ASSOCHAM President to raise current issues
before FM
ASSOCHAM President Rajkumar Dhoot is likely to meet Finance Minister
P Chidambaram on August 20 with a view to pleading on the toughest issue,
in recent past, for industrialists and foreign investors i.e. GAAR.
Addressing to a Press Conference on General Anti Avoidance Rules, Dhoot
highlighted the hard pressed need for putting GAAR into a 'cold storage'
until a cost-benefit analysis is done in proper consultation with the
stake-holders. Ved Jain, Chairman of ASSOCHAM Direct Tax Council, said
that the Government of India should focus on the net-impact of GAAR
on Indian economy rather than the tax revenue collection only. Though,
Ved Jain, with a view to inject market sentiment and motivate investors,
Government of India, ASSOCHAM indicated, may take decision either to
put GAAR on hold or would take accelerated approach towards amendment
in regressive provisions of GAAR.

Mid career training of IRS officers at Gurgaon (MDI) and Dukes is good
as it gives exposure to IRS officers to global practices.

Declining standard of Civil Services
N Krishnan's slamming of 'certain ambassadors' is biased. His prescription
for churning the IFS out of IAS is simply laughable. There is no alchemy
for this conversion. While, the IFS is a 'Specialist (central) service',
the IAS is a generalist All India service with different focus and area
of operation. One can't make an apple out of an orange. Once, the IFS
was the numero uno career option. Not now. It has now fallen to 4th
or 5th career option after IAS, IPS,IRS (Custom and Income tax).The
latter services carry more authority and, of course, unmentionable privileges.
Their Service tags are easily recognizable and the life's minor irritants
get easily sorted out particularly in case of luxury postings.
Quality of Civil Service depends on quality of candidates selected
and number of vacancies . Larger vacancies results in steep decline
in qualifying standards. This explains the general decline in the quality
of civil services. Fulfilling Constitutional commitments on recruitment
can't be ignored either. Having said that, why should the IAS officers
get themselves 'demoted' to IFS? Let us not denigrate the Foreign service
that has produced excellent ambassadors, writers, authors, intellectual
bloggers and orators. Some have risen to become Vice President and Speaker
Lok Sabha. If the pliable IAS officers choose to serve under corrupt
politicians, who could force them to join the IFS?

Information Officer (PIO) citing the exemption provisions contained
in section 8(1)(h) of the RTI Act stating that the disclosure of the
information would impede the process of investigation. The Central Information
Commission (CIC) observed that it is not clear how the disclosure of
the advice given by the CVC in this case including the relevant file
noting would impede the process of the disciplinary proceeding/ prosecution
of the official concerned. The advice tendered by the CVC is an input
based on which the competent authority decides about the nature of the
disciplinary action to be taken in any particular case. The Commission
further held that the affected person should have a natural right to
know about the advice and the manner it is tendered. The CIC directed
the PIO to provide the advice tendered by the CVC in this case including
the file noting leading to the advice.
Comments
The manner in which the vigilance enquiries are being conducted require
a drastic change in the post RTI era. New mechanism and procedure need
to be devised to effectively conduct the investigations in a transparent
manner.
