Order relating to appointment of Alkesh Kumar Sharma as a Joint Secretary in Ministry of Road Transport & Highways, Government of India (GoI), have been issued. Sharma is Kerala cadre IAS officer of 1990 batch. Presently, he is the Managing Director (MD) of Kerala State Industrial Development Corporation (KSIDC). He is also Secretary to Government of Kerala, Industries (Investment Promotion) Department. He has held several other important posts including that of National Project Co-ordinator, UNDP Project, GoI, Private Secretary to Union Minister of State, Ministry of Housing & Poverty Alleviation, GoI and Director of Tourism, Government of Kerala. He has also been a Director of Apollo Tyres Ltd since February 09, 2012 besides being a Director at Bharat Petroleum Corp. Ltd. since June 30, 2010. Add to it, he has been a Non Executive Director of Nitta Gelatin India Ltd since July 17, 2009 and Geojit BNP Paribas Financial Services Limited since July 20, 2009. He has been a Director of Bamni Proteins Ltd since July 17, 2009. He serves as a Director of Western India Plywoods Ltd. He has been Director of PTL Enterprises Limited since February 2, 2012.

Allocation of charges in CBDT and CBEC today ?
Allocation of charges of members in CBEC and CBDT will be decided by FM today. Certain officers who were not favourites earlier and had been unceremoniously removed from their charges are likely to have their status restored. The senior most Member in both the Boards is also likely to be made in charge of Personnel and staff matters. Besides, history of postings and experience in relevant field determine the responsibilities to be entrusted. FM is also likely to thereafter effect major changes in Chief Commissioners/ Commissioners in the field offices of both the Boards. The entire exercise may well be completed before the conference of Chief Commissioners called by FM towards the later part of the month.

Transport Allowance should not be taxable

As per existing guidelines, Transport Allowance to the extent of Rs.800/- (old TPA) only is exempted from Income Tax. After implementation of 6th Pay Commission Report, however the amount of TPA has been increased to Rs..3200+DA. The CBDT may kindly issue necessary instructions for exemption of the entire amount of Transport Allowance, which is given in performance of duty.

Anyone interested may first see the proposal submitted by the ISS Association, Eastern Chapter, Kolkata which is still valid and comprehensive. Residency Index is only one necessary criterion. Postings at other places, by class of city are also important. It also covers return policy. Own cost transfer even after serving two years in NE Region is against the Government Policy. However, present stay ignoring earlier postings is in no way an objective criterion.

Can the disclosure of advice given by CVC impede the process of investigation?

Information regarding the vigilance advice given by the Central Vigilance Commission (CVC) in the matter of the appellant was denied by the Public Information Officer (PIO) citing the exemption provisions contained in section 8(1)(h) of the RTI Act stating that the disclosure of the information would impede the process of investigation. The Central Information Commission (CIC) observed that it is not clear how the disclosure of the advice given by the CVC in this case including the relevant file noting would impede the process of the disciplinary proceeding/ prosecution of the official concerned. The advice tendered by the CVC is an input based on which the competent authority decides about the nature of the disciplinary action to be taken in any particular case. The Commission further held that the affected person should have a natural right to know about the advice and the manner it is tendered. The CIC directed the PIO to provide the advice tendered by the CVC in this case including the file noting leading to the advice.

Comments

The manner in which the vigilance enquiries are being conducted require a drastic change in the post RTI era. New mechanism and procedure need to be devised to effectively conduct the investigations in a transparent manner.
