Cabinet to consider new land acquisition bill
next week: Anita Chaudhary (UPDATED)
The most expected upgrade on India's antiquated land acquisition laws
will be considered by the Cabinet next week and efforts are underway
to introduce the new National Land Acquisition and Rehabilitation and
Resettlement Bill during monsoon session of Parliament, said Chaudhary.
Speaking at an ASSOCHAM National Conference organized on August 1, on
Creating Land Banks For Development: Planning and Implementation, Mrs.
Anita Chaudhary, Secretary, Department of Land Resources, Ministry of
Rural Dev said that "the government is only going to be a regulator
and not regulating too much and that is balance of the bill is trying
to make, not trying to put obstacles in the way of industrialization
and at the same time farmers are not uprooted but rehabilitated and
resettled. Land acquisition policy changes proposed by the Central Government
along with the high cost of housing loans were making affordable housing
for the middle class a difficult proposition, real estate developers
said here today but department of land resources secretary Anita Chaudhary
underlined the need for striking a balance between the interests of
farmers and the land developers which would be the central feature of
the bill. "The land acquisition bill is not against the interest
of builder and industry" Mrs. Chaudhary assured. It is not a hurdle
but a facilitator and enough flexibility would be there in the final
version before the cabinet according to her. The Government was pushing
for updating and computerizing the land records that would help curb
land grabbing that was a major cause of discontent over land acquisition.
To harmonize the interests of farmers and the developers, Navin M Raheja,
Chairman, ASSOCHAM Real Estate Committee & CMD, Raheja Developers
Ltd suggested that land acquisition agency should create land banks
to which farmers could offer voluntarily offer their lands. In an analysis
of government land policy DLF group executive director Rajeev Talwar
pointed out that for all the regulations and DDA dominance, some 50
per cent of the people residing in the NCR were living in slums or unauthorized
colonies. According to T C A Anant, Chief Statistician and Secretary,
Department of Planning and Programme Implementation much of the problem
was due to "opaque rules regarding land use change". He referred
to the farmers stir in NOIDA against land acquisition and pointed out
that when the farmers found that the land taken from them by the Government
without specifying the purpose was being transferred to developers at
much higher price, they felt that they could have themselves sold it
to developers and directly benefited from it.

BHEL profit is up
The BHEL has reported a nearly 13 per cent jump in net profit at Rs
921 crore for the quarter ended 30 June 2012. It had posted a net profit
of Rs 815.5 crore in the April-June quarter of financial year 2011-12.

Change of guard
I many a times deeply think that retirement is a good thing. It brings
change. Old ones go and new ones come. It brings fresh ideas. Similar
is impact of transfers and postings. It also brings new persons to chair.
In department of posts, we all expect new change and positive mindset
when new officers join as DDG (Personnel) and Director (Staff). It is
a good thing. Department is bringing change. All pending work will now
be cleared fast. There is good hope for all.

Making their case stronger
There is a question of prestige in society also in this world. If you
allow the direct recruits SOs who belong to the Select List of Under
Secretaries for the years 2004 and 2005 to jump the queue and make them

court for enabling them to state that 'even government is agreeing to
arrangement'. Not to forget the Level 'E' training taken by these officials
in ISTM.

Information regarding the Cabinet meetings for a period of seven
years
The request for information in respect of the Cabinet meetings held
over a period of seven years was refused claiming that providing the
information about all the items/ subjects considered in the meetings
held during this entire period would disproportionately divert the resources
of the public authority and therefore, could not be disclosed as per
section 7(9) of the RTI Act. The Public Information Officer (PIO) denied
the decisions taken in the meetings under section 8(1)(i) stating that
they are a part of the Cabinet papers and it was for the sponsoring
ministry to decide finally if the Cabinet papers could be disclosed
having implemented the Cabinet decision. Regarding the minutes of the
meetings he invited the appellant to inspect the minutes register maintained
in the Cabinet Secretariat. During the hearing, the respondent explained
that every year, about 400 to 450 items came up for discussion in the
Cabinet from various ministries and departments of the government and
over a period of seven years, this number would be close to 3000 items.
He submitted that collecting and providing this information to the appellant
would be an extremely time consuming task and would disproportionately
divert the resources of the Cabinet Secretariat. However, he offered
that specific information in this regard would be provided if the appellant
would identify any particular item or a few of those items. The Central
Information Commission (CIC) agreed with the contentions of the respondent
and advised the appellant to be more specific and ask for details of
a few of these items so that the PIO can provide such information without
putting strain on the resources of the Cabinet Secretariat. The Commission
also observed that it is only the sponsoring Ministry or Department
which can take a decision as to whether a particular Cabinet decision
has been fully implemented or not; the Cabinet Secretariat cannot take
such a call and decide about disclosing any Cabinet decision except
those which arise out of any proposal of the Cabinet Secretariat itself.
Comments
The discussions in the matter point out that there is no mechanism
at the level of the cabinet to be regularly updated about what action
has been taken regarding a particular decision taken by it. It raises
a question whether there should be a monitoring mechanism with the Cabinet
to know of the fate of the decision taken by it?
