The Prime Minister is right in his vision and thinking but practically
it is impossible especially given the political developments of the
last few years which has created a situation wherein regional politics
is more powerful than the central politics. It is next to impossible
as civil servants are always under pressure from the political bosses.

Bangaru & the P.C Act
Bagaru Laxaman's case is a first of its kind , but the judgement in
this case is more than the first of its kind. Bits of the rhetoric employed
in the text of the judgement makes more interesting than instructive
reading. For example it talks, among other things, of "political
corruption". I tried to find a definition of political corruption
in the PCA but could not. In the process though, I was amused to see
that the Prevention of Corruption Act does not apply to Presidents of
political parties ! How could Bangaru be booked under, proceeded and
punished? The Act applies to "public servants" and the definition
of public servant is given in the Act itself. It does not need the brains
of a judicial Einstein to understand that the Act does not apply to
president of a political party and Bangaru was the President of a political
party when some money transaction took place between him and some other
person. But taking money is not synonymous with taking bribe. The law
goes strictly according to the language of the law and not journalese.
Since there are highly erudite legal brains savouring the Whispers in
the morning over a cup of coffee or tea, would they help ordinary visitors
like me if my understanding of the provisions of the PCA are anywhere
near seemingly correct ? We are not talking morality but cold law alone.
Morality, ethics, values will create tehelka for the media indulging
in seduction, sucking, inducement to get their way "yen-ken-prakaren"
from public servants and blackmail them too if need be ! Radia tapes
have exposed their real faces before the public.Is there even one person
who can say he/she is incorruptible. Just recall the Mohini offence
that worked on the Mahayogi Shiva or the story of viswamitra. The difference
is only of degree, by the Grace of God alone. Otherwise frailty thy
name is public servants!!!

No laudable feat of judicial activism!
This is with reference to 'Kudos for Pakistan's Judiciary' by Prashanth
(WIC 27-4-12). A nuanced analysis of the case would indicate that the
verdict is actually a soft coup and not a laudable feat of judicial
activism. If one were to consider a number of other politically sensitive
cases handled by the apex court in recent past one would see not only
the court's double standards but also a curious convergence between
the apex court's approach and the interests or wishes of the military
establishment and the fundamentalist elements within the political establishment.
Leaving aside merits of the contempt case against PM Gilani (and there
is a lot I can argue even on merits), let us look purely at the legal
angle. Gilani has been convicted under article 204 (2) of the constitution
of Pakistan read with section 3 of the contempt of court ordinance 2003.
This ordinance promulgated in 2003 and re-promulgated in 2004 by Parvez
Musharraf was, when brought before the national assembly (lower house
of the Parliament in Pakistan), was not agreed to be turned in to a
law and had therefore lapsed some time towards the end of 2004 and has
not been revived ever since. Contempt proceedings were initiated under
this ordinance against the IG Police of Islamabad who was accused of
publicly manhandling and abusing the present CJ in March 2007 but in
2009 this very Supreme Court upheld the argument of the counsel for
the IG that his client can't be punished under a non-existent statute
as the ordinance under which he has been punished had already lapsed
in 2004. The punishment meted out to the IG was accordingly suspended.
Now three years later in 2012 the court seems to have forgotten its
own stand and punished Gilani under the same ordinance brushing aside
the same argument advanced by Gilani's counsel and also the attorney
general of Pakistan who was appointed by the court as prosecutor against
Gilani.

RTI Act to be used with responsibility and with due care The appellant
sought various details and basis of the regulations for the management
of employees in the Public Authority. The Public Information Officer
(PIO) provided some information and the Appellate Authority directed
the PIO to provide inspection of the documents to the appellant after
the payment as per the prescribed fee under RTI (Regulation of Fee and
Cost) Rules, 2005. The Central Information Commission (CIC) noted that
the appellant has been overzealous in exercising the cherished right
given to him under the RTI Act and has put in over 35 RTI applications
and 22 appeals before the First Appellate Authority (FAA), seeking voluminous
and old information. Further, the appellant has chosen not to appear
even for a single personal hearing fixed by the FAA or before the Commission
even when the notice is served to him. The Commission warned the appellant
to exercise the right given to him under the transparency legislation
with responsibility and with due care and not use it as a tool for settling
personal scores or with the intent to disturb the smooth functioning
of the public authority.
Comments
The RTI Act should not be allowed to be misused or abused. Indiscriminate
and impractical demands or directions under RTI Act for disclosure of
all information may adversely affect the efficiency of the administration
and result in the executive getting bogged down with the non-productive
work of collecting and furnishing information.
