into allegations that some police officers have been encouraging car thefts in the city and the unclaimed recovered vehicles are being distributed on 'superdari' for personal use by senior police officers and magistrates. Eleven such cases, where the unclaimed stolen vehicles confiscated by the police have been made over inter alia for personal use of Islamabad (West) Judicial Magistrate, Magistrate (sudder), City Magistrate, Asstt Commissioner (sudder) and Asstt Commissioner (PM Secretariat), have been identified. The vehicles being used by these worthies include Corolla luxury cars, Toyota jeeps and Suzuki Mehran. Coming down heavily on the scamsters the high court has directed that apart from legal action a suitable entry should also be made in the CRs of the concerned officials and magistrates regarding their misconduct. During 2011 Islamabad police registered 396 cases of car theft and recovered 79 vehicles out of which the unclaimed vehicles were distributed on 'superdari'.

SC admits petition against possible sacking of Army Chief, ISI, DG
A three judge bench of Pakistan's Supreme Court has admitted a petition filed by Advocate FK Butt praying for restraining the federal government from sacking Army Chief Keyani and DG ISI Shuja Pasha. The petition filed soon after the sacking of the former Defence Secretary, Naeem Khalid Lodhi was returned by the apex court's registrar as not being maintainable but the bench presided over by Chief Justice, Iftekhar Mohammad Chowdhary dismissed the registrar's objection and admitted the petition for hearing. In the normal course Gen Keyani is to retire on 29 November 2013 and Shuja pasha on 19th March this year.

Transit facility for NATO supplies through Pakistan likely to be restored
Transit facility for military hardware and other supplies for NATO troops in Afghanistan stopped some two months back in retaliation for NATO attack on Pakistani military outpost is likely to be restored after Pakistan's Parliament finalises new terms for the facility in the middle of February. Pakistan's Defence Minister, Chowdhary Ahmed Mukhtar in an interview to a private TV channel has advocated for restoration of the facility on a frame work of enhanced fees as the heavy trucks used for the supplies cause more damage to the roads than the normal goods carriers. The US is reportedly spending six times more to have the supplies delivered to the troops through alternative routes. Baluchistan on the Agenda of US House Committee on Foreign Affairs The US committee on foreign affairs is scheduled to devote a full session to discussion on Pakistan's troubled province of Baluchistan on 8th February 2012. The meeting is to be chaired by Republican Congressman Dana Rohrabacher co-author of a recent article with another congressman Louie Gohmert expressing support for an independent Baluchistan. The committee is likely to record testimony of three expert witnesses; a known pro Baluch independence supporter defence analyst Ralph Peters, an equally well known pro Pakistan (and obviously anti Baluch movement) professor of Georgetown university Christine Fair and Ali Dayan Hassan, Pakistan Director of Human Rights Watch. Pakistan watchers fear that the committee's deliberations might result in massive negative publicity for Pakistan on account of reports of massive human rights violations by the security forces in the province.

Beauty of English prose!

I have studied the order of Judge O.P.Saini in the PC v/s SS. The entire order is an impressive scissors and paste work of several pronouncements of the Supreme Court & foreign courts. Hence criminal conspiracy also may be seen differently in different geographies. But none of the citations matches the 2G scam case. However, one fact is established: the ministers of the Congress Party had acted by the law. First it was the Law Minister, who advised that the whole issue be first considered by an empowered group of ministers in view of the case and various options indicated in the statement of the case.A responsible Telecom Minister should have become cautious after such sane advice. Then came the PM who directed the telecom minister to auction and not allot on FCFS basis in letter dated 02.11.2007 Then entered FM (PC).Judge Saini has recorded that the complaint didn't contain any allegations against PC nor any evidence led initially by SS when he examined himself on 07.01.2011. However, on 15.09.2011 the complainant filed an application under sec 311CrPC for summoning/recalling of witnesses for examination on behalf of the complainant and in that application only allegations were leveled against PC. The said application was allowed on 08.12.2011 and thereafter the complainant examined himself on 17.12.2011 and 07.01.2012. On the strength of the SC rulings cited, the Special CBI Court did not find merit in the case and dismissed it. So, there is not much to complain against the Judge, though the media has given the impression that the words and expressions are those of Judge O P Saini. Interesting as it may be,one para from this order needs to be reproduced (which is quoted from the citations by the SC):"A man joins a conspiracy by word or deed. However criminal responsibility for a conspiracy requires more than a mere passive attitude towards an existing conspiracy. One who commits an overt act with knowledge of the conspiracy is guilty. And one who tacitly consents to the object of a conspiracy and goes along with other conspirators, actually standing by while the others put the conspiracy into effect, is guilty though he intends to take no active part in the crime." The real import of this particular para is not very clear. May be there are other players, yet to be unveiled. Decidedly the Congress is out of this murky affair, but the SC will be approached to revisit earlier rulings on criminal conspiracy in white collar crimes of the 2G kind, as more than economic and financial interests of the nation the very security of the country is at stake. It is a different matter how India should govern itself!(SS=Subramaniam Swami; PC=P. Chidambaram; FCFS=First Come First Serve).

Process of appointment of Ambassadors to be disclosed

The applicant sought various information from the Ministry of External Affairs (MEA) like the budget allocated to various divisions; salary and allowances being paid to the staff in Indian embassies; appointment process of Secretary/ Joint Secretaries/ Ambassadors; minutes of meeting of the Committees in MEA dealing with the above appointments etc. The PIO suggested the applicant to refer to some information available on the website of the MEA. The PIO further
informed that the appointment is as per the procedure laid down by the Government of India and as it involves examination of the ACR records of the officers, it cannot be provided under Section 8(1)(j) of the RTI Act. The minutes of meeting of the Committees in MEA dealing with the above appointments was denied under section 8(1)(a) of the RTI Act. The Commission accepted that it would not be in the national interest to disclose the quantum of allowances paid to the staff exemption under Section 8(1)(a) was upheld. The Commission, however, directed to provide the process of appointment. The PIO states that there are three boards for dealing with personnel and postings. The Commission directed to provide the information on these and minutes of the last three meetings of these board.

Comments

The process of appointment /posting at the senior level has been talked out in whispers in the power corridors. Officers from other services are also likely to use this order to remove the wall of secrecy surrounding such appointments.
